CITY COUNCIL MEETING

REPORT TO THE CITY COUNCIL
DATE: February 3, 2025
FROM: THOMAS W. GAFFERY IV, Interim City Manager
SUBJECT: Actions pertaining to semi-truck parking:
i. ADOPT Ordinance No. 2025-01 amending sections 4-

4.203, 4-4.209, 4-4.210 and 4-4.212 of Chapter 4 of Title 4, and adding Article 7 to Chapter 4 of Title 4 of the
Fowler Municipal Code related to on-street parking of
semi-trucks within the City
ii. APPROVE Resolution No. 2767 adopting the Master Fee Schedule

EXECUTIVE SUMMARY
This proposed Ordinance simplifies existing language relative to semi-truck and commercial vehicle parking within the City. It also adds additional provisions relative to semi-truck parking, to allow for additional parking enforcement and the ability to tow semi-trucks parked areas posted with signs after forty-eight (48) hours.

BACKGROUND
This item was introduced at the January 21, 2025 City Council meeting and approved unanimously by the members present. Today’s action also includes adoption of parking citation fees associated with the proposed ordinance.

Both on-street and off-street parking of commercial vehicles and semi-trucks continues to be an ongoing nuisance in various areas throughout the City. Off-street semi-truck parking in unauthorized areas (such as residential side yards, residential driveways, and unimproved lots) is handled by the City’s code enforcement officers via the issuance of Administrative Citations. This proposed Ordinance removes redundant language, clarifies confusing language, and removes references to unnecessary maps and figures. Time limits related to parking were reconciled across the Ordinance for consistency.

This Ordinance brings an update to the City’s Master Fee Schedule to reflect additional penalties for improperly parked commercial vehicles and semi-trucks in accordance with the Ordinance.
49 Section 7, Item F.

At the January 7, 2025 public hearing, Council continued the introduction of the Ordinance to January 21, 2025. A pre-adoption summary was published in The Fresno Business Journal on January 24, 2025.

CITY COUNCIL MEETING

REPORT TO THE CITY COUNCIL
DATE: February 3, 2025
FROM: ERIC ROCHA, Public Works and Public Utilities Director SUBJECT: Actions pertaining to City of Fowler South Kings Groundwater Sustainability Agency (SKGSA) Projects:
i. FIND that approval of the contract to design and provide for construction management of the San Antonio Basin
Interconnect project is exempt from further
environmental review under CEQA pursuant to Public
Resources Code section 21080.21, and direct staff to file a Notice of Exemption if the contract is approved.
ii. APPROVE a contract with Provost & Pritchard
Consulting Group in an amount not to exceed $41,000
for the design and construction management of the San
Antonio Basin Interconnect project and authorize the
Interim City Manager to execute the agreement
iii. APPROVE a contract with Provost & Pritchard
Consulting Group in an amount not to exceed $60,000
for Marshall Estates II Recharge Pipeline Feasibility
Study and authorize the Interim City Manager to execute the agreement
iv. APPROVE Budget Resolution No. 2769 allocating
funding for the project

EXECUTIVE SUMMARY
Find that the San Antonio Basin Interconnect project is exempt from environmental review pursuant to Public Resources Code section 21080.21. Approve contracts with Provost & Pritchard Consulting Group (“P&P”) for the design of the San Antonio Strom Drain Basin Interconnect Pipeline and the Marshall Estates II Recharge Pipeline Feasibility Study and approve Resolution #2769 for a budget amendment to fund these projects which will be reimbursed by the SKGSA.

BACKGROUND
The City of Fowler is a member of the South Kings Groundwater Sustainability Agency (“SKGSA”). As a member agency, the City is coordinating and designing groundwater recharge facilities with Consolidated Irrigation District (“CID”) to replenish the groundwater aquifer. The various interconnection pipeline designs will allow the City and SKGSA to conduct 71 Section 9, Item 9B.
recharge activities to efficiently take on storm water or excess irrigation water when supplies are available.

