A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOSTER CITY
AUTHORIZING THE CITY MANAGER TO SETTLE WORKERS COMPENSATION CLAIMS UNDER $50,000 NOT INCLUDING STATUTORY REQUIRED PAYMENTS
CITY OF FOSTER CITY
WHEREAS, effective July 1, 2025, Foster City was granted approval to self-insure workers’ compensation claims as part of the transition out of the Cities Group Joint Powers Authority; and
WHEREAS, effective August 1, 2025, all open and closed claims were forwarded to LWP Claims Solutions, Inc. as the City’s third-party administrator for workers’ compensation claims; and
WHEREAS, in order to settle workers’ compensation claims, best practice dictates that the City Manager be authorized to settle claims under $50,000 not including statutory required payments; and
WHEREAS, statutory payments are the mandatory temporary disability payments and other payments separate and apart from the settlement amounts agreed to by injured worker; and
WHEREAS, any claim settlements in excess of $50,000, not including statutory required payments, will be brough to the City Council for review and approval.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Foster City approves the resolution authorizing the City Manager to settle workers’ compensation claim settlements under $50,000, not including statutory required payments as specified herein.
PASSED AND ADOPTED as a resolution of the City Council of the City of Foster City at the regular meeting held on the 3rd day of November 2025, by the following vote:
