CITY COUNCIL MEETING

REPORT TO THE CITY COUNCIL
DATE: May 5, 2026
FROM: MATT FLOOD, Community & Economic Development Director SUBJECT: Council discussion:
i. RECEIVE a review and update on the Disposition and
Development Agreement (DDA) with Bill Purewal for the
City-owned property on the east corner of 6th and
Tuolumne Streets.
ii. PROVIDE DIRECTION to staff on how to proceed with
the DDA for the property on 6th and Tuolumne.

EXECUTIVE SUMMARY
Staff is seeking direction from Council on how to proceed with the Disposition and Development Agreement (DDA) for the historic Fowler Christian Church located on the east corner of 6th and Tuolumne Streets.

BACKGROUND
In 2023, the City entered into a DDA with Bill Purewal for the conversion of the historic Fowler Christian Church into a mixed-use building. After some due diligence was performed on the part of Mr. Purewal, they requested to have modifications made, and a “revised and restated” DDA was entered into with them in 2024.

In 2025 when I was hired, I met with Mr. Purewal and his staff to obtain information on the status of the project. Mr. Purewal expressed that they felt the original concept was not financially feasible due to the advanced state of dilapidation the building had. They requested consideration of an alternate plan that would involve demolishing the entire structure and building a new one.

In November of 2025 City staff assessed the building and confirmed that the assertion made by Mr. Purewal was most likely founded, with any renovation that would maintain the building intact most likely turning out to be prohibitively expensive.

This recommendation was passed on to the City Manager and he directed staff to work with Mr. Purewal to see what a reworked DDA and plans would look like.

Since that time, staff has had meetings and phone discussions with Mr. Purewal and his staff, working on the details of such an agreement with the City Attorney’s input. 20 Section , Item B
Since so much time has passed and there continues to be a significant amount of interest on the project, staff determined it was best to bring this to Council to receive direction on how to proceed.

If Council wishes to pursue this project, Council can either direct staff to proceed negotiating with Mr. Purewal and bring the reworked DDA to a Council Meeting to be determined, or request that staff explore other options.

PUBLIC NOTICE
This item does not require a public hearing and was noticed as a part of the City Council Agenda.

ENVIRONMENTAL REVIEW
This action is exempt from CEQA due to being a simple discussion item in which staff received direction from Council in how to proceed. However, this is part of a larger item that is also exempt pursuant to CCR Section 15312 concerning Surplus Government Property sales in which the property does not hold significant value for environmental habitat, et al.

GENERAL PLAN CONSISTENCY
This project is consistent with assisting the achievement of many goals within the General Plan, including:

General Plan Goal ED-1
Promote economic development through preparation and implementation of an Economic Development Strategy.

General Plan Goal ED-2
Establish a process to work with landowners and business owners to encourage their participation in implementing the City’s economic development goals and policies.

General Plan Goal ED-4
Promote rehabilitation of commercial sites.

General Plan Goal ED-5
Discourage passive land uses, underutilization of land, and vacant structures on available commercial sites.

General Plan Goal ED-6
Encourage activities that attract participants to Fowler and promote economic development.

FISCAL IMPACT
Not applicable, since staff is requesting direction on how to proceed with a future Council item. 21 Section , Item B

PROCUREMENT PROCESS
No procurement is proposed at this time.

CONFLICT OF INTEREST
Staff is not aware of any conflicts of interest.

Attachments
None.

CITY COUNCIL MEETING

REPORT TO THE CITY COUNCIL
DATE: May 5, 2026
FROM: WYATT CZESHINSKI, Assistant City Planner
SUBJECT: CONSIDER the following:
i. The introduction and waiver of the first reading of
Ordinance No. 2026-04, prezoning Assessor’s Parcel
Number 345-100-05 to the R-1-6 zone district, with
an R-3 Implementing zone district designation,
prezoning the northern half of Assessor’s Parcel
Number 345-100-04 to the R-1-10 zone district, with
an R-1 implementing zone district, and prezoning the
southern half of Assessor’s Parcel Number 345-100-
04 to the R-1-7 zone district, with an R-2
implementing zone district;
ii. Resolution No. 2831, finding that Planning Project
No. 25-44 is consistent with the City’s General Plan
and General Plan Environmental Impact Report
pursuant to CEQA Guidelines Section 15183,
Approving Tentative Parcel Map No. 2025-45, and
Approving Vesting Tentative Subdivision Map No.
6537, as conditioned; and
iii. Initiating annexation of Assessor’s Parcel Numbers 345-100-05 and 345-100-04.

EXECUTIVE SUMMARY
Planning Project No. 25-44 consists of an application which includes a Tentative Parcel Map (“TPM”), a Vesting Tentative Subdivision Map (“VTSM”), a request to prezone approximately

76.11 acres of land, and a request to annex the prezoned land to the City of Fowler (“Project”).