The San Antonio Storm Drain Basin interconnect project has been identified as a viable project to leverage an existing storm drain basin immediately adjacent to a CID pipeline. This project is expected to add approximately sixty linear feet (“60 LF”) of gravity pipeline between the Iowa Ditch and the San Antonio Drive Storm Drain Basin. The proposed design contract will prepare the construction documents to advertise for construction bids and include construction administration and inspection services once the project is under construction.

The Marshall Estates II Recharge Pipeline Feasibility Study will allow the City to investigate the requirements and possible costs if a new pipeline and surface water connection are undertaken for the Tract 6381 - Marshall Estates II subdivision currently under construction.

This project will study the feasibility and cost of a pipeline alignment to connect from the Norris Ditch to the Storm Drain System newly constructed for the Marshall Estates II subdivision. If feasible and approved by CID, this project could allow the City and SKGSA to route water to the newly expanded storm drain basin within the Marshall Estate II subdivision for groundwater recharge.

Both of these projects were included in the SKGSA budget for FY 2024/2025 and once the project or feasibility study has been completed, the SKGSA will reimburse the City for the cost of these projects.

PUBLIC NOTICE
This item does not require a public hearing and was noticed as a part of the City Council Agenda.

ENVIRONMENTAL REVIEW
Action Item (ii):

The San Antonio Basin Interconnect Project would result in the construction of a new pipeline of approximately 60 LF in length. Pursuant to California Environmental Quality Act (“CEQA”) Guidelines Section 15282, and in accordance with Public Resource Code Section 21080.21, the construction of new pipelines under a mile in length are exempt from any further environmental analysis, so long as the action would not have the potential to have a significant impact on the environment. The proposed pipeline would be less than one mile in length and does not have the potential to have a significant impact on the environment. As a result, should Action Item (ii) be approved, the City would file a Notice of Exemption (“NOE”) with Fresno County, whereafter the NOE would also be published on the State Clearinghouse website.

Action Item (iii):

The Marshall Estates II Interconnect Feasibility Study Project does not qualify as “project” pursuant to CEQA Guidelines section 15378 because it would not have the potential to result in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The Project proposes to perform a study to determine the feasibility of constructing pipeline intertie improvements that would increase the recharge capabilities of the underlying aquifer in relation to the approved Marshall Estates II residential subdivision. The proposed study would not result in any activity that would either directly or 72 Section 9, Item 9B.
indirectly impact the environment, nor would it involve the issuance to a person of a lease, permit, license, certificate, or other entitlement for use by one or more public agencies.

GENERAL PLAN CONSISTENCY
Goal SAF-1
The community is resilient to the effects of a changing climate.

Goal SAF-3
Local watersheds, water bodies, and groundwater resources are responsibly managed.

Goal SAF-4
Minimize risk from hazardous materials, flooding, seismic, and fire hazards.

Policy SAF-13
Conserve and, where feasible, create or restore areas providing water quality benefits such as undeveloped open space areas, basins, and drainage canals.

Policy SAF-23
Work with the Consolidated Irrigation District (CID) and other responsible parties to ensure flood management facilities and structures (e.g., pump stations, canals) are properly maintained and/or improved.

Goal PF-1
Fowler provides reliable public facilities, utilities, and community services that meet the needs of the existing community and planned growth.

Goal PF-2
Fowler maintains and manages the orderly and efficient expansion of public facilities, utilities, and community services.

Policy PF-21
Protect groundwater resources within the planning area. This includes protecting the occurrence of groundwater recharge, as well as the quality and quantity of available groundwater resources.

Policy PF-22
Support local efforts to implement the Sustainable Groundwater Management Act (SGMA).

Coordinate with applicable Groundwater Sustainability Agencies (GSAs) to implement appropriate policies and programs identified in adopted Groundwater Sustainability Plans (GSPs).

Policy PF-24
Where feasible, require on-site systems that facilitate groundwater recharge and/or retention and reuse of water on-site.
73 Section 9, Item 9B.

