FIND APPROVAL OF THE PROGRAM EXEMPT FROM THE CEQA PURSUANT TO SECTION 15061(B)(3) and 15301

CITY OF FOSTER CITY
WHEREAS, the Housing Element is an integral part of the Foster City General Plan that identifies the City’s housing needs, states the City’s goals and objectives regarding housing production, rehabilitation, preservation, and conservation to meet those needs, and defines the policies and programs; and WHEREAS, Government Code Section 65400 requires each jurisdiction to prepare an annual progress report (APR), due to the California Department of Housing Community Development (HCD) by April 1, on the jurisdiction’s status and progress in implementing its housing element; and
WHEREAS, the Housing Element includes Program H-B-2-b, Facilitate Non-Profit Rehabilitation/Maintenance Assistance, to partner with a non-profit organization to provide up to $5,000 in funding to very low-income homeowners who cannot otherwise afford the repairs, and the quantified objective is to improve six (6) units with assistance by 2031; and
WHEREAS, the implementation of the program requires collaboration with third parties; and
WHEREAS, staff issued a request for proposals for the Minor Home Repair Program on September 15, 2025, posted on the City’s website, and an email soliciting proposals was sent to multiple recipients, including the Housing Endowment and Regional Trust of San Mateo County (HEART), Habitat for Humanity Greater San Francisco (HGSF), Rebuilding Together Peninsula, Foster City Lions Club, Thrive Alliance for Nonprofits, Housing Leadership Council of San Mateo County, HIP Housing, and the Peninsula Clergy Network; and

WHEREAS, staff is proposing that the agreement with Rebuilding Together Peninsula be for two (2) years, with a maximum amount of $17,500; and WHEREAS, there is approximately $5.7 million available in the fund balance, which is sufficient to absorb this supplemental appropriation.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Foster City does hereby:

1. Authorize the City Manager to execute an Agreement with Rebuilding Together Peninsula, in an amount not to exceed $17,500 for the Minor Home Repair Program for eligible Foster City homeowners for a term of two (2) years, with minor amendments that may be approved by the City Attorney.

2. Approve the appropriation of $17,500 from Fund 137 to account number 137- 0847-419-42-51.

3. The Council finds that the approval of the implementation of Minor Repair Program, would be administrative and not result in physical changes to the environment and would be exempt pursuant to CEQA Guidelines Section 15061(b)(3). The Minor Home Repair Program will enable a homeowner to make minor repairs to their existing home, which would be categorically exempt pursuant to CEQA Guidelines Section 15301, as the repair of an existing home will involve negligible or no expansion of existing or former use.
