AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH HABITAT FOR

PROVIDE CONSTRUCTION SERVICES FOR LOWER INCOME HOMEOWNERS TO IMPLEMENT PROGRAM H-B-2-A OF THE 2023-2031 HOUSING ELEMENT; APPROVING AN APPROPRIATION OF $861,750 FROM COMMERCIAL LINKAGE FEE FUND (FUND 137) TO ACCOUNT NUMBER 137-0847-419-42-51; AND FIND

APPROVAL OF THE PROGRAM EXEMPT FROM THE CEQA PURSUANT TO SECTION 15061(B)(3) and 15301

CITY OF FOSTER CITY
WHEREAS, the Housing Element is an integral part of the Foster City General Plan that identifies the City’s housing needs, states the City’s goals and objectives regarding housing production, rehabilitation, preservation, and conservation to meet those needs, and defines the policies and programs; and WHEREAS, Government Code Section 65400 requires each jurisdiction to prepare an annual progress report (APR), due to the California Department of Housing Community Development (HCD) by April 1, on the jurisdiction’s status and progress in implementing its housing element; and
WHEREAS, the Housing Element includes Program H-B-2-a, Lower-Income Homeowner Rehabilitation Loans, to provide or partner with a regional program to provide new rehabilitation loans, energy improvements such as weatherization or solar, disaster assistance programs, and proactive outreach to lower-income homeowners, and the quantified objective to issue 18 new loans by 2031, or three (3) per year, half of which being very low income and half of which being low income; and WHEREAS, the implementation of the program requires collaboration with third parties; and
WHEREAS, staff issued a request for proposals for the Home Rehabilitation Program on September 15, 2025, posted it on the City’s website, and an email soliciting proposals was sent to multiple recipients, including the Housing Endowment and Regional Trust of San Mateo County (HEART), Meriwest Credit Union, AmeriNat, Habitat for Humanity Greater San Francisco (HGSF), Together Peninsula, Thrive Alliance for Nonprofits, Housing Leadership Council of San Mateo County, and HIP Housing; and WHEREAS, staff received one response from HGSF, which will be partnering with AmeriNat for loan servicing; and
WHEREAS, staff reviewed the proposal and noted that HGSF has extensive experience in administering home rehabilitation and repair programs; and 4 1

WHEREAS, staff is proposing that the agreement with HGSF is for three (3) years, with a maximum amount of $861,750; and
WHEREAS, there is approximately $5.7 million available in the fund balance, which is sufficient to absorb this supplemental appropriation.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Foster City does hereby:

1. Authorize the Mayor to execute an Agreement with Habitat for Humanity Greater San Francisco, Inc. for a three (3) year term in an amount not to exceed $861,750 for the Home Rehabilitation Program to issue loans and provide construction services for eligible Foster City homeowners, with minor amendments that may be approved by the City Attorney.

2. Approve the appropriation of $861,750 from Fund 137 to account number 137- 0847-419-42-51.

3. The Council finds that the approval of the implementation of the Home Rehabilitation Program would be administrative and not result in physical changes to the environment and would be exempt pursuant to CEQA Guidelines Section 15061(b)(3). The Home Rehabilitation Program will enable a homeowner to rehabilitate their existing home, which would be categorically exempt pursuant to CEQA Guidelines Section 15301, as the rehabilitation of existing homes will involve negligible or no expansion of existing or former use.
