SUBJECT: WATER TANKS AND FACILITIES IMPROVEMENT PROJECT (CIP 405-660) AND THE SEISMIC IMPROVEMENTS AT THE
LAGOON PUMP STATION PROJECT (CIP 301-690) – NOTICES
OF COMPLETION
RECOMMENDATION
It is recommended that the Board of Directors of the Estero Municipal Improvement District (EMID) and the City Council of the City of Foster City adopt the attached resolutions (Attachments 1 & 2 respectively) authorizing acceptance of the work performed by Manito Construction, Inc. for the construction of the Water Tanks and Facilities Improvement Project (CIP 405-660) and the Seismic Improvements at the Lagoon Pump Station Project (CIP 301-690).
EXECUTIVE SUMMARY
CIP 405-660 includes various needed maintenance and improvements on EMID’s water storage tanks and water booster pump station. The project additionally installed an
automatic flushing device on Baffin Street to help maintain water quality. CIP 301-690 includes various minor seismic improvements at the City’s lagoon pump station.
On November 6, 2023, the District Board adopted EMID Resolution No. 3748 and City Council adopted City Resolution No. 2023-106 approving a construction agreement with Manito Construction, Inc. in the amount of $4,353,252 to construct both projects.
The work has been completed in conformance with the contract documents. It is recommended that the EMID Board of Directors and Foster City City Council accept the work and direct the District Secretary/City Clerk to file the NOCs and close out the projects.
BACKGROUND/ANALYSIS
CIP 405-660 is comprised of the following four (4) projects that were previously identified in the capital improvement project budgets: (a) CIP 405-660 Remove and Recoat Water Tanks 1, 2, and 3 (2016-2017); (b) CIP 405-670 Water Quality Dosing and Tank Improvements (2017-2018); (c) CIP 405-687 Seismic Improvements at Water Booster Pump Station (2019-2020); and (d) CIP 405-688 Seismic Improvements at Water Tanks 1, 2, and 3 (2019-2020).
On August 5, 2019, the EMID Board adopted EMID Resolution No. 3490 authorizing:
(1) the award of a consultant agreement with Consor North America (Consor) (dba MurraySmith) in the amount of $393,013 to provide design and construction support for the former CIPs 405-660, 405-670, and 405-688; (2) combining three projects into a single project; and (3) renaming the single project: CIP 405-660 Water Tank Improvements Project.
On April 20, 2020, the EMID Board adopted EMID Resolution No. 3508, which included authorizing: (1) the award of Contract Amendment No. 1 with Consor in the amount of $57,912 to include the design and construction support for CIP 405-687; (2) combining former CIPs 405-687 and 405-660 into a single project; and (c) renaming the single project: CIP 405-660 Water Tanks and Facilities Improvements Project.
On April 20, 2020, City Council adopted City Resolution No. 2020-35 authorizing the award of a professional engineering services agreement in the amount of $88,075 for CIP 301-690 Seismic Improvements at the Lagoon Pump Station Project to Consor.
Given that the two projects had some overlap in type of work and sharing the same location, the projects were designed and packaged together as one in order to take advantage of economies of scale.
On September 28, 2020, the Council/Board accepted by Minute Order, the Report/Memo outlining project’s repair design recommendations for the overall Project.
In early 2021, the project was put on hold, while the Engineering Division worked on filling a number of staffing vacancies. The project was subsequently restarted in 2023.
At its July 17, 2023, City Council/Board meeting, the City Council adopted City Resolution No. 2023-79 and the EMID Board adopted EMID Resolution No. 3738 authorizing the Call for Bids for the subject project.
On November 6, 2023, the District Board adopted EMID Resolution No. 3748 and City Council adopted City Resolution No. 2023-106 approving a construction agreement with Manito Construction in the amount of $4,353,252 and established a contingency in the amount of $640,000 for CIP 405-660 and $13,000 for CIP 301-690. Under the same resolutions, the District Board also approved Contract Amendment No. 4 (CA #4) with Consor, in the amount of $121,270 for CIP 405-660 and Contract Amendment No. 1 (CA #1) in the amount of $7,053 for CIP 301-690, to provide part-time construction support services. These part-time services were to supplement City engineering staff in performing inspection and construction management duties.
During construction, one contract amendment (CA #5) in the amount of $32,906 was issued to Consor to align with Contract Change Order #6 which increased scope and added more contract time for construction than originally anticipated for CIP 405-660.
Construction began in January 2024 and was substantially completed in May of 2025.
On May 19, 2025, the District Board adopted EMID Resolution No. 3802, approving a $75,000 increase in the project contingency to fund a portion of the installation of seismic expansion joints at the water booster pump station. This remaining scope was completed in late June, 2025. The contractor has completed all punch list items of work and the final invoice for work was received in July 2025.
During the course of the project, seven (7) contract change orders were issued to Manito Construction, resulting in a net increase in the contract value by $611,044.81. The majority of these change orders were a result of increased corrosion found in the roof rafters of all three steel water storage tanks, the remediation and removal of oil encountered at the base of Tank number one, and most significantly, the redesign and additional piping required to install the seismic joints on the discharge lines of the water booster pump station.
Given that Manito Construction has completed its work in conformance with the contract documents, it is recommended that the District Board and City Council accept the work and direct the District Secretary/City Clerk to file the NOCs for the projects.