VTSM No. 6537 proposes the subdivision of Assessor’s Parcel Number (“APN”) 345-100-05 (“Project site”), a parcel of approximately 38.35 acres, into 179 single family residential lots, park space, and a storm drainage basin, consistent with the development standards prescribed by the R-3 implementing zone district. Additionally, to create a logical annexation boundary, APN 345-100-04, a parcel of approximately 37.76 acres in size (“Annexation Parcel”), would be prezoned consistent with the City’s General Plan land use for the Annexation Parcel and would be annexed into the City along with the Project site. The Project is consistent with the goals and policies of the City’s General Plan. Staff recommend that the City Council introduce 23 Section , Item C
and waive the first reading of Ordinance No. 2026-04, adopt Resolution No. 2831, and initiate the annexation of APN 345-100-05 and 345-100-04.

BACKGROUND
Michael Chaney of 1021 Ventures LLC (“Applicant”), has proposed to subdivide an approximately 38.35-acre parcel into a single-family residential subdivision, comprising 179 lots, a 2.41-acre linear park space, and a 2-acre storm drainage basin. The subject property is located at the northwest corner of East Parlier Avenue and South Fowler Avenue (APN 345- 100-05), is designated as Medium Low Density Residential (“MLDR”) by the City’s General Plan, and is zoned AE-20 (Exclusive Agriculture) by the County of Fresno. As a part of the Project, the Project site would be annexed to the City of Fowler and prezoned R-1-6, with an implementing zone district of R-3, consistent with the Project site’s MLDR land use designation. The Project site contains an existing single-family residence, with accessory buildings, and has previously been used for agricultural production. Any existing structures would be removed as a part of the Project.

Additionally, as described above, the Project would prezone APN 345-100-04 R-1-10 (northern half) and R-1-7 (southern half), with an implementing zone district of R-1 and R-2, consistent with the underlying General Plan land use designation of Low Density Residential (“LDR”) (northern half) and MLDR (southern half), respectively. No development is proposed on this parcel at this time. The parcel has historically been used for agricultural production and currently contains row crops and a rural residential home with accessory structures.

In addition to the VTSM, prezone, and California Environmental Quality Act (“CEQA”) determination actions that the City Council will review, the Project also includes a request for approval of a TPM for the Project site, discussed further below. The designated approval authority for TPM’s is the Planning Commission, however Fowler Zoning Ordinance Section

9.30.080(C) states that “when a proposed project requires more than one (1) permit or approval with more than one (1) approving authority, all applications shall be processed concurrently and action shall be taken by each approving authority, with the option to elevate all discretionary actions to the highest approval authority”. Because the Project includes several proposals that require ultimate approval by the City Council, the Community & Economic Development Director has determined that it would be appropriate for the approval authority to be elevated to the City Council for the TPM as well. As a result, the Planning Commission is serving as a recommending body for each of the proposals of the Project, including the TPM.

The Planning Commission reviewed the Project at it’s March 5, 2026, meeting and voted to recommend that the City Council prezone the Project site and Annexation Parcel as described above, approve a TPM for the Project site, approve a VTSM for the Project site, and initiate annexation of the Project site and Annexation Parcel.

The Project was placed on the April 21, 2026, City Council agenda, but was continued to the May 5, 2026, City Council meeting at the request of the Applicant. 24 Section , Item C

ANALYSIS
General Plan Conformity
As discussed above, the Project site is designated MLDR by the City’s General Plan land use diagram. The Applicant has proposed the annexation of the site to the City of Fowler, requiring that the site be prezoned. The proposed prezoning designation is a mapping designation of R1-6, with an implementing zone district of R-3. According to Table 4-1 of the City of Fowler General Plan, the MLDR land use designation is consistent with the R-1-6 mapping zone district. At 4.67 dwelling units per acre, the proposed Project would also be developed within the density range required by the General Plan.

Public Infrastructure
The Project would have a singular point of access onto West Parlier Avenue, South Fowler Avenue, and the future development to the west of the Project site. Water and sewer infrastructure would be required to be extended along the Project’s South Fowler Avenue and West Parlier Avenue frontages, being reimbursed for any costs in excess of its contribution.

Additionally, approximately 77 feet of sewer main within West South Avenue would be required to be upsized between the manhole at the intersection of West South Avenue and South Fowler Avenue and the South Avenue lift station. This upsizing would be required to be completed by the developer, but would be completely reimbursed by the City using development impact fees that have been previously collected.

While the Selma Kingsburg Fowler County Sanitation District (SKF) Collection System Master Plan notes that a lift station is planned to serve the Project site, roughly located on its northeastern corner, SKF indicated in a meeting with the City and Applicant on January 30, 2026, that construction of a new lift station would not be required if the Applicant’s engineer demonstrates that the gravity flows from the site were adequate enough to meet SKF’s minimum grade requirements. The proposed sewer main within South Fowler Avenue must also meet the minimum clearance requirements to cross the Consolidated Irrigation District canal that runs west and east through South Fowler Avenue and the Project site without a need for a sewer lift station.

Additionally, the City will be upgrading the South Avenue Lift Station as a CIP project. Should the ultimate buildout of the upgraded lift station not be able to be funded completely by City funds, the remainder of the buildout of the lift station will be funded by developer fair share contributions. If when the Final Map for the Project is approved the upgraded lift station no longer has remaining capacity to serve the Project, then the Applicant shall be responsible for paying the Project’s fair share contribution of the remaining expansion of the lift station to its ultimate buildout.

