A RESOLUTION OF THE BOARD OF DIRECTORS OF THE ESTERO MUNICIPAL IMPROVEMENT DISTRICT APPROVING AMENDMENT 1 TO THE TASK ORDER WITH CONSOR PMCM, INC. FOR CONSTRUCTION MANAGEMENT AND
INSPECTIONS SERVICES FOR THE FUEL SYSTEMS IMPROVEMENTS PROJECT (CIP 301-700) IN THE AMOUNT OF $114,640; A SUPPLEMENTAL APPROPRIATION OF $114,640 TO ACCOUNT NUMBER 301-0910-700-4251; AND FINDING THE
APPROVAL EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES §15061(B)(3)
ESTERO MUNICIPAL IMPROVEMENT DISTRICT
WHEREAS, the Estero Municipal Improvement District’s unleaded and diesel fuel systems are at the end of their useful lives and should be replaced due to safety, regulatory compliance, and environmental concerns; and
WHEREAS, on December 16, 2024, the Board of Directors adopted EMID Resolution No. 3787 awarding construction contract to West Star Environmental, Inc. and construction management and inspection services contract to Consor; and WHEREAS, due to unforeseen underground conflicts encountered during construction the project completion date has been delayed by approximately two-and-a- half months; and
WHEREAS, the continuation of construction management and inspection services is necessary to complete the project; and
WHEREAS, the established contingency for construction management services in the amount of $30,000 is insufficient to fully fund the additional scope of work required to complete the project; and
WHEREAS, total funding in the amount of $4,222,000 is approved for CIP 301- 700 project budget; and
WHEREAS, the current project budget does not include sufficient funding to accommodate the additional scope of work; and
WHEREAS, this Project is categorically exempt pursuant to CEQA Guidelines Section 15301(b) – Existing Facilities.
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Estero Municipal Improvement District does hereby authorize:

1. The District Manager to execute Amendment No. One (1) to the Task Order with Consor PMCM, Inc. in the amount of $114,640 for Construction Management & Inspection services for the Fuel Systems Improvements Project (CIP 301-700); and
2. A supplemental appropriation of $114,640 to the Fuel Systems Improvement Project (CIP 700) Account 301-0910-700-4251 funded by (a) $28,660 from the Water Enterprise CIP Fund 405; (b) $28,660 from the Wastewater Enterprise CIP Fund 455; and (c) $57,320 from the City CIP Fund 301.
PASSED AND ADOPTED as a resolution of the Board of Directors of the Estero Municipal Improvement District at the regular meeting held on the 20 th day of October 2025, by the following vote:
