Psomas Amendment No. 6 to CON 18-18
December 6, 2022
of Psomas’ original contract and Amendment No. 1, an amendment of the Cooperative Agreement with OCTA was necessary to provide additional funding to cover costs related to the City’s involvement in the I-405 project. City staff had initiated those discussions with OCTA in anticipation of the need to amend the Cooperative Agreement.
Following a lengthy negotiation process between OCTA project management staff and the City’s Public Works staff, an additional $1,985,000 provided by Amendment No. 3 to the Cooperative Agreement between OCTA and the City was approved by the OCTA Board of Directors on April 8, 2019. The additional funding was critical to allow the City to meet its commitment to supporting the project through its anticipated completion in 2023.
Per the terms of the Cooperative Agreement, the City has a responsibility to review, provide comments, approve plans and other submittals, field inspect improvements, attend field meetings, and many other project demands related to the I-405 Improvement Project on time to facilitate the OCTA's delivery of the project. As this project is being constructed via a designbuild (DB) process, the submittal review process is accelerated. Due to inadequate City staffing levels and the volume of work to deliver the City's CIP and handle normal, operating City business, it was identified in early 2018 that there would be a need to retain a consulting team to address the I-405 review process. To secure a consulting team, a Request for Proposals (RFP) was issued to five reputable consulting firms who have similar experience with this type of workflow and the I-405 project.
In response to the RFP, the City received two proposals: one from Psomas and one from Interwest. Upon review and ranking of the two proposals, Psomas was ranked higher. On April 3, 2018, the City awarded a contract to Psomas. As the I-405 project is expected to continue until end of 2023, the contract term with Psomas continues until December 2022. The structure of the contract is such that the scope of services and the corresponding fee will be reviewed annually with amendments to the original contract presented to City Council for review and approval. The original contract scope encompassed the period from April 3, 2018 (while reaching back a few weeks to capture reviews that are past due) through December 31, 2018.
During this time, Psomas' time spent and corresponding charges were slightly less than anticipated monthly which allowed their services to extend beyond December 2018 without need for an amendment until March 5, 2019. The original contract billed on a Time and Material basis as needed for amount not to exceed $643,452.
On March 5, 2019, Council approved Amendment No. 1 to Contract 18-18 for $180,000 from March 2019 through May 2019. On April 30, 2019, Council approved Amendment No. 2 to Contract 18-18 for $397,748 from June 2019 through December 2019. On March 17, 2020, City Council approved Amendment No. 3 to Contract 18-18 with Psomas for $681,954 from January 2020 through December 2020. On December 9, 2020, City Manager approved Amendment No. 4 for a time extension only from December 2020 through June 30, 2021. On May 4, 2021, the City Council approved Amendment No. 5 for $743,047 from July 2021 through December 2022.
It should be noted that the expenses incurred by the City for Psomas’ services related to the I-405 Improvement Project are 100% reimbursable per the terms of the Cooperative Agreement, which provided an initial amount of $975,700 in funding to the City; in addition,
Psomas Amendment No. 6 to CON 18-18
December 6, 2022
Amendment No. 3 to the Cooperative Agreement provided an additional $1,985,000 where after the approval of Amendment No. 6 for amount not to exceed $229,02, there will be a remaining balance of $3,356.97.
The basic outline of the scope of services is to serve as an extension/augmentation of City staff and assist the City, and in some cases take a lead role, with tasks related to the I-405 Improvement Project, including:
Overall project management including being the central clearinghouse for submittal reviews and processing
Attending meetings with and on behalf of the City
Conducting field reviews and construction observation o Traffic Management Plan (TMP), detours, and construction-related signal timing o All civil engineering and utility improvements
Design reviews for the following major areas:
o Civil design including roadway, drainage, grading, and utilities o Traffic including Traffic Management Plan (TMP), traffic signals, signing & striping, traffic control, detour plans, traffic detour, and construction-related signal timing plans, implementing and fine-tuning signal timing plans o Water Quality Management Plans (WQMPs)
o Landscape Elements
As Psomas’ scope of services is reviewed on an annual basis with amendments to the original contract, staff is now recommending that the City Council approve Amendment No. 6 to Contract 18-18 with Psomas for amount not to exceed $229,022 for continued project management, design review, and field observation of improvements related to the I-405 Improvement Project from January 2023 through December 2023. Should services be required beyond December 2023 due to delays of the I-405 construction project schedule, staff will work with OCTA staff to negotiate additional reimbursable funds as part of an amendment to the cooperative agreement between OCTA and the City of Fountain Valley.