FISCAL IMPACT
The City's Groundwater recharge impact fee fund will be used to fund the two basins.

However, once completed, the SKGSA will reimburse the City for the design and construction of these projects since the City has paid their proportionate share of the SKGSA fees to facilitate groundwater recharge projects. Lastly, a budget amendment resolution to capture this change in the City’s fiscal year 2024/25 budget is included.

PROCUREMENT PROCESS
P&P, the City’s on-call engineering consultant, was selected through a competitive bid process applicable to both City- and State-funded projects. P&P is uniquely qualified as the City’s oncall engineering consultant, and their prior experience with SKGSA projects. As P&P’s these two projects are over the Interim City Manager’s purchasing authority, they are being brought for City Council consideration.

CONFLICT OF INTEREST
Staff is not aware of any conflicts of interest.

Subject: Engineering and Land Surveying Services for San Antonio Basin Interconnect Pipeline, Fowler, California
Dear Thomas Gaffery:

Thank you for the opportunity to submit this proposal to provide engineering services for the San Antonio Pipeline project. This proposal discusses our understanding of the project, recommends a scope of services together with associated fees, deliverables and approximate schedules, sets forth our assumptions.

PROJECT UNDERSTANDING
We understand that the South Kings Groundwater Sustainability Agency (SKGSA) budget includes funding to design and construct of this project. The City of Fowler is part of the SKGSA and is in an agreement with Consolidated Irrigation District (CID) to fund groundwater recharge programs to help sustain the aquifer the City relies on. The City has interest in adding a new surface water connection to the existing San Antonio Basin. The new line is anticipated to be connected to CID’s water distribution system. The project is proposed to divert surplus water when CID has an extended water year or during flood releases after excessive rain events. Adding the new surface water connection will benefit the local groundwater system through recharge and will allow for better management of surplus supplies when available. Our proposed scope is aimed at assisting the City in completing the design and construction management of the project.

SCOPE OF SERVICES
Our proposed scope of work for this proposal is segregated into several phases, described below.

PHASE SUR: TOPOGRAPHIC AND BOUNDARY SURVEY
Work under this phase will include topographic and boundary survey of the existing basin and facilities adjacent to project property to develop a CAD drawing and surface model for the design. A boundary survey will be needed to identify the public and private boundaries in the vicinity of the proposed pipeline facility.

The topographic survey will include general topography, grade breaks, locating fence lines, power poles, structures, irrigation facilities, and other features pertinent to the design. The survey will be based on current NAVD88 elevations, with ties to control points located near the project location.

DELIVERABLES:
• Topographic and Boundary Survey information integrated into the design plans. a. CAD drawing and Surface model

Work under this phase will include preparing design plans, specifications, and an engineer’s opinion of probable construction costs (EOPCC) to add a new surface water connection for recharge to the existing San Antonio storm drain basin. The new surface water connection is assumed to tie into an existing standpipe where flow will be regulated by a butterfly valve and gravity fed into the basin. It is anticipated that a flow meter will be installed to measure flow into the basin. Design plans and specification documents will be prepared and provided for the City and CID review at the 50% and final design milestones. Once review comments are received, we will proceed with the design. Specific tasks for the new San Antonio facilities include:

1. Structural calculations for sizing and reinforcing the concrete turnout and inlet structure.

2. Hydraulic Calculations for sizing the proposed pipeline.

3. Development of design plans and corresponding specifications ready for construction.

4. Opinion of Probable Construction Costs as the design progresses to allow the City to budget for construction.

DELIVERABLES:
• Electronic copy of Design Plans and Specifications at the 50% and 100% milestone. • Opinion of Probable Construction Costs as the design advances (electronic copy).

PHASE CM: CONSTRUCTION MANAGEMENT
Work under this phase will include the following services anticipated with the construction of the new surface water connection. The services anticipated include construction contract administration assistance, construction observation, construction staking and record drawings. The following tasks are the current level of effort anticipated with the construction of the project.

