THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO SECTION 15061(B)(3) AND SECTION 15304 (CLASS 4)
CITY OF FOSTER CITY
WHEREAS, annual routine maintenance keeps the City’s trees healthy and protects infrastructure and public safety; and
WHEREAS, some trees must be removed due to structural instability, potential damage to surrounding infrastructure, or disease; and
WHEREAS, funding of $50,000 is available in the FY 2025-26 budget for contractual services for routine tree maintenance, with programmed increases in subsequent fiscal years; and
WHEREAS, per unit costs were solicited through the issuance of a Request for Proposals for pruning, removal, and stump grinding services; and WHEREAS, A Plus Tree, Inc. submitted the lowest responsible and responsive proposal on a per unit basis for the required services; and WHEREAS, the contract term is November 1, 2025, through June 30, 2028, with the option to extend for up to two additional one-year terms through June 30, 2030.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Foster City does hereby find the project exempt from review under the California Environmental Quality Act (CEQA) pursuant to Public Resources Code Section 15061(b)(3), as the routine maintenance of City-owned trees does not have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Additionally, the approval is categorically exempt pursuant to section 15304 of the CEQA Guidelines as the work will include minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees.