The interior of the subdivision would provide outlots dedicated for open space and storm drainage purposes. Outlots created and developed for these purposes would be dedicated in fee to the City. Additional outlots are proposed on the exterior of the subdivision for landscaping purposes and would also be dedicated in fee to the City. In addition to constructing interior roads to the City’s current local street standard, the Project would be required to construct it’s West Parlier Avenue and South Fowler Avenue frontages to City standards for a major collector street and major arterial street, respectively.

Traffic Study
25 Section , Item C
The Project was required to prepare a Traffic Impact Analysis (“traffic study”) demonstrating the impact of the proposed development on roadways within the Project site’s vicinity. The traffic study included a recommendation that the Project pay its equitable fair share costs for future impacts to the intersections listed below:
 Merced Street and State Route 99 Northbound Ramps – 10.6%  Merced Street/Sumner Avenue and State Route 99 Southbound Off-Ramp – 15.6%  Fresno Street and Fowler Avenue – 29.1%
 Manning Avenue and State Route 99 Northbound Off-Ramp – 1.4% The City has coordinated with Caltrans on the future mitigation necessary to alleviate impacts to the two Merced Street/State Route 99 intersections listed above and have determined that the appropriate mitigation measure for these two intersections is the construction of a roundabout at both intersections.

Fowler Unified School District (“FUSD”)
Students residing at the Project site would attend Marshall Elementary (K-2), Fremont Elementary (3-5), Sutter Middle School (6-8), and Fowler High School (9-12). The student generation factor within Fowler Unified has ranged between 0.5 and 0.6 students per household, indicating that the proposed Project would generate approximately 89 to 107 students.

In accordance with State law, any new development is subject to school development fees as a condition of building permit issuance to offset potential impacts to schools. The 179 homes proposed throughout the development would be subject to school development fees on a persquare foot (“sqft”) basis. These funds, in combination with bond financing authorized by FUSD voters and State assistance, will provide facilities and reduce overcrowding in the longterm.

Tentative Parcel Map
The Project proposes a TPM that would subdivide the Project site into two resulting parcels of

21.62 (Parcel 1) and 16.73 (Parcel 2) acres, respectively. The parcel map would be required to be recorded subsequent to annexation, but prior to recordation of the Project’s Final Map, assuming the VTSM is approved by the City Council. Processing the TPM concurrently with the VTSM and Final Map, but recording prior to the Final Map, may be beneficial to the Applicant in relation to financing and the phased development of the VTSM.

Vesting Tentative Subdivision Map
The proposed VTSM includes 179 single family residential lots, ranging from 4,859 sqft to 10,283 sqft in size. Proposed lots have been reviewed for conformance with the City of Fowler Subdivision Ordinance and the development standards of the R-3 implementing zone district, as outlined in the Fowler Zoning Ordinance. The VTSM would be developed in phases.

Open Space
General Plan Policy OS-3 requires that single-family projects include 5% open space within the boundaries of the Project. Under the current proposal the Applicant would be required to develop approximately 1.92 acres of open space within proposed subdivision. The Project would include approximately 2.41 acres of parkland proposed along the northern and western boundaries of the Project site, meeting the minimum park space requirement. 26 Section , Item C
Fowler Municipal Code Design Standards
The Project is required and will be conditioned to comply with Section 9.120.060 (SingleFamily Residential Subdivision Design Standards) of the Fowler Zoning Ordinance. While the Applicant has not provided elevations for homes that would be constructed as a part of the Project, design would be required to meet City of Fowler’s Single-Family Residential Design Standards.

Kirby Canal
The Project site possesses a Consolidated Irrigation District surface canal that runs through the site in a curvilinear manner. The Project would result in the undergrounding of this existing canal and would relocate the canal to run below the proposed linear park located on the Project site’s northern and western boundary. Relocation of the canal would ensure that no structures are placed above the canal in the future as a result of the proposed VTSM.

Annexation
The Local Agency Formation Commission of Fresno County (LAFCo) requires that cities within Fresno County be developed with boundaries that occur in a logical manner which prevents the creation of jurisdictional islands. The Project site and Annexation Parcel are currently contiguous to the Fowler city limits to the west of the Project site.

Zoning Code/Map Amendment Findings (Fowler Zoning Ordinance Section 9.110.070) Prior to approving an application for the prezoning of a site, the Approval Authority shall make all of the following findings:

1. The Zoning Code or Zoning Map Amendment is consistent with the intent of the goals and policies of the General Plan.

The Project would result in a residential subdivision developed on a site that meets the density requirements of the MLDR land use designation, for which the site is designated by the City’s General Plan. Prezoning of the site to the R-1-6 mapping zone district/R-3 implementing zone district would be consistent with the site’s MLDR land use designation.

The Project would also result in the prezoning of the Annexation Parcel to the R-1-10 and R-1-7 zone district, with an implementing zone district of R-1 and R-2, respectively, consistent with the Annexation Parcel’s LDR and MLDR land use designation.