TASK 1 – CONTRACT ADMINISTRATION
P&P will perform the following tasks and duties to assist the City of Fowler in administering the construction contract:
• Coordinate with the Contractor and City to process paperwork associated with the construction Contract Documents, including: Notice of Award, Contract, Indemnity Agreement, Bonds, Insurance, Notice to Proceed, Construction Schedule, Submittals, Contract Change Orders, Shop Drawings, Record Drawings, and Notice of Completion;
• Prepare for and attend pre-construction meeting with Contractor, sub-contractors and City staff.

Attend and participate in other construction related meetings with Contractor and City staff; • Prepare recommendations to City staff for monthly progress payments, and final payment; and • Record documents will be prepared after the completion of the Project’s construction. The record documents will be prepared based on Contractor record-keeping as required by the Contract documents and reviewed by P&P. The construction documents will be revised based on this information to reflect changes from the original plans. The record plans will be provided to the City and will be provided approximately two months after the receipt of the Contractor’s records and City’s records.

TASK 2 – CONSTRUCTION OBSERVATION
P&P will perform the following tasks and duties to observe the construction of the Project, subject to the Engineer’s Roles and Responsibilities during Construction stated below:

• Provide construction review for conformance to Contract Documents at a level determined by P&P to be appropriate for the construction, based on the level of activity, ability, and reliability of the construction staff, and need for review during specific activities. City staff shall regularly be consulted regarding the level of this effort;
• Construction materials and soils testing for verification purposes will be performed by an approved material testing facility. All costs for initial tests shall be at the expense of the Owner. The costs of any retests, including time for the Engineer, shall be at the expense of the contractor at no additional cost to the project. The material testing facility will provide technicians to observe earthwork activities, conduct compaction tests and record the results. Documentation of the testing results will be provided at the end of construction.
• Coordinate with the Contractor and City staff to deal with issues that may arise during construction; and
• Document construction review work by completing construction review reports, periodic progress reports for District staff, and taking digital photos of critical phases of the work.

In addition to the roles and responsibilities during construction set forth in the Consulting Agreement between City and P&P, P&P’s role and responsibilities during construction shall be in accordance with the following:
• P&P will make visits to the construction work site at intervals appropriate to the various stages of construction to determine whether the construction contractor is performing the construction work in accordance with the construction contract documents, and to observe as an experienced and qualified design professional the progress that has been made and the quality of the various aspects of contractor’s executed construction work. Based on information obtained during such visits and observations, P&P, for the benefit of City, will determine if the construction work is proceeding in accordance with the construction contract documents. P&P will generally not be required to make exhaustive or continuous inspections on the construction site to check the quality or quantity of the construction work. P&P’s efforts will be directed toward providing for the City, among other things, a greater degree of confidence that the completed construction work will conform generally to the construction contract documents. On the basis of such visits and observations, P&P will keep the City and CID informed of the progress of the construction work. P&P will inform City and CID, in writing, of any portion of the construction work that the P&P becomes aware of that may be defective, not in accordance with the construction contract documents, or will prejudice the integrity of the design concept of the completed Project as a functioning whole as indicated by the construction contract documents;
• P&P may authorize minor variations in the construction work from the requirements of the construction contract documents which do not involve an adjustment in the construction contract price or times and are compatible with the design concept of the completed Project as a functioning whole as indicated by the construction contract documents; • P&P may recommend the rejection of construction work, but the City alone will have the ultimate decision for rejection of construction work which P&P believes to be defective, or that P&P believes will not produce a completed Project that conforms to the construction contract documents or that will prejudice the integrity of the design concept of the completed Project as a functioning whole as indicated by the construction contract documents;
• P&P will not supervise, direct, control, or have authority over or be responsible for construction contractor’s means, methods, techniques, sequences, or procedures of construction, or the safety precautions and programs incident thereto, or for any failure of construction contractor to comply with laws and regulations applicable to the performance of the construction work. P&P will not be 83 Section 9, Item 9B.

