SUBJECT:AMENDMENT TO EXTEND JOINT USE AGREEMENT WITH SAN

MATEO-FOSTER CITY SCHOOL DISTRICT

RECOMMENDATION
It is recommended that the City Council/EMID Board of Directors adopt a resolution authorizing the Mayor/President to execute an amendment to the Joint Use Agreement (JUA) between the City of Foster City/Estero Municipal Improvement District (CITY/EMID) and the San Mateo-Foster City School District (SCHOOL DISTRICT) to extend the term of the agreement through August 31, 2026.

EXECUTIVE SUMMARY
The existing JUA between the City/EMID and the School District expired on April 30, 2026. On May 4, 2026, a temporary extension through June 30, 2026, was approved by the City Council/EMID Board to allow both agencies time to negotiate and finalize a new multi-year agreement aligned with their fiscal years. As agreement terms remain under review and summer schedules have limited the ability to complete negotiations, staff recommend extending the current agreement through August 31, 2026, to provide additional time to finalize and execute the new long-term agreement.

BACKGROUND/ANALYSIS
The CITY/EMID and the SCHOOL DISTRICT have maintained a JUA since 1991 for

the shared use of facilities at Audubon, Foster City, and Brewer Island Schools. The agreement promotes efficient use of public resources and provides community access to recreational and educational facilities.

On April 23, 2023, CITY/EMID and the SCHOOL DISTRICT entered into the current JUA with a term from May 1, 2023, through April 30, 2026. As the agreement approached expiration, both parties identified opportunities to update and refine various provisions to better reflect current operational practices and align the agreement term with each agency’s fiscal year, which runs from July 1 through June

30. To provide additional time for negotiations and development of a new multi-year agreement, on May 4, 2026, City Council approved a short-term extension through June 30, 2026. Since that time, staff from both agencies have continued to review and negotiate agreement terms. While progress has been made, several provisions remain under review and require additional coordination before a long-term agreement can be finalized.

Due to summer schedules and operational commitments, staff recommend extending the current Joint Use Agreement through August 31, 2026. This extension will provide sufficient time for both parties to complete negotiations, finalize updated terms, and prepare a new multi-year agreement for formal consideration and approval by their respective governing bodies.