The construction activities will continue through end of 2023. However, there is much progress.
Below is a summary of the progress.
The Phase 1 of Brookhurst Bridge is completed and was opened to traffic on midFebruary 2022. The Phase 2 of Brookhurst Bridge is under construction and will be completed by March 2023.
Ward Bridge is under construction with an anticipated opening to traffic by end of March 2023.
The Warner bridges are under construction and will be open to traffic by April 2023. Reservoir #1 site work is complete and waiting for irrigation and landscaping installation.
This work is coordinated with the construction of a digital billboard sign structure and the proposed SiFi hut.
All outstanding improvements ranging from sidewalks, ADA ramps, fire hydrants, water meters for irrigation, drainage improvements, traffic signals, widening of pavements,
Psomas Amendment No. 6 to CON 18-18
December 6, 2022
striping, and signing, and reconstruction of distress pavements will be worked on from January 2023 to the end of December 2023.
Additionally, the project started irrigation and landscaping improvements for the completed bridges.
New water lines are being relocated through the Ward and Warner Bridges and will need to be inspected by specialty inspectors certified in the welding of large scale steel municipal water lines.
This continued work will require the review of improvement plans and changes, traffic control plans, field modifications, coordination with OCTA and OC405 Partners, oversight inspection, and documentation control for all the improvement work within the City of Fountain Valley
Staff recommends that the City Council approve Amendment No. 6 to Contract 18-18 with Psomas for amount not to exceed $229,022 for continued project management, design review, and field observation services of improvements related to the I-405 Improvement Project.

This is the recommended alternative.
Alternative No. 2: Do not approve Amendment No. 6. This is not recommended as retention of the Psomas team is critical to the City in a couple of ways. One is that it allows the City to fulfill its responsibility to review and provide comments on all plans and other submittals related to the I-405 Improvement Project promptly as outlined in Cooperative Agreement No. C-5-3613 between the OCTA and the City for the I-405 Improvement Project. Another is that it ensures that the plans and ultimately the construction are being performed to City standards and that the City’s interests are best represented by providing this robust augmentation to support City staff.

AGA Traffic Signal Modifications Specifications
December 6, 2022
DISCUSSION:
At the request of the City, AGA Engineers Inc. (AGA) submitted a fee proposal for the preparation of specifications and Engineers estimates for the traffic signal modifications at the following two locations.
Euclid Street at Condor Avenue
Talbert Avenue at Bushard Street
The City operates and maintains fifty-five (55) traffic signal intersections. In addition, the City of Fountain Valley shares three intersections controlled by the City of Santa Ana. The scope of work includes the preparation of specifications and Engineer’s estimate of construction costs for Euclid Street at Condor Avenue and Talbert Avenue at Bushard Street traffic signal modifications. This work is an integral part of the City’s continuing effort to replace and upgrade traffic signals and equipment to improve traffic signal conditions. As part of these improvements, the City will be adding a crosswalk at the east side of Euclid Street to cross Condor Avenue.
On March 24, 2021, Staff solicited qualifications for As-Needed Engineering Services on the PlanetBids portal. On April 22, 2021, the City received proposals from thirty-eight (38) vendors for various services including traffic signal timing, maintenance, and repair. After careful consideration and evaluation of proposals, Staff selected ten (10) highest ranked consultants for the on-call list of qualified consultants for as-needed engineering services. This list also allows Staff to solicit competitive bids limited to those pre-qualified consultants.
AGA Engineers, Inc. is a highly qualified consulting firm and provides the City of Fountain Valley with excellent professional traffic signal and field assessment services. AGA has previously worked on various similar projects for the City of Fountain Valley including traffic signal modification design services and the Systemic Safety Analysis Report (SSARP). The SSARP was used to evaluate safety measures to address fatality and severe injury collisions Citywide.
Staff recommends that the City Council accept a fee proposal from AGA Engineers Inc. for $3,640 for the preparation of specifications for Euclid Street at Condor Avenue and Talbert Avenue at Bushard Street traffic signal modifications, and authorize staff to issue a Purchase Order to encumber the on-call contract. The proposed traffic signal modifications will be funded by Measure M funds.