PHASE FEAS: MARSHALL ESTATE PIPELINE FEASIBILITY STUDY
It is understood that the City and SKGSA are interested in conveying surface water to the Tract 6381 Marshall Estates II storm drain basin when surplus water is available. Work under this phase will include developing a preliminary level feasibility study and conceptual costs for developing a potential water delivery system to the Marshall Estates. The following tasks shown below are the deliverables anticipated to complete the phase.

TASK 1 – FIELD VISIT
To assist with preliminary evaluation, a site visit is proposed to document conditions, gather information, look for significant obstacles to overcome potential fatal flaws along potential pipeline routes. The primary focus will be along Armstrong Avenue and into the Marshall Estates property. Conceptual alignments will be considered prior to the field visit to focus the effort on the one-day visit.

TASK 2 – IDENTIFY PROJECT ALTERNATIVES AND CONCEPTUAL COSTS This task will evaluate potential pipeline routes for delivering surface water to the Marshall Estates property.

It is assumed that the potential pipeline will likely be along Armstrong Avenue. Up to two (2) conceptual alternatives will be evaluated for this feasibility study. Project Descriptions will be developed for these alternatives so that the preferred alternative description can support environmental and/or regulatory needs.

Preliminary opinions of construction costs will also be developed for the alternatives. As these will be preliminary concepts, the opinions of construction costs are anticipated to include 30% - 40% contingency to account for potential unknowns that would be further vetted through a full design process. Costs will be developed through a combination of the Consultant’s prior experience with similar irrigation facility work and available construction cost resources such as RS Means.

TASK 3 – FACILITY CAPACITY EVALUATION
This task will evaluate the pipeline hydraulics for the proposed alternatives. A Hydraulic Grade Line (HGL) will be developed to understand the sizing, capacity, and head pressure of the proposed pipeline alternatives.

The calculations will be done using spreadsheets.

TASK 4 – SUMMARIZE POSSIBLE WATER SUPPLY
The historical hydrology of the CID water supplies will be summarized, as it is the most likely potential project water supply source. A high-level analysis will be prepared evaluating the potential timing of available supplies in the future.

TASK 5 – UTILITY RESEARCH
This task will involve utility research to identify existing underground utilities along each alternative. This task will assist with determining the most feasible alignment option.

TASK 6 – PERMITTING / REGULATORY REQUIREMENTS
For each identified alternative, a description of the possible permitting and regulatory requirements will be prepared. This is anticipated to describe the environmental planning requirements associated with the California Environmental Quality Act (CEQA) and the Federal National Environmental Policy Act (NEPA).

Potential permitting requirements that may be necessary for approval prior to construction will also be described. Approximate timelines for each will be described. However, review and input by State and Federal agencies can widely vary based on alternative complexity and agency staff availability. 88 Section 9, Item 9B.

This task will prepare a conceptual plan set of the recommended pipeline alternative. The conceptual design drawings will convey the design intent and identify the major construction activities.

TASK 8 – PREPARE FEASIBILITY STUDY REPORT
The information obtained through the prior tasks will be summarized in a report. The report is expected to provide information on the following topics:
• Description of the project alternatives.
• Summary of facility capacity evaluation.
• Explanation of the source and reliability of the water supply. • Summary of the permitting required for each alternative. • Estimated cost for each project alternative.
• Engineers’ recommendation for project alternatives.

