A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOSTER CITY
AUTHORIZING THE FIRST AMENDMENT TO THE CONCESSION AGREEMENT
WITH EDGEWATER MARINE LLC FOR BOAT RENTAL SERVICES, EXTENDING THE AGREEMENT THROUGH SEPTEMBER 30, 2026 AND AUTHORIZING THE MAYOR
TO EXECUTE THE AMENDMENT
CITY OF FOSTER CITY
WHEREAS, on January 4, 2021, the City Council approved a Concession Agreement with Edgewater Marine LLC to provide boat rental services within the City of Foster City, with an initial term from January 1, 2021 through June 30, 2026; and WHEREAS, Edgewater Marine LLC, has provided a proposal under which the City of Foster City will receive a concession fee of 7% of gross revenues during the term of January 1, 2021 through June 30, 2026, with optional extensions through June 30, 2030; and
WHEREAS, the current Concessions Agreement for boat rental is scheduled to expire on June 30, 2026; and
WHEREAS, Edgewater Marine LLC has expressed its desire to continue operating the concession and has maintained a cooperative working relationship with the City throughout the term of the agreement; and
WHEREAS, extending the agreement through September 30, 2026, will allow continued operation of boat rental services while providing additional time for staff to negotiate the terms of an agreement extension and to determine the most appropriate long-term operating strategy for lagoon-based recreation services; and WHEREAS, the City Council finds that extending the agreement through September 30, 2026 is in the best interest of the City and its residents.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Foster City does hereby approve a First Amendment to the Concession Agreement with Edgewater Marine LLC for Boat Rental Services, extending the agreement thorough September 30, 2026, and authorizes the Mayor to execute the agreement amendment on behalf of the City.
