SUBJECT: An Ordinance of the City Council of the City of Fountain Valley Increasing Council Member Compensation
Three-Year Strategic Goals

EXECUTIVE SUMMARY:
Enact an Ordinance increasing Council Member Compensation.
DISCUSSION:
A city council may enact an ordinance providing that each member of the city council shall receive a salary based on the population of the city. (Gov Code 36516(a)(1).) 1 In cities over 50,000 to 75,000 in population, compensation is up to and including five hundred dollars ($500) per month. (Gov Code 36516(a)(2)(C).)2
The salary of council members may be increased by ordinance. The amount of the increase may not exceed 5 percent for each calendar year from the operative date of the last adjustment of the salary. (Gov Code 36516(a)(4).) The 5-percent increase is not compounded; it is 5- percent times the number of years since the last adjustment. (89 Ops. Cal. Atty. Gen. 159 (2006).)
1 The rules are different for Charter Cities as Council compensation is considered a matter of local concern. (57 Ops. Cal. Atty. Gen. 11 (1974).)
2 Amounts paid by a city for retirement, health and welfare, and federal social security benefits are not included for purposes of determining salary, provided that the same benefits are available and paid by the city for its employees. (Gov Code 36516(d).) Nor are amounts paid by a city to reimburse a council member for actual and necessary expenses. (Gov Code 36516(e).)
Council Compensation
June 20, 2023
At some point before 1997, the City Council set its compensation at $500 per month. Using 1997 (when Title 2 was repealed and re-enacted) as the benchmark, at least 25 years have passed since the last adjustment, which allows an adjustment in compensation of up to 125- percent (5% x 25 years = 125%). This provides for a maximum compensation amount (excluding benefits, which the City of Fountain Valley does not provide notwithstanding the fact many cities do) of $1,125 per month.
A survey of Orange County cities revealed the following City Council compensation amounts:
ALISO VIEJO $ 520.00 2022 $2,242.58 $2,762.58

Council Compensation
June 20, 2023
The average monthly compensation, including benefits, is $1,453.86. Further, this amount is substantially lower than actual amounts paid because numerous cities responded that they provide benefits but did not identify the cost of the benefits. Those cities’ benefits are reflected as a $0 cost in the above analysis.
Further, Fountain Valley’s closest neighbors provide compensation, not including benefits, of the following amounts: Huntington Beach ($1,512), Garden Grove ($1,312.34), Santa Ana ($1,000), and Costa Mesa ($904.40). Garden Grove adopted its most recent Council Compensation ordinance in 2022.
According to the U.S. Bureau or Labor Statistics, $500 in April of 1997 has the same purchasing power that $946.83 has today.
Based on the allowable compensation of up to $1,125 per month, survey of other cities, and CPI, staff recommends that the City Council increase its compensation to the maximum amount of $1,125 per month. Fountain Valley provides no benefits to Council Members and, therefore, even at $1,125, Fountain Valley Council Member compensation will still be lower than the Orange County average. Per state law, any change to Council Member compensation does not take effect until after the next Council election. (Gov. Code 36516.5) FISCAL REVIEW:
The increase in council compensation, including employer paid taxes, would be an additional cost of $640 per council member per month or a total of $38,400 on an annual basis. These costs are not included in the adopted FY 2023-24 annual budget and would require a budget amendment. The Budget Amendment appropriates a total of $38,400 in increased expenditures from the General Fund unappropriated fund balance into the City Council salary and benefit expenditure accounts 100.10.10100.50000 and 100.10.10100.50400.

