A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOSTER CITY AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACT AMENDMENT NO. 2 IN THE AMOUNT OF $35,000 WITH APEX TESTING LABORATORIES, INC. FOR
TESTING AND INSPECTION SERVICES ON THE FOSTER CITY COMMUNITY REBUILD PROJECT (CIP301-678)
CITY OF FOSTER CITY
WHEREAS, City Council adopted City Resolution No. 2024-92 on September 3, 2024, approving a task order agreement for material testing and inspection services with Apex Testing Laboratories, Inc. for $341,520 and a project contingency of $30,000; and WHEREAS, the original agreement scope did not include waterproof testing; and WHEREAS, the City Manager authorized Amendment No. 1 on April 20,2026 in the amount of $30,000; and
WHEREAS, funding is available in the project budget account number 301-0910- 678-4251 due to waterproof testing being budgeted for.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Foster City does hereby authorize the City Manager to execute contract amendment No. 2 with Apex Testing Laboratories, Inc. in the amount not-to-exceed $35,000 to provide testing and inspection services on the Foster City Community Center Rebuild Project (CIP 301- 678).
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the Agreements, in the forms attached hereto, with minor, non-substantive revisions that may be approved by the City Manager and the City Attorney, and to execute any other necessary documents to effectuate the terms of the Agreement.