As a result, the Project is consistent with the City’s General Plan and its goals and policies.

2. The Zoning Code or Zoning Map Amendment prescribes reasonable controls and standards to ensure compatibility with other established uses.

The Project would result in the development of a single-family residential subdivision on land that is planned for such usage. Prezoning of the Project site and the Annexation Parcel consistent with the underlying land use designation would ensure that 27 Section , Item C
reasonable controls and standards are in place to ensure compatibility with other established uses, as is proposed by the Project.

3. The Zoning Code or Zoning Map Amendment provides reasonable property development rights while protecting environmentally sensitive land uses and species.

As proposed, the Project would be consistent with the City’s General Plan and General Plan Environmental Impact Report. Prezoning of the Project site and the Annexation Parcel consistent with the underlying General Plan designation, which the Project proposes, would ensure that reasonable property rights are preserved, while environmentally sensitive land uses and species are maintained at the same time. Any mitigations or policies aimed at reducing the impact of the buildout of the City’s General Plan would be applicable to the development of this Project.

4. The Zoning Code or Zoning Map Amendment ensures protection of the general health, safety, and welfare of the community.

The Project proposes to prezone the Project site and the Annexation Parcel consistent with the existing land use designation for the site, as prescribed by the City’s General Plan. Prezoning the site in this manner will ensure that development standards are required consistent with the type of development anticipated for the site. Requiring and enforcing these development standards will ensure protection of the general health, safety, and welfare of the community.

Grounds for Approval of a Tentative Parcel Map
The Subdivision Map Act (Gov. Code § 66474) requires cities make the following findings prior to approval of a tentative map:

1. The proposed map is consistent with applicable general and specific plans as specified in Section 65451.

The proposed TPM would result in the subdivision of the Project site into two resulting parcels that would meet the minimum requirements of the R-3 implementing zone district. The TPM would be consistent with the City’s General Plan and would not conflict with any specific plans.

2. The design or improvement of the proposed subdivision is consistent with applicable general and specific plans.

The proposed TPM is designed in a manner that is consistent with the City’s General Plan, the Fowler Zoning Ordinance, and the Fowler Subdivision Ordinance, and would not conflict with any specific plans.

3. The site is physically suitable for the type of development.

The TPM would split the Project site in order to aid the phased development of VTSM No. 6537. While no development is directly proposed by the TPM, the Project would 28 Section , Item C
make possible the development of the site into a single-family residential subdivision that is consistent with the site’s General Plan land use designation and the R-3 development standards for which the site would be prezoned as a part of the Project.

4. The site is physically suitable for the proposed density of development.

The TPM would split the Project site in order to aid the phased development of VTSM No. 6537. While no development is directly proposed by the TPM, the Project would make possible the development of the site into a single-family residential subdivision that is consistent with the site’s General Plan land use designation of MLDR. Meeting the density range prescribed by the General Plan ensures that the Project is developed at a suitable density.

5. The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure a fish or wildlife habitat.

The Project is consistent with the previously certified City of Fowler General Plan Environmental Impact Report (“EIR”). The EIR considered impacts to fish and wildlife resources within the City’s Planning Area. Buildout of the land uses analyzed under the General Plan EIR was found to not have a significant environmental effect on biological resources. As such, the proposed Project, which is being developed in accordance with the City’s General Plan, would not result in substantial environmental damage or substantially and avoidably injure a fish or wildlife habitat.

6. The design of the subdivision or type of improvements is not likely to cause serious public health problems.

There is no evidence in the record that the Project is likely to cause any serious public health problems. The Project is consistent with the City’s General Plan and would be developed consistent with the City’s development standards, as conditioned.

7. The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision.

The TPM would result in the creation of an access and utility easement connecting Parcel 2 to South Fowler Avenue. The TPM would not conflict with any other easement acquired by the public at large.

Grounds for Approval of a Tentative Subdivision Map
The Subdivision Map Act (Gov. Code § 66474) requires cities make the following findings prior to approval of a tentative map:
29 Section , Item C

1. The proposed map is consistent with applicable general and specific plans as specified in Section 65451.

As discussed above, the Project site has a MLDR land use designation. According to Table 4-1 of the Fowler General Plan, the MLDR land use designation is consistent with the R-1-6 mapping zone district, which the Applicant has applied for the prezoning of the property as, subsequent to annexation by the City. This prezoning would make the site’s General Plan and zoning designation consistent with one another. As proposed, the VTSM meets the density requirements of the MLDR land use designation and conforms with the R3 implementing zone district standards, making the Project consistent with both the applicable General Plan and zoning requirements.

2. The design or improvement of the proposed subdivision is consistent with applicable general and specific plans.

The proposed VTSM has been reviewed for compliance with the City’s General Plan, the Fowler Subdivision Ordinance, and the Fowler Zoning Ordinance. As conditioned, the Project meets all applicable design and improvement requirements.

3. The site is physically suitable for the type of development.

The Project site is designated as MLDR by the City’s General Plan and is thus anticipated for single-family residential development. After reviewing the VTSM, it has been determined that the Project site is suitable for the type of development being proposed.

