CITY COUNCIL MEETING
REPORT TO THE CITY COUNCIL
DATE: September 16, 2025
FROM: WYATT CZESHINSKI, Assistant City Planner
SUBJECT: ADOPT Ordinance No. 2025-06, which:
i. FINDS that Ordinance No. 2025-06 is exempt from
further environmental analysis pursuant to CEQA
Guidelines section 15061, subdivision (b)(3), and;
ii. APPROVES a text amendment amending the Fowler
Municipal Code to include regulations relating to
sidewalk vending within the City.
EXECUTIVE SUMMARY
The City of Fowler Municipal Code (“FMC”) does not currently contain specific regulations governing sidewalk vending operations within the City. Staff have drafted a text amendment to provide an individual chapter within the FMC regarding the regulation of sidewalk vendors within the City. Approval of the proposed text amendment to the FMC would add these regulations.
BACKGROUND
As stated above, the FMC currently does not regulate sidewalk vending operations within the City. State law allows local jurisdictions to regulate such operations based on time and place and health and safety standards. Staff have proposed Ordinance No. 2025-06 to approve a text amendment which provides standards for the operation of sidewalk vendors within the City limits. Under the proposed text amendment, any sidewalk vendor operating within the City would be required to first obtain and maintain an active business license with the City. The text amendment proposed under Ordinance No. 2025-06 establishes general standards that apply to all sidewalk vendors, as well as standards specific to sidewalk vendors who are stationary, roaming, and those vending within City parks (See Attachment 1). Any sidewalk vending operation must also meet the requirements of and hold any applicable permits issued by the Fresno County Department of Public Health. Based on State law, infractions of any set regulation may be enforced through administrative citations.
The City Council voted unanimously (5-0) to introduce and waive the first reading of Ordinance No. 2025-06 at its September 2, 2025, meeting. A second reading (which can also be waived) is required prior to adopting the ordinance. Ordinances take effect 30 days following adoption. 22 Section 7, Item 7C
At the September 2, 2025, City Council meeting and public hearing of Ordinance No. 2025-06, questions regarding how the proposed ordinance would affect non-profit organizations were raised in relation to the required business license and the requirements of the ordinance related to the intersection site triangle. FMC Section 3-1.201 states that the provisions of Chapter 1 of Title 3 of the FMC (Business Licenses) do not apply to non-profit organizations as described by California Business and Professions Code section 16000, subdivision (b). The non-profit must submit a verified statement to the City for the exemption to be recorded. A business license is then issued to the non-profit, however the fee for the license is waived.
Additionally, Ordinance No. 2025-06 is specifically tied to operations within the public right of way. Regardless if the person or organization is a non-profit, they will be subject to the intersection site triangle provisions when operating within the public right of way, as this regulation is provided to help maintain safety.
PUBLIC NOTICE
A Notice of Public Hearing was published in The Business Journal on August 22, 2025, which is at least ten (10) days prior to the public hearing where the item was introduced, on September 2, 2025.
ENVIRONMENTAL REVIEW
The first step in complying with the California Environmental Quality Act (“CEQA”) is to determine whether the activity in question constitutes a “project” as defined by CEQA (Pub.
Res. Code § 21000, et seq.; Cal. Code Regs. Tit. 14, § 15000, et seq. [“CEQA Guidelines”].) The text amendment proposed under Ordinance No. 2025-06 qualifies as a “project” under CEQA because it involves the amendment of the City’s Municipal Code, which is similar in nature to the “enactment and amendment of zoning ordinances,” as described in CEQA Guidelines section 15378, subdivision (a)(1).
The second step is to determine whether the Project is exempt from further environmental review by a statutory or categorical exemption. While the proposed text amendment meets the qualifications to be considered a “project” under CEQA, this amendment to the City’s Municipal Code would have no potential for causing a significant effect on the environment. In cases where it can be determined with certainty that a project will not cause a significant impact to the environment, such actions are exempt from further environmental analysis under CEQA Guidelines Section 15061, subdivision (b)(3), commonly referred to as the “Common Sense Exemption”. If the text amendment is approved, a Notice of Exemption for Ordinance No. 2025-06 will be filed with the County Clerk and the State Clearinghouse.