EXHIBIT B

INSURANCE REQUIREMENTS
Prior to commencement of the Services, Vendor shall take out and maintain at its own expense the insurance coverage required by this Exhibit C. Vendor shall cause any subcontractor with whom Vendor contracts for the performance of Services pursuant to this Agreement to take out and maintain equivalent insurance coverage. Said insurance shall be maintained at all times during Vendor’s performance of Services under this Agreement, and for any additional period specified herein. All insurance shall be placed with insurance companies that are licensed and admitted to conduct business in the State of California and are rated at a minimum with an "A:VII" by A.M. Best Company, unless otherwise acceptable to the City. a. Minimum Limits of Insurance. Vendor shall maintain the following types of insurance with limits no less than specified:
(i) General Liability Insurance (including operations, products and completed operations coverages) in an amount not less than $2,000,000 per occurrence for bodily injury, personal injury and property damage. If Commercial General Liability insurance or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to this project/location (ISO CG 25 03 or 25 04) or the general aggregate limit shall be twice the required occurrence limit. (ii) Worker's Compensation Insurance as required by the State of California. (iii) Automobile Liability Insurance in an amount not less than $1,000,000 per accident for bodily injury and property damage.
(iv) Umbrella or Excess Liability. In the event Vendor purchases an Umbrella or Excess insurance policy(ies) to meet the “Minimum Limits of Insurance,” this insurance policy(ies) shall “follow form” and afford no less coverage than the primary insurance policy(ies). In addition, such Umbrella or Excess insurance policy(ies) shall also apply on a primary and non-contributory basis for the benefit of the City, its officers, officials, employees, agents and volunteers.
(v) Professional Liability. Contractor shall maintain professional liability insurance that insures against professional errors and omissions that may be made in performing the Services to be rendered in connection with this Agreement, in the minimum amount of two million dollars ($2,000,000) per claim and in the aggregate. Any policy inception date, continuity date, or retroactive date must be before the effective date of this agreement, and Contractor agrees to maintain continuous coverage through a period no less than three years after completion of the services required by this agreement.

If Vendor maintains higher limits than the minimums shown above, the City shall be entitled to coverage at the higher limits maintained.
b. Other Insurance Provisions. The general liability policy is to contain, or be endorsed to contain, the following provisions:
(i) The City, its officers, officials, employees, agents, and volunteers are to be covered as insured's with respect to liability arising out of automobiles owned, leased, hired or borrowed by or on behalf of the Vendor; and with respect to liability arising out of work or operations performed by or on behalf of the Vendor including materials, parts or equipment furnished in connection with such work or operations. General liability coverage can be provided in the form of an endorsement to the Vendor’s insurance (at least as broad 92 Section 9, Item 9B.
021023tg 8
as ISO Form 20 10 11 85 or both CG 20 10, CG 20 26, CG 20 33 or CG 20 38; and CG 20 37 forms if later revisions used).
(ii) For any claims related to the Services performed pursuant to this Agreement, the Vendor’s insurance coverage shall be primary insurance as respects the City, its officers, officials, employees, agents, and volunteers. Any insurance or self-insurance maintained by the City, its officers, officials, employees, agents or volunteers shall be excess of the Vendor’s insurance and shall not contribute with it. (iii) Each insurance policy required by this section shall be endorsed to state that the City shall receive written notice at least thirty (30) days prior to the cancellation, non-renewal, or material modification of the coverages required herein.
(iv) Vendor grants to the City a waiver of any right to subrogation which any insurer of said Vendor may acquire against the City by virtue of the payment of any loss under such insurance. Vendor agrees to obtain any endorsement that may be necessary to affect this waiver of subrogation, but this provision applies regardless of whether or not the City has received a waiver of subrogation endorsement from the insurer. (v) Any deductibles or self-insured retentions must be declared to and approved by the City of Fowler Risk Services. The City may require the Vendor to purchase coverage with a lower deductible or retention or provide proof of ability to pay losses and related investigations, claim administration, and defense expenses within the retention.
c. Evidence of Coverage. Vendor shall deliver to City written evidence of the above insurance coverages, including the required endorsements prior to commencing Services under this Agreement; and the production of such written evidence shall be an express condition precedent, notwithstanding anything to the contrary in this Agreement, to Vendor’s right to be paid any compensation under this Agreement. City's failure, at any time, to object to Vendor’s failure to provide the specified insurance or written evidence thereof (either as to the type or amount of such insurance), shall not be deemed a waiver of City's right to insist upon such insurance later.
d. Maintenance of Insurance. If Vendor fails to furnish and maintain the insurance required by this section, City may (but is not required to) purchase such insurance on behalf of Vendor, and the Vendor shall pay the cost thereof to City upon demand, and City shall furnish Vendor with any information needed to obtain such insurance. Moreover, at its discretion, City may pay for such insurance with funds otherwise due Vendor under this Agreement.
e. Subcontractors. If the Vendor should subcontract all or any portion of the work to be performed in this Agreement, the Vendor shall cover the subcontractor, and/or require each subcontractor to adhere to all the requirements contained herein. Similarly, any cancellation, lapse, reduction or change of subcontractor’s insurance shall have the same impact as described above. f. Special Risks or Circumstances. The City reserves the right to modify these requirements, including limits, based on the nature of the risk, prior experience, insurer, coverage, or other special circumstances.
g. Indemnity and Defense. Except as otherwise expressly provided, the insurance requirements in this section shall not in any way limit, in either scope or amount, the indemnity and defense obligations separately owed by Vendor to City under this Agreement. 93 Section 9, Item 9B.