4. The site is physically suitable for the proposed density of development.

The Project site is designated as MLDR by the City’s General Plan and is thus anticipated for single-family residential development. The proposed VTSM would result in a dwelling unit per acre ratio of 4.67, which is within the density range prescribed by the General Plan for the MLDR land use designation. The Project site has been determined to be adequate for the type of density proposed within the development.

5. The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure a fish or wildlife habitat.

The Project is consistent with the previously certified City of Fowler General Plan EIR.

30 Section , Item C

The Project would not conflict with any existing easements acquired by the public at large. An easement would be created by the Project’s TPM for Parcel 2 to have access and utility connection to South Fowler Avenue. Additionally, the Kirby Canal would be relocated along the Project site’s northern and western boundary. A new easement of 30 feet in width would be dedicated to Consolidated Irrigation District as a result of the relocation. The existing canal easement would be abandoned.

PUBLIC NOTICE
A Notice of Public Hearing was published in The Business Journal on April 10, 2026, which is at least twenty (10) days prior to the public hearing. It was also sent via US Mail to property owners within 300 feet of the proposed Project.

ENVIRONMENTAL REVIEW
The first step in complying with CEQA is to determine whether the activity in question constitutes a “project” as defined by CEQA (Pub. Res. Code § 21000, et seq.; Cal. Code Regs.

Tit. 14, § 15000, et seq. [“CEQA Guidelines”].) The second step is to determine whether the project is subject to or exempt from CEQA. This Project qualifies as a project under CEQA because it involves the issuance of a “lease, permit, license, certificate, or other entitlement for use” as described in CEQA Guidelines section 15378, subdivision (a)(3). Development of the Project site into a residential subdivision qualifies as a “project” under CEQA.

The Project would result in the construction of a new residential subdivision on land that is planned for such usage. The Project aligns with the site’s MLDR General Plan land use designation, will prezone the Project site and the Annexation Parcel consistent with the General Plan land use designations for each, and would qualify to be found consistent with the City’s General Plan EIR under CEQA Guidelines Section 15183.

Accordingly, staff recommend that the City Council find that the Project is absolved from further environmental analysis, pursuant to CEQA Guidelines Section 15183. If the Project is approved, a Notice of Exemption for the Project will be filed with the County Clerk and the State Clearinghouse.

Transportation Impact Study

1.0 Introduction

1.1 Description of the Region/Project
This Transportation Impact Study (TIS) has been prepared for the purpose of analyzing traffic conditions related to the proposed TTM 6537 Residential Development project (the Project) located within greater Fresno County and the City of Fowler’s Sphere of Influence. The TIS is intended to identify the extent to which the Project would affect traffic operations that may indicate a need for improvements within the study area and/or other measures to address traffic operations.

The project calls for the development of 199 single-family residential units, and the proposed subdivision will be located on the northwest corner of Fowler Avenue and Parlier Avenue approximately 0.8 miles south of the State Route (SR) 99 and Merced Street interchange within the City of Fowler. Figure 1-1 shows the regional context of the Project site while Figure 1-2 shows the Project location. Figure 1-3 shows the site plan of the proposed Project.

1.1.1 Project Access
The Project has two primary access points, one located along the west side of Fowler Avenue and the other located along the north side of Parlier Avenue.

1.1.2 Study Area
The study intersections included in this TIS are listed below and shown in Figure 1-2. The study intersections were developed in consultation with the City of Fowler, Fresno County, and Caltrans staff.

1.1.3 Study Scenarios
This TIS includes level of service (LOS) analysis for the following traffic scenarios (Study Scenarios):
 Existing (2025) Conditions
 Existing (2025) Conditions With Project
 Existing (2025) Conditions With Project Plus Approved/Pending Projects  Opening Year 2026 With Project Plus Approved/Pending Projects  Horizon (Future) Year 2046 Without Project
 Horizon (Future) Year 2046 With Project

1.2 Methodology
This TIS was prepared using general principles outlined in the City of Fowler’s Traffic Impact Analysis Guidelines (dated January 2025) modified as described in the Traffic Impact Study Scoping Document to be consistent with current conditions. In analyzing street and intersection capacities, the Level of Service (LOS) methodologies are applied. LOS standards are applied by transportation agencies to quantitatively assess a street and highway system’s performance. In addition, safety concerns are analyzed to determine the need for appropriate mitigation resulting from increased traffic near sensitive uses and other evaluations such as the need for signalized intersections or other improvements. Guidelines incorporated in the Highway Capacity Manual (HCM), 7th Edition, were also used in the development of this TIS.

1.2.1 Intersection Analysis
Intersection LOS analysis was conducted using the Synchro software program. Synchro supports HCM methodologies and is deemed an acceptable program by City of Fowler, County of Fresno, and Caltrans staff for assessment of traffic impacts. LOS can be determined for both signalized and unsignalized intersections.

Tables 1-1 and 1-2 define LOS “A” to “F” by indicating the ranges in the amounts of average delay for a vehicle at signalized and unsignalized intersections for each level of service ranging from LOS “A” to “F”.

