FOR THE REMOVAL OF THE UNDERGROUND STORAGE TANK
AT LIFT STATION 29 AS PART OF THE EMERGENCY
GENERATOR REPLACEMENT PROJECT (CIP 455-705)

RECOMMENDATION
It is recommended that the Board of Directors of the Estero Municipal Improvement District (EMID) adopt the attached resolution authorizing:

1. The President to execute an agreement with Patriot Environmental Services (Patriot) in the amount of $162,227 for the removal of the Underground Storage Tank (UST) at Lift Station 29 as part of the Emergency Generator Replacement Project (CIP 455-705); and

2. The establishment of a construction contingency in the amount of $32,000 with authorization given to the District Manager or his designee to execute contract change orders up to the contingency amount; and

3. Finding that the Project is categorically exempt pursuant to CEQA Guidelines Section 15301(b) – Existing Facilities.

EXECUTIVE SUMMARY
CIP 455-705 includes the removal of a UST, day fuel tank and associated equipment which fuel the back-up generator at Lift Station 29. The current tank is no longer in use, not in compliance and not required for the new generator that will be installed in Summer 2026. Freyer and Laureta, Inc. (F&L) are the Engineers of Record who developed construction documents for the project.

Two (2) bids for the construction of CIP 455-705 were received and opened on Wednesday, November 20, 2025, following an informal bid solicitation. The bid submitted by Patriot in the amount of $162,227 was determined to be the lowest responsible and responsive bid.

Construction is anticipated to start in March 2026 and is estimated to take two months to be completed. MCK America, Inc. (MCK) will provide construction management, inspection and support services throughout the duration of construction.

There are adequate funds in the project budget for CIP 455-705 to cover the cost of construction.

BACKGROUND/ANALYSIS
CIP 455-705 was approved by the District Board as part of the Fiscal Year 2021-2022 budget to address the replacement of emergency generators at ten (10) of the District’s wastewater lift stations (Lift Stations 10, 12, 14, 15, 16, 22, 26, 29, 41 and 59).

The project scope includes the removal of a UST located within the Bank of America parking lot at 909 East Hillsdale Boulevard that fuels the back-up generator for Lift Station

29. The UST has experienced ongoing failures in passing Line Tightness tests, which checks if the underground fuel pipes are leaking and has recently failed an Acoustic Monitoring inspection, which uses sensors to detect corrosion/leaks, conducted by San Mateo County Health’s Environmental Health Services. Although decommissioned, testing is required to be conducted annually until its final removal. In March 2025, staff decided to expedite the removal of the UST, ahead of construction of the generator replacements project, to avoid further violations and potential fees. The work will include the removal of the day fuel tank, any conduit, wiring, and equipment connected to the UST both inside and outside of the Bank of America building. The existing generator will remain and be removed during the installation of the new generator.

Based on the estimated construction cost provided by F&L, bids were solicited through an informal bidding process. Bids for this project were opened on Thursday, November 20, 2025, with the following results:

Name of Company Total Bid $ Over/(Under)
Engineer’s
Estimate
% Over/(Under)
Engineer’s
Estimate
Engineer’s Estimate $140,445.00 $ - - %
Patriot Environmental Services $162,227.00 $21,782.00 16% Gems Environmental
Management Services
$329,692.80 $189,247.80 135%
Patriot submitted the lowest responsible and responsive bid, in the amount of $162,227.

The bid amount is above the engineer’s estimate by $21,782.00 or 16%. Staff conducted an extensive evaluation of Patriot and found their previous experience to be satisfactory and in line with what staff expect for this project. Patriot has provided all the required documents and licenses.

Construction duration is 60 calendar days and is anticipated to start in March 2026 and be completed by May 2026. MCK will provide construction management, inspection and support services throughout the duration of construction. F&L will provide construction support services during construction and produce record drawings post-construction.

Staff is coordinating construction with Bank of America’s property managers and the City’s Maintenance Division to ensure uninterrupted service during the work and will work around the bank’s operational hours, if needed.

CEQA
Categorically Exempt pursuant to CEQA Guidelines Section 15301(b) – Existing Facilities.

FISCAL IMPACT
There are adequate funds in the project budget for construction. A construction contingency of $32,000 or approximately 20% of the total bid amount of $162,227 is requested to pay for any unforeseen conditions during construction. The higher contingency percentage is proposed as this type of work may lead to discovering unforeseen environmental mitigation needs. Any unused money, including contingency remaining following construction, will be retained in the project budget for the remaining project scope to replace the emergency generators.
