RESOLUTION NO.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE ESTERO MUNICIPAL

IMPROVEMENT DISTRICT APPROVING THE REVISED SEWER SYSTEM

MANAGEMENT PLAN AS REQUIRED BY THE STATE WATER RESOURCES

CONTROL BOARD STATEWIDE GENERAL WASTE DISCHARGE REQUIREMENTS FOR SANITARY SEWER SYSTEMS; AND FINDING THE APPROVAL EXEMPT FROM

REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) GUIDELINES SECTIONS 15061(b)(3) AND 15301

ESTERO MUNICIPAL IMPROVEMENT DISTRICT
WHEREAS, On December 6, 2022, the State Water Resources Control Board adopted Statewide Waste Discharge Requirements General Order for Sanitary Sewer Systems (Order No. 2022-0103-DWQ) which amended the SWRCB General Order 2006- 0003-DWQ and the Monitoring and Reporting Program from Order WQ 2013-0058-EXEC; and
WHEREAS, the purpose of the Wastewater Discharge Requirements (WDR) is to develop a regulatory mechanism to provide a consistent statewide approach for reducing sanitary sewer overflows; and
WHEREAS, the WDR requires preparation of a Sewer System Management Plan (SSMP) consisting of eleven (11) separate elements; and WHEREAS, the Sewer System Management Plan (SSMP) was approved by the District Board on January 5, 2009 and subsequently an updated plan was approved by the District Board on April 3, 2017; and
WHEREAS, the Public Works Wastewater Division recommends the Estero Municipal Improvement District’s update of the SSMP for adoption by the Board of Directors.

NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Estero Municipal Improvement District does hereby approve the Sewer System Management Plan as required by the State Water Resources Control Board Statewide General Waste Discharge Requirements for Sanitary Sewer Systems and authorizes staff to comply with the Sewer System Management Plan, Statewide General Waste Discharge Requirements, and the State Water Resources Control Board requirements, and finds that the adoption of this resolution is exempt from CEQA under the common sense exemption, as CEQA applies only to projects with the potential for significant environmental impacts. Since this activity has no such impact, it is not subject to CEQA per CEQA Guideline Section 15061(b)(3), and 15301, Existing Facilities, which allows for the operation and maintenance of existing public facilities with negligible or no expansion of use. 3 5