Members of the City Council
SUBJECT: Frontier City-Wide Fiber Optic Installation
1. Approve a total project budget of $193,440 for Frontier’s City-wide Fiber Optic Installation Project.
2. Accept the remaining $112,840 of a $193,440 fee proposal from Annealta for Plan Checking, Construction Management and Inspection Services for Frontier’s City-wide Fiber Optic Installation Project.
3. Amend FY 2022/23 General Fund Budget in the amount of $73,215.
Three-Year Strategic Goals
☒ Enhance the culture and environment of “A Nice Place to Live” ☒ Attract and retain revenue producing businesses
☐ Achieve fiscal stability in accordance with the 20-Year Financial Plan ☐ Attract and retain quality staff
☐ Not applicable
EXECUTIVE SUMMARY:
Staff recommends that the City Council approve a total project budget of $193,440 for City’s services for review, permit issuance, and construction inspection of Frontier’s City-Wide Fiber Optic Installation Project, accept the remaining $112,840 of a $193,440 fee proposal from Annealta for plan checking, construction management, and inspection services for Frontier’s City-wide Fiber Optic Installation Project, and amend FY 2022/23 General Fund Budget in the amount of $73,215.
DISCUSSION:
Frontier reached out to the City of Fountain Valley and expressed interest in installing citywide fiber optics over two to three years. City Staff expressed their concerns to Frontier regarding “limited and inadequate staffing to process their request expeditiously at this time.” In
Annealta Group, Inc. – Project Management for Frontier
December 6, 2022
response, Frontier offered to fund staffing support services to process their request, starting with an initial deposit of $50,000.
To execute Frontier’s request to install a citywide fiber optics plan, staff solicited proposals for plan checking and construction inspection support services from the City’s approved on-call list of qualified consultants for As-Needed Construction Management and Inspection Services.
Annealta Group, Inc. (Annealta) ranked highest and best qualified based on their expertise in utility project management and utility plan checking services.
Annealta is a highly respected civil engineering and construction management firm with an excellent reputation for its work on similar projects throughout Southern California. Annealta has provided consulting services to Fountain Valley on past projects including providing inspection services on projects such as the City’s Rehabilitation and Resurfacing of Residential Roadways, Project GT229, and Rehabilitation of Warner Avenue from Brookhurst Street to Euclid Street, Project TI275.
On February 1, 2022, City Council approved a fee proposal from Annealta for $80,600, a prorated amount from the $193,440 proposal for plan checking, construction management and inspection services for Frontier’s City-Wide fiber optic installation plan. This is a completely 100% refundable program where Frontier has agreed through formal agreements to pay for these services by providing deposits in $50,000 increments or in other amounts as needed.
Frontier plans to provide high-speed fiber optic internet services to every home in Fountain Valley.
On November 16, 2021, the City Council approved an As-Needed On-Call Construction Management and Inspection Services contract CON 21-70 for Annealta for $400,000. On February 1, 2022, the City Council approved an amendment to the FY 2021/22 General Fund Budget, in the amount of $80,600, a pro-rated amount from the $193,440 Annealta proposal.
On April 17, 2022, a purchase order was created for $80,600 for use through the end of FY 2021/22 since the finance rules do not allow service contracts to carry over into the new fiscal year. On November 1, 2022, a FY2022/23 purchase order was created for $80,600 to match current year budgeted appropriations.
To date, Frontier has deposited $134,442.81 to fund the plan checking, construction management and inspection services and for city staff time; however, additional payments to Annealta cannot be processed until a new budget is established and approved by the City Council for the remainder of this fiscal year. Frontier continues to be committed to replenishing funds when needed in increments of $50,000 or other amounts as needed.
Staff recommends that the City Council approve a total project budget of $193,440 for Frontier’s City-wide Fiber Optic Installation Project, accept the remaining $112,840 of a $193,440 fee proposal from Annealta for plan checking, construction management and inspection services for Frontier’s City-wide Fiber Optic Installation Project, and amend FY 2022/23 General Fund Budget for $73,215.

ALTERNATIVES:
Alternative No. 1: Approve a total project budget of $193,440 for Frontier’s City-wide Fiber Optic Installation Project, accept the remaining $112,840 of a $193,440 fee proposal from Annealta for plan checking, construction management and inspection services for Frontier’s City-wide Fiber Optic Installation Project, and amend FY 2022/23 General Fund Budget for $73,215.