COUNCIL ACTION REQUEST

Members of the City Council
SUBJECT: Approve and Adopt a Resolution to Authorize and Approve Pooling of Self Insurance Through the Excess Workers Compensation Program of the California Joint Powers Insurance Authority
Three-Year Strategic Goals
☐ Enhance the culture and environment of “A Nice Place to Live” ☐ Achieve fiscal stability by evaluating processes, and attract and retain revenue producing businesses/opportunities
☐ Attract and retain quality staff through best practices and trends ☐ Maintain, build, and modernize infrastructure to support growth and future needs of the City

EXECUTIVE SUMMARY:
As a cost saving measure, the City recently switched its insurance pool from the PRISM program to CJPIA. This change over covered every policy that was previously covered by PRISM; however, the only remaining policy that was not covered by PRISM is the Workers Compensation Policy which had been covered through Brown and Brown Insurance. As a cost saving measure and for uniformity amongst all the insurance programs, City staff is requesting that the City Council approve the change from Brown and Brown Insurance to CJPIA for the Workers Compensation Policy.
DISCUSSION:
The City of Fountain Valley executed a Joint Powers Agreement to become a member of the California JPIA and was accepted back in April. At the time of acceptance, the City enrolled into all the insurance pool programs except for the Workers Compensation Program, as City staff was waiting to receive the 2023/24 renewal estimates from Brown and Brown Insurance, the City’s current Workers Compensation Coverage carrier.
The coverage provided by Brown and Brown Insurance is strictly the insurance coverage and does not include Third Party Administrative services to handle the claims. The City currently contracts with Adminsure as the Third Party Administrator for Workers Compensation Claims.
The CJPIA Workers Compensation Policy provides the same coverages as the Brown and Brown policy with one exception. Currently, the Self Insured Retention (SIR) with Brown and Brown is $750,000 per employee claim and $1 Million per Public Safety Employee Claim. The CJPIA program has allowed the City to keep the SIR consistent at $750,000 for both General Employees and Public Safety Employees. The Workers Compensation Program through CJPIA does require a 3-year commitment to the program. In addition to the lower SIR, the City would also gain a new Third Party Administrator that is used by CJPIA, Athens. Athens is a highly reputable Third Party Administrator and are well reviewed by those that use their services.
If the City decides to participate in the CJPIA Workers Compensation program then the City would also enter into an agreement with Athens as the City’s Third Party Administrator, which the costs are included in the premium presented by CJPIA.
Lastly, by selecting CJPIA as the City’s Workers Compensation Carrier, it will allow for all city insurance policies to be under one program.
FISCAL REVIEW:
Staff received the estimates from both Brown and Brown and CJPIA for Workers Compensation Coverage in Fiscal Year 2023 / 24. Here are the breakdowns in cost:
CJPIA Brown & Brown
23/24 Premium $460,205 $317,500
23/24 TPA Costs Included in $168,000 (Adminsure)
Premium
TOTAL: $460,025 $485,500
The costs for CJPIA workers compensation coverage has been included in the FY 2023-24 Adopted Budget.
PUBLIC NOTIFICATION:

ENVIRONMENTAL IMPACT REVIEW:

ATTORNEY REVIEW:
The Attorney(s) for the City have reviewed the attached Resolutions.
ALTERNATIVES:
Alternative 1. The City selects to use CJPIA as the provider for the Workers Compensation program for the next 3 years at a minimum, which includes TPA services provided by Athens.
Alternative 2. The City does not choose to use CJPIA as the Workers Compensation carrier and provides direction to staff to seek another carrier.
RECOMMENDATION:
Staff is requesting City Council approval of Alternative No. 1 to approve CJPIA as the provider for the Workers Compensation program for the next 3 years at a minimum which includes TPA services provided by Athens.

