SUBJECT: Lift Station 59 Effluent Line Improvements Project (CIP 455-695) – Notice of Completion
RECOMMENDATION
It is recommended that the Board of Directors of the Estero Municipal Improvement District (EMID) adopt the attached resolution (Attachment 1) authorizing acceptance of the work performed by Performance Mechanical, Inc. (PMI) for the construction of the Lift Station 59 Effluent Line Improvements Project (CIP 455-695) and other related actions.
EXECUTIVE SUMMARY
CIP 455-695 includes improvements to provide Pump Station 59, the District’s final and largest capacity lift station, with enhanced operational flexibility and flow measurement accuracy and reliability.
On October 7, 2024, the District Board adopted EMID Resolution No. 3778 approving a construction agreement with PMI in the amount of $1,289,130 to construct the Project.
The work has been completed in conformance with the contract documents. It is recommended that the EMID Board of Directors accept the work and direct the District Secretary to file the Notice of Completion (NOC) and close out the project.
BACKGROUND
CIP 455-695 includes improvements to provide Pump Station 59, the District’s final and largest capacity lift station, with enhanced operational flexibility and flow measurement accuracy and reliability. The specific improvements designed to achieve these goals include the following:
1. Replace the flow meter that measures the volume of sewage that flows to the Wastewater Treatment Plan.
2. Design, purchase, and assemble a temporary bypass for the Pump Station that can be installed by staff and stored at the Corporation Yard to allow for repairs on the system without interrupting sewage flow to the Wastewater Treatment Plant.
3. Install a knife gate valve to allow for isolation of half the station for continued system operation during repairs and maintenance.
At its February 1, 2021 meeting, the EMID Board adopted EMID Resolution No. 3557 authorizing a consultant agreement with BKF Engineers for professional engineering services for the subject project. At its April 3, 2023, meeting, the EMID Board adopted EMID Resolution No. 3715 authorizing the Call for Bids for the project. However, the District received one sole bid, almost one million dollars over the engineer’s estimate. At its June 20, 2023, meeting, the EMID Board subsequently adopted EMID Resolution No. 3735 rejecting the sole bid and approved additional design work in order to rebid the project.
At its July 15, 2024 meeting, the EMID Board adopted EMID Resolution No. 3767 authorizing the Call for Bids based on revised plans and specifications.
On August 5, 2024, the EMID Board adopted EMID Resolution No. 3768 and City Resolution No. 2024-75 awarding a master agreement for professional on-call construction management services to Consor. Services as part of this agreement include construction management, inspection, materials testing and coordination and review of submittals, etc.
On October 7, 2024, the EMID Board adopted EMID Resolution No. 3778, authorizing the following: (1) the award of a construction agreement to Performance Mechanical, Inc. in the amount of $1,289,130; (2) the execution of a task order with Consor in the amount of $149,305 for construction management and inspection services; and (3) the execution of a contract amendment with BKF in the amount of $10,833 for construction support services.
ANALYSIS
The Project was initiated in November 2024 with the procurement of long lead time items. After the items were received, construction began in January 2026. Throughout the entire duration of the Project, only two contract change orders were issued to PMI, resulting in a small contract increase of $2,310.38, which is approximately 2% of the available contingency amount.
Contract Change Order #1 (CCO #1) resulted in a $13,901.30 credit. These savings were due to underground field conditions that allowed for a smaller, more cost-effective vault to house the flow meter than originally planned.
Contract Change Order #2 (CCO #2) increased the contract cost by $16,211.68 to accommodate out-of-scope items. This included the removal and disposal of an abandoned 30-inch diameter asbestos cement pipe, specialty adjustment of a ball valve, and additional paving.
Given that PMI has completed its work in conformance with the contract documents, it is recommended that the District Board accept the work and direct the District Secretary to file the Notice of Completion for the project.

FISCAL IMPACT
There is no fiscal impact associated with this resolution. The table below includes the project expenditure summary as of July 9, 2026:
Item CIP 695
Approved Budget $1,800,000.00
Project Expenditures
Construction Contract (PMI) $1,289,130.00
CCOs #1 and #2 $2,310.38
Design Contract (BKF) $178,959.00
Construction Management Contract
(Consor) $149,305.00
Amendment #1 $21,358.51
Miscellaneous Expenses $11,066.59
Total Anticipated Project Expense $1,652,129.48
The work has been completed, and the NOC is ready to be filed. Action by the EMID Board tonight will establish the official date of completion of the work performed by PMI, formalizing the District’s acceptance of the contract work and allowing for the release of retention to the contractor and encumbered funds for construction back to the project.
At project closeout, estimated to occur in approximately 2 months, any remaining funds in the project will return to the respective originating funds.