When an intersection does not meet target LOS standards (LOS A, B, C, or D), analysis is conducted to determine whether improvements are needed.

In addition, for unsignalized intersections that do not meet acceptable LOS standards, an evaluation would be conducted to determine whether signal warrants would indicate the need for a traffic signal. Signal warrants are numerical thresholds used by traffic engineers to determine whether a traffic signal is needed. If signal warrants are not met, the typical conclusion 46 Section , Item C
3 TTM 6537 Residential Development
Transportation Impact Study
is that the intersection is operating at an acceptable LOS. The California Manual on Uniform Traffic Control Devices (California MUTCD) introduces standards for determining the need for traffic signals. The California MUTCD indicates that the satisfaction of one or more traffic signal warrants does not in itself require the installation of a traffic signal. In addition to the warrant analysis, an engineering study of the current or expected traffic conditions should be conducted to determine whether the installation of a traffic signal is justified.

1.3 Policies to Maintain Level of Service
In accordance with standard TIS practice, the goal of the project is to achieve a target LOS D or better for street segments and intersections.

1.4 VMT Analysis
A vehicle miles traveled (VMT) analysis will not be needed since the project is consistent with the City of Fowler’s General Plan.

1.5 Traffic Safety Analysis
A traffic safety analysis was conducted to determine whether there are any safety concerns on the State highway system that would be increased by the addition of project traffic. The analysis is included in Appendix F.

2.0 Project Traffic

2.1 Trip Generation
To assess the impact that the Project may have on the surrounding roadway network, the first step is to determine Project trip generation. Project trip generation was determined using trip generation rates from the Institute of Transportation Engineers (ITE) Trip Generation Manual (11th Edition). The considerations described above led to the recommended trip generation for weekday AM (7:00-9:00am) and PM (4:00-6:00pm) peak hours shown in Table 2-1.

2.2 Trip Distribution
Project trip distribution percentages are shown in Figure 2-1. These percentages are based upon knowledge of the study area, engineering judgement, prevailing traffic patterns in the study area, major routes, population centers, and other existing development.

2.3 Project Traffic
Project traffic as shown in Table 2-1 was distributed to the roadway system using the trip distribution percentages shown in Figure 2-1. A graphical representation of the resulting AM and PM peak hour Project trips is shown in Figures 2-2, and 2-3.

3.0 Traffic Impacts

3.1 Existing Traffic and Level of Service (LOS)
Existing AM and PM peak hour turning movements were collected by National Data & Surveying Services (NDS) on Wednesday September 10, 2025, at the following project study intersections:
 1 - W. Merced St/SR 99 NB Ramps
 2 - Sumner Ave/W. Merced St/SR 99 SB Off-Ramp/Fowler Ave  3 - Fowler Ave/W. Fresno St
 4 - Fowler Ave/SR 99 SB On-Ramp
 5 - Fowler Ave/South Ave
 6 - Fowler Avenue/Parlier Avenue
 7 - Fowler Avenue/Manning Avenue
 8 - Manning Avenue/SR 99 SB Ramps
 9 - Manning Avenue/SR 99 NB On-Ramp (Left from EB Manning to NB On-Ramp)  10 - Manning Avenue/SR 99 NB Off-Ramp
Existing AM and PM peak hour turning movements were collected by VRPA at the intersection of E. Parlier Avenue and S. Clovis Avenue on Thursday, October 2, 2025. Existing traffic at this intersection was collected by VRPA at the request of the County of Fresno following their review of the scoping document.

All intersection turning movement counts were conducted for the peak hour periods of 7:00-9:00 AM and 4:00-6:00 PM. Existing roadway lane geometry is shown in Figure 3-1. Existing traffic is shown in Figures 3-2 and 3-3. Traffic count data worksheets are provided in Appendix B.

Project traffic, as calculated in Chapter 2, was added to Existing traffic to determine Existing (2025) With Project traffic as shown in Figures 3-4, and 3-5. Note that the intersection of E. Parlier Avenue and Clovis Avenue was not studied as part of this TIS however per the County of Fresno’s request, VRPA performed a count of this intersection and when comparing the total intersection traffic for Existing Vs. Existing With Project Traffic, there is a difference of 5 trips (171 total trips for Existing AM Without Project Traffic and 176 total trips for Existing AM With Project Traffic) which is the equivalent of a 2.92% increase in traffic at this intersection as a result of the Project.