GENERAL PLAN CONSISTENCY
The proposed text amendment is consistent with the following General Plan goals and policies:
General Plan Policy CH-3
Consider pedestrian and bicyclist safety and comfort in the design and development of streets, parks, and public spaces.
General Plan Policy CH-11
Encourage farmers’ markets as a means of providing fresh fruit and vegetables to the community.
23 Section 7, Item 7C
General Plan Goal ED-1
Fowler maintains a supportive business climate that helps attract and retain new and existing businesses.
General Plan Policy ED-14
Facilitate the development of businesses that contribute to Fowler’s Economic Development Goals established through the General Plan or the Economic Development Strategy, which, along with the provision of affordable housing, creates a pleasing place to live and work.
FISCAL IMPACT
This text amendment would result in regulations that would regulate street vending within the City. Street vendors would be required to obtain and maintain a business license with the City in order to operate.
PROCUREMENT
This item is a staff sponsored text amendment which did not involve any procurement process.
CONFLICT OF INTEREST
Staff is not aware of any conflicts of interest.

EXECUTIVE SUMMARY
The Fowler Police Department desires to lease one 2025 Ford F-150 Responder and one 2025 Chevrolet Tahoe PPV pursuit-rated patrol vehicles equipped with police safety equipment and Fowler PD patrol decals to support operations in the Police Department for the City of Fowler. Staff has obtained a quote and is seeking approval for the lease contract.
BACKGROUND
Unified Fleet Services has submitted a vehicle lease-to-own proposal for one 2025 Ford F-150 Responder PPV (Police Pursuit Vehicle) and one Chevrolet Tahoe PPV for consideration.
These vehicles are California smog-certified and pursuit-rated, making them compliant with state regulations and fully equipped for emergency response operations. The proposed lease structure follows a five-year term with a $1.00 buyout at the end, allowing the agency to retain full ownership of the vehicle upon completion of the lease.
The financial details are as follows: The Ford F-150 Responder PPV is quoted at $16,205 annually, and a total of $81,026.00 after the five annual payments and $1.00 buyout. The Chevrolet Tahoe PPV is quoted at $17,520 annually, and a total of $87,601.00 after five annual payments and the $1.00 buyout. The total cost to the City will be $33,725 annually for both vehicles for five years. This proposal includes approximately $23,000 for vehicle upfitting for each vehicle, based on current estimates. Upfitting services may be sourced from either Dana Safety Supply or Cooks Communications, both located in Fresno, CA. While lease rates continue to fluctuate with the market, the current estimated rate for this quote is approximately
5.78%, based on leasing both vehicles simultaneously.

Sole Source Acquisition Request
Request
The Police Department is seeking to enter into a lease agreement with Unified Fleet Services to procure:
- One (1) 2025 Ford F-150 Responder PPV
o Pursuit rated
o California smog certified
- One (1) 2025 Chevrolet Tahoe PPV
The lease allows a five-year term with a $1.00 buyout per vehicle in the final year of the agreement, allowing the City to assume full ownership. The total cost of both vehicles over the term of the lease is $168,625, which includes $23,000 per vehicle upfitting. The estimated interest rate is approximately
5.78%, based on current market conditions.
Justification for the Sole Source:
Unified Fleet Services was the only vendor able to meet all the operational and compliance requirements including the following:
- No low-mileage restrictions
- Direct law enforcement leasing
- Pursuit-rated vehicle availability
- Integrated upfitting services
Other vendors, such as Bancorp Inc. and Enterprise Inc., were unable to provide solutions that met the department’s needs. Specifically, Bancorp imposed restrictive mileage limits, and Enterprise no longer offers exclusive law enforcement leasing arrangements.
Unified Fleet Services is new to the west coast market but recently completed a lease agreement with the Merced Police Department.