CITY COUNCIL
COUNCIL ACTION REQUEST
To: Honorable Mayor and Agenda Date: June 20, 2023
Members of the City Council
SUBJECT: Approval of the FY2023/24 Statement of Investment Policy Three-Year Strategic Goals
☐ Enhance the culture and environment of “A Nice Place to Live” ☐ Achieve fiscal stability by evaluating processes, and attract and retain revenue producing businesses/opportunities
☐ Attract and retain quality staff through best practices and trends ☐ Maintain, build, and modernize infrastructure to support growth and future needs of the City ☒ Not applicable
EXECUTIVE SUMMARY:
The Investment Policy provides the guidelines for prudent investment of the City’s idle or reserve cash and outlines the policies essential to ensuring the safety and financial strength of the City’s investment portfolio. Pursuant to its own terms, the City’s Investment Policy is reviewed on an annual basis for submission and approval by the City Council. Upon review by the City Treasurer and the City’s investment advisors, Chandler Asset Management, updates have been incorporated into the document.
Attached for your consideration is the investment policy for the fiscal year 2023/24.
DISCUSSION:
The City’s Investment Policy guides the investment of over $100 million in pooled cash and investments. The California Government Code sets specific rules for how public agencies can invest their idle cash and limits the types of investment vehicles public agencies can utilize. The City’s Investment Policy further limits investment choices to a smaller subset of what is allowed by the Government Code. The City’s overriding objectives of the investment program are to preserve principal, provide sufficient liquidity, and manage investment risks, while seeking a market-rate of return. Although the generation of revenues through interest earnings on investments is an appropriate City goal, the primary consideration in the investment of City funds is capital preservation in the overall portfolio. As such, the City’s yield objective is to achieve a reasonable rate of return on City investments rather than the maximum generation of income, which could expose the City to unacceptable levels of risk.
Approval of the FY 2023/24 Statement of Investment Policy June 20, 2023
On September 20, 2022, the City Council approved the FY2022/23 Statement of Investment Policy which follows best practices recommended by the California Debt and Investment Advisory Commission (CDIAC), California Municipal Treasurers Association (CMTA) and the Government Finance Officers Association (GFOA) with stated objectives of the policy as safety, liquidity and return. It also affirmed the market benchmark, the Intercontinental Exchange (ICE) Bank of America Merrill Lynch (BAML) 1-5 Year U.S. Treasury/ Agency Index which remains the same for FY2023/24.
Consistent with best practices, the Investment Policy (Attachment 1) is reviewed each year and presented to the City Council for adoption. After review, staff is recommending changes to the following sections:
I. Introduction
Staff added the four (4) primary goals of the Investment Policy to the Introduction section to provide a clear and concise overview of what the policy aims to achieve. Including the goals of the policy in the introduction section helps to provide an informative and focused overview of the policy, ensuring clarity, transparency, and accountability.
V. Delegation of Authority
Staff included delegation of authority in the event that the City Treasurer is unavailable to authorize transactions. The updated section delegates authorization of investment transactions to the Finance Manager, Deputy City Manager, or City Manager if the City Treasurer is unavailable. This action defines who may transact on the investment program and provides for a continuity of operations.
X. Prohibited Investment Vehicles and Practices
This section was updated to reflect provisions of SB 1489, which was signed by the Governor in September 2022. The bill amended Government Code Section 53601 and prohibits the purchase of a security with a forward settlement date exceeding 45 days from the time of investment.
XVIII. Reporting
Amended the Quarterly Reports section to reflect provisions of SB 1489. This bill also amended Government Code section 53646(b)(1) to increase the timeline that the treasurer has for presenting a quarterly report to legislative body of the local agency by 15 days, from 30- to 45 days following the end of the quarter.
Glossary of Investment Terms
SB 1489 also clarified and defined the maturity of a security. A public agency investment’s term or remaining maturity is to be measured from the settlement date to final maturity.
FISCAL REVIEW:
Consistent with State law, the City’s primary objective is to invest in a manner aimed to safeguard principal and maintain liquidity where the secondary objective is to achieve a market rate of return. Investment performance is evaluated by comparing the City’s pooled investment portfolio’s total rate of return to a market benchmark that closely resembles the City’s investment policy constraints in terms of duration, security types and credit quality. As
Approval of the FY 2023/24 Statement of Investment Policy June 20, 2023
reflected below, while the City’s “total rate of return” has been negative for the last two years as we navigate through a pandemic, it has performed better than the selected benchmark, Intercontinental Exchange (ICE) Bank of America Merrill Lynch (BAML) 1-5 Year U.S.
Treasury/ Agency Index.