Project traffic, as calculated in Chapter 2, was added to Existing traffic plus Approved/Pending Projects to determine Existing (2025) With Project Plus Approved/Pending Projects traffic as shown in Figures 3-6, and 3-7. Note that VRPA met with City staff to discuss all applicable Approved/Pending projects which included the following:
 Clayton and Golden State Blvd. Property Prezone:
57 Section , Item C
14 TTM 6537 Residential Development

o Located at the southeast corner of Clayton Avenue and Golden State Blvd. and consisting of a proposed 44-lot industrial subdivision – project traffic prepared by VRPA as part of a previous TIS project.
 City of Fowler - Blossom Pointe Apartments:
o Located at the northeast quadrant of the Mariposa Street and 10th Street intersection and consisting of a 116 multi-family dwelling unit development – project traffic prepared by VRPA as part of a previous TIS project.  City of Fowler Buford Oil Company Travel Center:
o Located at the northeast corner of Manning Avenue and SR 99 and consisting of a proposed Travel Stop including tire shop, restaurant(s), and hotel – project traffic prepared by Peters Engineering Group as part of a previous TIS project.  City of Fowler – Tract 6501:
o Located at the northwest corner of the intersection of E. South Avenue and Sunnyside Avenue and consisting of a proposed 103 lot subdivision – see Appendix D for AM/PM Peak Hour Trip Generation.

Intersection operations for all Existing Traffic conditions (Existing, Existing Plus Project and Existing Plus Project with Cumulative Developments), are shown in Table 3-1.

Except for the intersections at 2 - Sumner Ave/W. Merced St/SR 99 SB Off-Ramp/Fowler Ave, and 10 - Manning Avenue/SR99 NB Off-Ramp, all study area intersections for all Existing Traffic conditions (Existing, Existing Plus Project and Existing Plus Project with Cumulative Developments) operate at level of service D or better. At the intersection of 2 - Sumner Ave/W.

Merced St/SR 99 SB Off-Ramp/Fowler Ave, and 10 - Manning Avenue/SR99 NB Off-Ramp, although the Existing Plus Project with Cumulative Developments traffic exceeds LOS D, these intersections do not meet peak hour signal warrants (California MUTCD Peak Hour Warrant – Warrant 3) because the minor approaches do not carry enough traffic to justify signalization (see Appendix D for Signal Warrant Worksheet).

3.2 Opening Year Traffic Conditions

Traffic conditions with the Project for the assumed opening year of 2026 were estimated by applying a growth rate of 2% per year to the existing traffic volumes. Project traffic, as calculated in Chapter 2, was added to Opening Year (2026) traffic plus Approved/Pending Projects to determine Opening Year (2026) With Project Plus Approved/Pending Projects traffic as shown in Figures 3-8, and 3-9.

Intersection operations for Opening Year conditions With Project Plus Approved/Pending Projects are shown in Table 3-1. Except for the intersections at 2 - Sumner Ave/W. Merced St/SR 99 SB Off-Ramp/Fowler Ave, and 10 - Manning Avenue/SR99 NB Off-Ramp, all study area 58 Section , Item C

intersections for these conditions operate at level of service D or better. At the intersection of 2 - Sumner Ave/W. Merced St/SR 99 SB Off-Ramp/Fowler Ave, and 10 - Manning Avenue/SR99 NB Off-Ramp, although the Opening Year conditions With Project Plus Approved/Pending Projects traffic exceeds LOS D, these intersections do not meet peak hour signal warrants (California MUTCD Peak Hour Warrant – Warrant 3) because the minor approaches do not carry enough traffic to justify signalization (see Appendix D for Signal Warrant Worksheet).

3.3 Horizon (Future) Year Traffic Conditions

Horizon Year traffic conditions with and without the Project in the Year 2046 (20 years from Opening Year conditions) were estimated by taking the larger of the traffic volumes from the following conditions:
 Applying a growth rate of 2% per year to the existing traffic volumes  2046 Fresno COG Regional Model with segment growth factors (taken by comparing the regional model future daily traffic to the existing average daily traffic) When comparing the traffic generated from these varying conditions, it was determined that traffic generated from applying a 2% growth rate per year to existing traffic volumes controlled.

The Horizon Year Lane Geometry is shown in Figure 3-10. The resulting traffic for the Horizon Year Without Project scenario is shown in Figures 3-11 and 3-12.

Project traffic, as calculated in Chapter 2, was added to Horizon Year traffic to determine Horizon Year With Project traffic as shown in Figures 3-13 and 3-14.

Intersection operations for Horizon Year conditions With and Without Project traffic are shown in Table 3-2.

For Horizon Year conditions, the intersections at 1 – Sumner Ave/W. Merced St/SR 99 NB Ramp, 2 - Sumner Ave/W. Merced St/SR 99 SB Off-Ramp/Fowler Ave, and 9 - Manning Avenue/SR99 NB Off-Ramp, all study area intersections for all Existing Traffic conditions (Existing, Existing Plus Project and Existing Plus Project with Cumulative Developments) operate at level of service D or better. At the intersection of 3 – Fowler Ave/W. Fresno St, although traffic exceeds LOS D, these intersections do not meet peak hour signal warrants (California MUTCD Peak Hour Warrant – Warrant 3) because the minor approaches do not carry enough traffic to justify signalization (see Appendix D for Signal Warrant Worksheet).

3.4 Queuing Analysis
Table 3-3 provides a queue length summary for left and right turn lanes at the study intersections for all scenarios. Queuing analysis was performed at study intersections utilizing the Synchro software program. Synchro provides the 95th percentile queue for signalized intersections and shows the length of the queue in feet. Queue length for stop-controlled intersections was calculated by multiplying the Synchro output vehicle for each intersection leg by 25-feet to determine the total queue length.