CITY COUNCIL MEETING

REPORT TO THE CITY COUNCIL
DATE: February 3, 2025
FROM: DAWN E. MARPLE, City Planner
SUBJECT: ADOPT Resolution No. 2770, approving Street Vacation No. 24- 33, summarily vacating previously relinquished abutters’ rights for APN 345-110-87, and determining the proposed vacation does not meet the definition of a “project” pursuant to CEQA guidelines Section 15378

EXECUTIVE SUMMARY
Street Vacation No. 24-33 proposes to summarily vacate previously-relinquished abutters’ rights for Assessor’s Parcel Number (APN) 345-110-87, located on the west side of South Golden State Boulevard right-of-way between East South Avenue and South Temperance Avenue. The Planning Commission found the request conforms with the City of Fowler 2040 General Plan at its January 9, 2025 special meeting.

BACKGROUND
South Golden State Boulevard was the original U.S. Route 99, until the completion of the current State Route 99 and Interstate 5 in the 1960s. Generally, properties abutting highways and freeways relinquish direct access to these roads for safety and to ensure free-flowing traffic.

Since the relocation of U.S. Route 99 away from Golden State Boulevard, these access restrictions are not as important.

The proposed abutters’ rights to be vacated is located on the west side of South Golden State Boulevard between East South Avenue and South Temperance Avenue. The property owner of APN 345-110-87 has requested that the City consider vacating this portion of the right-of-way in order to establish a driveway for direct access to Golden State Boulevard. The City has no need to limit access rights at this location to South Golden State Boulevard. The width of the proposed vacation is limited to the property’s frontage, approximately 50 feet.

The Streets and Highways Code provides that a local agency may summarily vacate an excess right-of-way of a street or highway not required for street or highway purposes. (Sts. & Hy. Code § 8334, subd. (a).) The subject right-of-way meets these conditions.

At the January 9, 2025 Planning Commission special meeting, and in accordance with Government Code Section 65402 subdivision (a), the Planning Commission made a finding that Street Vacation No. 24-33 conforms to the City of Fowler General Plan. 97 Section 9, Item 9C.

As discussed above, subsequent to a finding of General Plan conformity by the Planning Commission, the City Council must now take action on Street Vacation No. 24-33.

PUBLIC NOTICE
This item does not require a public hearing and was noticed as a part of the City Council Agenda.

ENVIRONMENTAL REVIEW
The City Council’s approval would not result in a direct physical change or reasonably foreseeable indirect physical change to the environment, nor is the Council issuing a lease, permit, license, certificate, or other entitlement for use or making a recommendation about any such issuance. Therefore, the Council’s determination does not fall within the definition of a “project” pursuant to CEQA Guidelines Section 15378 and no further environmental review is required.

