o Bair Island Addling Efforts Must Continue. With 10,404 eggs addled, a strong understanding of local goose control needs, the region has made too much progress to “let it ride”. Considering Wildlife Innovations’ willingness to assume egg addling efforts on Bair Island, I signed up for another year to ensure a smooth transition.

DEPARTMENT: City Attorney
SUBJECT: Ratification of Proclamation of Local Emergency by the City Manager Related to 815 Sea Spray Lane Structure Fire Recovery

RECOMMENDATION
It is recommended that the City Council adopt the attached resolution ratifying the Proclamation of Local Emergency issued by the City Manager of the City of Foster City related to 815 Sea Spray Lane structure fire recovery.

EXECUTIVE SUMMARY
On August 2, 2026, a major six-alarm structure fire occurred at 815 Sea Spray Lane within the Spinnaker Cove condominium community. The incident caused extensive fire and structure damage to forty nine (49) condominium units and displaced more than one hundred (100) residents, with the resulting building being red-tagged and deemed uninhabitable. Impacted residents have lost their homes and have significant financial and recovery needs.

BACKGROUND/ANALYSIS
As a result of the conditions of disaster referenced above, the City Manager, in his capacity as Director of Emergency Services, determined that a “local emergency”1 existed and issued a Proclamation of Local Emergency on September 16, 2026. (See Attachment 1.) The City Clerk’s Office provided written notification of the Proclamation Item 8.1

Page 646 of 654 ends

to the appropriate departments within San Mateo County and the California Governor’s Office of Emergency Services pursuant to Government Code 8607.

Pursuant to Government Code section 8630(b), the City Council must ratify the Proclamation of Local Emergency within seven days of its issuance.

The City Council is now being asked to ratify the Proclamation of Local Emergency issued on September 16, 2026 so that the impacted residents may be potentially eligible to receive all State financial assistance.

CALIFORNIA ENVIRONMENTAL QUALITY ACT
The ratification of the Proclamation is not a project within the meaning of Section 15378 of CEQA Guidelines because it has no potential for resulting in either a direct or a reasonably foreseeable indirect physical change in the environment, either directly or ultimately.

FISCAL IMPACT
There is no fiscal impact to the City by ratification of the Proclamation.

RESOLUTION

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOSTER CITY RATIFYING

THE PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY BY THE CITY MANAGER OF THE CITY OF FOSTER CITY RELATED TO 815 SEA SPRAY LANE

STRUCTURE FIRE RECOVERY

CITY OF FOSTER CITY
WHEREAS, Government Code section 8630 and section 2.40.070 (A) of the Municipal Code empower the Director of Emergency Services to proclaim the existence of a local emergency when the City of Foster City (“City”) is affected or likely to be affected by an emergency, as that term is defined in Section 2.40.020 and the City Council is not in session; and
WHEREAS, the Director of Director of Emergency Services is identified in the Municipal Code as the City Manager; and
WHEREAS, on August 2, 2026, a major six-alarm structure fire occurred at 815 Sea Spray Lane within the Spinnaker Cove condominium community; and WHEREAS, San Mateo Consolidated Fire Department (SMCFD), the Foster City Police Department (FCPD), and assisting public agencies responded; and WHEREAS, the incident caused extensive fire and structural damage to forty-nine (49) condominium units, displaced more than one hundred (100) residents, injured four (4) firefighters, and resulted in the building being red-tagged and deemed unsafe for occupancy and general access; and
WHEREAS, there are no unmet emergency response needs; however, impacted residents have lost their homes and have significant financial and recovery needs, which include, but are not limited to the following: challenges associated with relocating in a very high cost, constrained housing market while replacing vehicles, household, and personal items. Impacted property owners face these same challenges while also facing mortgage payments and homeowners’ association dues on their condominium units that will likely not be rebuilt for at least three (3) or more years; and WHEREAS, as part of the ongoing recovery efforts, the City requested a physical disaster declaration through the U.S. Small Business Administration, which was approved on September 4, 2026. While these disaster loans will help some impacted residents, the combination of insurance, donated funds, relevant City and County programs, and SBA loans have not closed the recovery gaps for many residents who are facing long term displacement and other significant challenges associated with insurance and claims; and Item 8.1

Page 648 of 654 ends

4919-8521-8001 v1
WHEREAS, the City’s proclamation of emergency seeks any and all State financial assistance programs and options that may strengthen recovery for more than 100 residents who were impacted by the structure fire incident; including, but not limited to, income loss tax (Federal and State) deductions and supportive flexibilities, in addition to insurance extensions, Additional Living Expenses (ALE) coverage, CDI claims mediation and other forms of assistance; and
WHEREAS, the City Manager, acting as Director of Emergency Services, did find that conditions of disaster to persons and property within this City were met due to the significant unmet recovery needs; and
WHEREAS, in response to these developments, the City Manager in his capacity as the City’s Director of Emergency Services proclaimed the existence of a local emergency on September 16, 2026 at approximately 9:00 A.M.; and WHEREAS, as contemplated in the Emergency Service Act contained in Government Code Section 8550 et seq., including Section 8558(c), a local emergency exists because of the existence of conditions of disaster to the safety of persons and property within the City caused by the aforesaid conditions which are beyond the control of the services, personnel, equipment, and facilities of the City; and WHEREAS, the City Clerk has provided written notification of this Proclamation and other necessary documents to the appropriate departments within San Mateo County and the California Governor’s Office of Emergency Services pursuant to Government Code 8607.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Foster City does hereby resolve, declare, determine, and order as follows:

1. The Proclamation of Existence of a Local Emergency executed on September 16, 2026, attached hereto as “Attachment A” is hereby ratified and approved by the City Council; and

2. In accordance with Government Code section 8630, this local emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council of the City of Foster City, and it shall be terminated at the earliest possible date that conditions warrant.

3. The City Council shall review this Resolution as necessary pursuant to Government Code section 8630 until the Proclamation is terminated.
