A RESOLUTION OF THE BOARD OF DIRECTORS OF THE ESTERO MUNICIPAL
IMPROVEMENT DISTRICT APPROVING THE AMENDMENT TO THE JOINT USE
AGREEMENT BETWEEN THE CITY OF FOSTER CITY/ESTERO MUNICIPAL
IMPROVEMENT DISTRICT AND THE SAN MATEO-FOSTER CITY SCHOOL DISTRICT, EXTENDING THE AGREEMENT THROUGH AUGUST 31, 2026, AND
AUTHORIZING THE BOARD PRESIDENT TO EXECUTE THE AMENDMENT
ESTERO MUNICIPAL IMPROVEMENT DISTRICT
WHEREAS, the City of Foster City/Estero Municipal Improvement District (“CITY/EMID”) and the San Mateo-Foster City School District (“SCHOOL DISTRICT”) entered into a Joint Use Agreement dated April 23, 2023, for the shared use of facilities, with a term from May 1, 2023 through April 30, 2026; and WHEREAS, on May 4, 2026, the CITY/EMID and the SCHOOL DISTRICT approved a temporary extension of the agreement through June 30, 2026, to allow additional time to review and update agreement provisions and align the agreement term with both agencies’ fiscal years (July 1 through June 30); and WHEREAS, staff from both agencies have continued to review and negotiate updated agreement terms, and while progress has been made, several provisions remain under consideration; and
WHEREAS, due to summer schedules and operational commitments, additional time is needed to complete negotiations and finalize a new multi-year Joint Use Agreement; and
WHEREAS, the proposed Amendment would extend the term of the existing Joint Use Agreement through August 31, 2026; and
WHEREAS, City staff recommends approval of the Amendment to the Joint Use Agreement.
NOW, THEREFORE, BE IT RESOLVED that Board of Directors of the Estero Municipal Improvement District hereby authorizes the Board President to execute the Amendment to the Joint Use Agreement between the City of Foster City/Estero Municipal Improvement District and the San Mateo-Foster City School District, extending the term of the agreement through August 31, 2026.
