A RESOLUTION OF THE BOARD OF DIRECTORS OF THE ESTERO MUNICIPAL IMPROVEMENT DISTRICT AUTHORIZING THE EXECUTION OF TASK ORDER 2025- 03 WITH EKI ENVIRONMENT & WATER, INC. IN THE AMOUNT OF $69,900 TO DEVELOP THE 2025 URBAN WATER MANAGEMENT PLAN AND WATER
SHORTAGE CONTINGENCY PLAN; APPROVING A PROJECT CONTINGENCY IN THE AMOUNT OF $14,000 WITH AUTHORITY GIVEN TO THE DISTRICT MANAGER TO EXECUTE CONTRACT AMENDMENTS UP TO THE CONTINGENCY AMOUNT;
AND FINDING THE APPROVAL EXEMPT FROM CEQA PURSUANT TO SECTION 15282 (v) OF THE CEQA GUIDELINES
ESTERO MUNICIPAL IMPROVEMENT DISTRICT
WHEREAS, Assembly Bill (AB) 797 (Water Code Section 10610 et seq.), known as the Urban Water Management Planning Act, enacted by the California Legislature during the 1983-1984 Regular Session, which subsequently has been amended by AB 2661, mandates that every supplier providing water for municipal purposes to more than 3,000 customers or supplying more than 3,000 acre-feet of water annually, prepare an Urban Water Management Plan (UWMP); and
WHEREAS, Estero Municipal Improvement District (EMID) is an urban supplier of water providing water to over 30,000 customers; and
WHEREAS, the UWMP addresses long-term water supply, demand, and reliability and includes a Water Shortage Contingency Plan (WSCP) to outline the water supplier’s response and plan for changes or shortages in water supplies; and WHEREAS, the UWMP and WSCP are required to be updated every five years; and
WHEREAS, EMID updated and adopted its UWMP and WSCP in 2020 per EMID Resolution No. 3596 and EMID Resolution No. 3597, respectively, in compliance with requirements; and
WHEREAS, EKI Environment & Water, Inc. (EKI) has extensive experience preparing UWMPs and WSCPs, and has demonstrated its capability by preparing the 2020 UWMP for EMID as well as multiple other agencies; and WHEREAS, EKI has an approved Master Services Agreement with EMID for Water and Wastewater Engineering Services under which EMID can access on-call professional services by Task Order; and

WHEREAS, the full cost of the 2025 Urban Water Management Plan was assumed in the approved FY 2025-26 budget such that funding is available in Account No. 128- 0838-419-4251 General Plan Maintenance Fund; and
WHEREAS, the preparation and adoption of Urban Water Management Plans is exempt from CEQA pursuant to Section 15282 (v) per the provisions of Section 10652 of the Water Code.
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Estero Municipal Improvement District does hereby:
1. Authorize the President to execute Task Order 2025-03 with EKI Environment & Water, Inc. in the amount of $69,900 to develop the 2025 UWMP and WSCP; and
2. Establish a contingency in the amount of $14,000 with authority given to the District Manager or his designee to execute contract amendments up to the contingency amount.
BE IT FURTHER RESOLVED that the President is hereby authorized to execute the Task Order, with minor, non-substantive revisions that may be approved by the City Attorney, and to execute any other necessary documents to effectuate the terms of the Task Order.
