A RESOLUTION OF THE BOARD OF DIRECTORS OF THE ESTERO MUNICIPAL
IMPROVEMENT DISTRICT ACCEPTING THE ANNUAL DEVELOPMENT IMPACT FEE AND CAPACITY FEE REPORT FOR FISCAL YEAR 2024-2025
ESTERO MUNICIPAL IMPROVEMENT DISTRICT
WHEREAS, local agencies often charge fees as a condition of approval for development projects to fund improvements to compensate for the demands that the developments have on public resources known as Development Impact Fee; and WHEREAS, in 1989, the State Legislature passed Assembly Bill 1600 (AB 1600), which added Sections 66000 et seq. to the California Government Code known as Mitigation Fee Act (“MFA”); and
WHEREAS, City/District assesses four Development Impact Fees for Affordable Housing, Park Facilities, Public Safety, and Transportation– and two Capacity Fees for Water and Wastewater; and
WHEREAS, pursuant to Government Code Sections 66001 (d), 66006 (b)(1), and 66013 (d), MFA requires local agencies to report the Impact fees and Capacity fees collected and their use annually; and
WHEREAS, staff has completed the Annual Development Impact Fee and Capacity Fee Report for Fiscal Year 2024-2025.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Estero Municipal Improvement District does hereby accept the Annual Development Impact Fee and Capacity Fee Report for the Fiscal Year 2024-2025.
PASSED AND ADOPTED as a resolution of the Board of Directors of the Estero Municipal Improvement District at the Regular Meeting held on the 15th day of December 2025 by the following vote:
