RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOSTER CITY AUTHORIZING THE MAYOR TO EXECUTE CONTRACT AMENDMENT NO. 3 TO THE EXISTING AGREEMENT WITH 4LEAF, INC. (4LEAF) FOR PROFESSIONAL ON-CALL BUILDING SERVICES, TO EXTEND THE TERM OF THE AGREEMENT TO JUNE 30, 2027 AND INCREASE THE AMOUNT OF COMPENSATION BY $550,000 FOR A TOTAL AGREEMENT AMOUNT NOT TO EXCEED $875,000; APPROVING A SUPPLEMENTAL APPROPRIATION OF $300,000 FOR BUILDING DIVISION PROFESSIONAL SERVICES (ACCOUNT NO. 001-0820-424-4251) FROM THE
GENERAL FUND RESERVES, AND FINDING THE REQUEST EXEMPT FROM THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES 15061(B)(3)
CITY OF FOSTER CITY
WHEREAS, the Building Division is responsible for ensuring that all construction projects permitted within the City comply with the California Building Code, the Foster City Municipal Code, and all other applicable codes and regulations; and WHEREAS, the Building Division has a limited staff comprising of six (6) full time positions and one (1) temporary position (recently approved Principal Building Inspector) providing services related to all construction permit activity in the City, and limited staffing poses a significant challenge in providing continuous and uninterrupted building division services; and
WHEREAS, to address these challenges, on July 15, 2024, the City Council approved professional on-call building service agreements with 4LEAF, Inc. (4Leaf) and West Coast Code Consultants, Inc. (WC3) in an amount not to exceed $150,000 each to provide coverage during staff absences, ensuring continuity of services, increased flexibility, cost-effectiveness, and enhanced customer satisfaction for a period to two years ending June 30, 2026; and
WHEREAS, on April 7, 2025, the City Council approved Contract Amendment No. 1 to the existing agreement with 4Leaf in an additional amount of $75,000; and WHEREAS, on July 21, 2025, Contract Amendment No. 2 in the amount of $100,000 was added to the 4Leaf agreement for continuing on-call building services through a supplemental appropriation; and
WHEREAS, the remaining funds in the 4Leaf agreement will not be enough to ensure staffing coverage during upcoming training or unforeseen absences and vacancies; and
WHEREAS, staff is recommending that the City Council approve contract amendment No. 3 to the existing Contract Agreement with 4Leaf for professional on-call building services, including additional amount of $550,000 and extending the term to June 30, 2027 and a supplemental appropriation of $300,000 for Building Division professional services (account No. 001-0820-424-4251) from the General Fund reserves. 4898-0699-3781 v1
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Foster City does hereby authorize the Mayor to execute Contract Amendment No. 3 to the existing Agreement with 4Leaf, to extend the term to June 30, 2027, and increase compensation by $550,000 for a total maximum contract amount not to exceed $875,000.
BE IT FURTHER RESOLVED, that the Council hereby approves a supplemental appropriation of $300,000 for Building Division professional services (account No. 001- 0820-424-4251) for FY25-26 from the General Fund reserves.
BE IT FURTHER RESOLVED, that the Mayor is authorized to execute Contract Amendment No. 3 to the existing Agreement with 4Leaf, with minor amendments in a form approved by the City Attorney.