GENERAL PLAN CONSISTENCY
The portion of South Golden State Boulevard right-of-way proposed for vacation of abutters’ rights is designated an Expressway as identified in the Mobility (Circulation) Element of the General Plan. The City does not have driveway spacing requirements for properties abutting expressways, and the California Highway Design Manual recommends limiting driveways wider than 30 feet on expressways. Accordingly, the right-of-way vacation will not impede the City’s ability to meet its general plan goals and policies. The Planning Commission determined that the vacation of right-of-way proposed under Street Vacation No. 24-33 conforms to, and is consistent with, the City of Fowler 2040 General Plan.

FISCAL IMPACT
City Council’s approval would have no fiscal impact.

PROCUREMENT PROCESS
No procurement is associated with this action.

CONFLICT OF INTEREST
Staff is not aware of any conflicts of interest.

RESOLUTION NO. 2770

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOWLER, APPROVING STREET VACATION NO. 24-33 AND THAT VACATION OF RIGHTOF-WAY PROPOSED UNDER STREET VACATION NO. 24-33 DOES NOT QUALIFY AS A “PROJECT” FOR PURPOSES OF ENVIRONMENTAL REVIEW UNDER CEQA.

WHEREAS, Streets and Highways Code Division 9, Part 3, Chapter 4 authorizes local agencies to summarily vacate a street or highway in different circumstances, each an independent basis to affect a summary vacation of a street or highway; and WHEREAS, the definition of a “street” and “highway” under the Streets and Highway Code includes relinquished abutters’ rights, easements, and rights-of-way; and WHEREAS, Streets and Highways Code section 8334, subdivision (a) provides that the legislative body of a local agency may summarily vacate an excess right-of-way of a street or highway not required for street or highway purposes; and WHEREAS, the owner of Assessor’s Parcel Number (APN) 345-110-87 has requested that the City vacate the relinquishment of abutters’ rights of APN 345-110-87 along its portion of the South Golden State Boulevard right-of way that it abuts as further detailed in Exhibit A and Exhibit B, attached hereto and incorporated by this reference herein and WHEREAS, the City of Fowler is the sole owner of the subject right-of-way and the subject right-of-way is an excess right-of-way of a street or highway not required for street or highway purposes; and
WHEREAS, the Fowler Planning Commission considered Street Vacation No. 24-33 at a special meeting on January 21, 2025 and found that the vacation would not conflict with any policy of the Circulation Element of the City’s General Plan; and WHEREAS, the Planning Commission forwarded their report and finding of conformity to the City Council for consideration of Street Vacation No. 24-33; and WHEREAS, the City of Fowler City Council considered Street Vacation No. 24-33 at a regularly scheduled meeting on February 3, 2025; and
WHEREAS, the City Council considered the California Environmental Quality Act (“CEQA”) analysis outlined in the staff report and elsewhere in the Administrative Record which determined that adoption of the proposed determination of the vacation’s conformance with the City’s General Plan does not meet the definition of a “project” for purposes of environmental review under CEQA Guidelines section 15378; and
WHEREAS, the City Council has had an opportunity to review and consider the entire administrative record relating to Street Vacation No. 24-33, which is on file with the City’s Planning Department, and reviewed and considered those portions of the administrative record determined to be necessary to make an informed decision, including, but not necessarily limited to, the staff report, the written materials submitted with the request, and the verbal and written 99 Section 9, Item 9C.
testimony and other evidence presented during the public hearing, which are incorporated herein by this reference (“Administrative Record”).

NOW THEREFORE, BASED UPON THE ENTIRE RECORD OF THE
PROCEEDINGS, THE CITY COUNCIL FINDS AND RESOLVES AS FOLLOWS:

1. Street Vacation No. 24-33 does not qualify as “project” under CEQA and is therefore exempt from further environmental review.

2. Approving Street Vacation No. 24-33 is in the best interest of the City.

3. Street Vacation No. 24-33 is approved.
