REPORT TO THE CITY COUNCIL
DATE: May 7, 2024
FROM: THOMAS W. GAFFERY IV, Assistant City Manager
SUBJECT: INTRODUCTION of Ordinance 2024-02 amending Sections 5-24.01, 5-24.02, and 5-24.03 of Chapter 24, of Title 5 of the Fowler Municipal Code regarding outdoor smoking and tobacco use.

EXECUTIVE SUMMARY
The City originally adopted Ordinance No. 2020-04 which added Chapter 24 to Title 5 of the Fowler Municipal Code creating a smoking prohibition at City facilities. This Ordinance Amendment provides clarity to the City’s smoking prohibition by expanding the definitions for the locations that the prohibition applies to, begins to implement General Plan policy and action items, and incorporates recommended public health best practices from the American Lung Association of California.

BACKGROUND
The proposed Ordinance expands the smoking prohibition from applying only to City facilities to a broader range of public places, including recreational areas, public event areas, outdoor dining areas, and others, whether publicly or privately owned. This Ordinance also provides more thorough definitions for “electronic smoking devices” and “enclosed areas”. Furthermore, it specifies that public sidewalks and roadways are not subject to the smoking prohibition, except those within 30 feet of an area subject to a smoking prohibition.

PUBLIC NOTICE
A Public Hearing Notice was published in The Fresno Business Journal on April 26, 2024, which is at least ten (10) days prior to the public hearing.

ENVIRONMENTAL REVIEW
This action does not constitute a “project” pursuant to the California Environmental Quality Act (CEQA). CEQA Guidelines section 15378 defines a “project” as an action which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. It is not reasonably foreseeable that this action would create either a direct or indirect physical change in the environment, and therefore environmental review under CEQA is not required.
34 Section 10, Item 10B.

Reduce exposure to secondhand smoke.

Action Item CH-8a
