SUBJECT: AMENDMENT TO EXTEND JOINT USE AGREEMENT WITH SAN
MATEO-FOSTER CITY SCHOOL DISTRICT
RECOMMENDATION
It is recommended that the City Council adopt a resolution approving an amendment to the Joint Use Agreement (JUA) between the City of Foster City/Estero Municipal Improvement District (CITY/EMID) and the San Mateo-Foster City School District (SCHOOL DISTRICT) to extend the term of the agreement through June 30, 2026.
EXECUTIVE SUMMARY
The existing JUA between CITY/EMID and the SCHOOL DISTRICT is set to expire on April 30, 2026. Staff recommend approval of a short-term, two-month extension through June 30, 2026. This extension will allow both agencies sufficient time to finalize updates to the agreement and return with a new multi-year agreement aligned with both agencies’ fiscal years (July through June).
BACKGROUND/ ANALYSIS
The CITY/EMID has had a JUA with the SCHOOL DISTRICT since 1991 for the joint use of Audubon, Foster City, and Brewer Island School facilities. On April 23, 2023, CITY/EMID and the SCHOOL DISTRICT entered a JUA for shared use of facilities, with a term from May 1, 2023, through April 30, 2026. The JUA supports collaborative use of public facilities and promotes efficient use of community resources. As the current agreement approaches expiration, both CITY/EMID and the SCHOOL DISTRICT have identified the need to update and refine certain provisions within the JUA. Additionally, both parties desire to align the agreement term with their respective fiscal years, which run from July 1 through June 30.
To facilitate this transition, staff recommend extending the current JUA for an additional two months, through June 30, 2026. This extension will provide the necessary time to:
Incorporate recommended edits and updates to the JUA
Ensure consistency with current operational practices
Align the agreement term with both agencies’ fiscal year cycles Prepare and present a new three-year JUA for formal approval Staff anticipate returning to the City Council in June 2026 with a new JUA for consideration and approval.
California Environmental Quality Act
Not Applicable
FISCAL IMPACT
There is no direct fiscal impact associated with this short-term extension. The amendment maintains the existing terms and conditions of the current agreement.