Queueing is noted as a concern at the Merced Street/Fowler Avenue/Sumner Avenue/SR 99 Southbound Off Ramp intersection as queue for the left turn from westbound Merced Street to southbound Fowler Avenue is expected to exceed the available storage length for the following scenarios:
 Existing Plus Approved Projects Plus Project (PM peak hour only)  Opening Year Plus Project (PM peak hour only)
 Horizon Year (2046) Without Project (AM and PM peak hours)  Horizon Year (2046) Plus Project (AM and PM peak hours) 76 Section , Item C

4.0 Mitigation

4.1 Roadway Improvements
As discussed in Section 3.0 (Traffic Impacts), roadway improvements may be desirable to support the development of the Project, as well as to accommodate traffic increases related to overall growth in the study area. The Project site, currently outside of the City of Fowler limits but within the City of Fowler’s sphere of influence, proposes the development of 199 single-family residential units.

Considering the criteria provided in Section 1.3 (Policies To Maintain Level of Service) and the results presented in Section 3.0, the following improvements may be implemented to alleviate roadway deficiencies identified in this Transportation Impact Study.

INTERSECTIONS
 1 – W. Merced St/SR 99 NB Ramps
Recommended improvements to achieve acceptable levels of service:
 Existing Plus Approved Projects Plus Project, Opening Year Plus Project, Horizon Year Without Project, and Horizon Year Plus Project Conditions Alternative 1
o Install a traffic signal when warranted
o Widen the westbound approach to the intersection to include a through lane and a right turn lane (adding one right turn lane)
Alternative 2
o Install a roundabout
 2 – Sumner Ave/W. Merced St/SR 99 SB Off-Ramp/Fowler Ave Recommended improvements to achieve acceptable levels of service:
 Existing Plus Approved Projects Plus Project, Opening Year Plus Project, Horizon Year Without Project, and Horizon Year Plus Project Conditions Alternative 1
o Install a traffic signal when warranted
o Widen the northbound approach to the intersection to include a left turn lane and a right turn lane with right-turn overlap phasing (adding one right turn lane with rightturn overlap phasing) 78 Section , Item C
36 TTM 6537 Residential Development
Transportation Impact Study
Alternative 2
o Install a roundabout
 3 – Fowler Avenue and W. Fresno Street
Install a traffic signal when warranted.

The intersection is forecasted to operate at unacceptable levels of service under the Horizon Year scenarios. However, this intersection does not meet the peak hour traffic signal warrant because the minor approach does not carry enough traffic to justify signalization. It should be noted that installation of a traffic signal would alleviate level of service deficiencies at the intersection.
 10 – Manning Avenue and SR99 NB Off-Ramp
Recommended improvements to achieve acceptable levels of service:
 Existing Plus Approved Projects Plus Project, Opening Year Plus Project, Horizon Year Without Project, and Horizon Year Plus Project Conditions o Install a traffic signal when warranted
The level of service resulting from the potential improvements identified above is shown in Table 4-1 with queuing analysis presented in Table 4-2. Figure 4-1 shows the recommended improvements at the respective intersections considering the Horizon Year Plus Project scenario.

In the case of the W. Merced St/SR 99 NB Ramps and Sumner Ave/W. Merced St/SR 99 SB OffRamp/Fowler Ave intersections, only the traffic signal alternatives identified above have been analyzed. The City of Fowler and Caltrans have conducted separate analyses and are actively pursuing the installation of roundabouts at these intersections.

In addition to the information provided above, it is noted that Table 4-2 indicates that queuing concerns would be expected at the W. Merced St/SR 99 NB Ramps and the Sumner Ave/W.

Merced St/SR 99 SB Off-Ramp/Fowler Ave two study area intersections with the recommended improvements. Queuing exceeding the expected storage lengths would be expected in various scenarios for the Merced Street/SR 99 interchange area for the following movements:
 Eastbound Merced Street to Northbound SR 99
 Westbound Merced Street to Northbound SR 99
 Westbound Merced Street to Southbound Fowler Avenue
79 Section , Item C
37 TTM 6537 Residential Development
Transportation Impact Study
The queuing concerns identified above support the decision of the City and Caltrans to pursue the installation of roundabouts at the SR 99/Merced Street interchange area. Although Caltrans and the City have conceptually proposed roundabouts at the interchange of SR 99 and Merced Street, this study does not assume their implementation in the 2046 horizon year due to pending development approvals.

4.2 Equitable Share Responsibility
It is expected that the Project will contribute to the City of Fowler’s traffic impact fee program to provide for its share of the improvements described above. For informational purposes, this section shows the Project’s equitable share responsibility for the improvements described above.

The formula used to calculate the equitable share responsibility to City of Fowler/Caltrans facilities is as follows:

Equitable Share = (Project Trips)/(Horizon Year Plus Project Traffic – Existing Traffic) Table 4-3 shows the Project’s equitable fair share responsibility on a percentage basis for improvements to City of Fowler/Caltrans facilities as described above. The equitable fair share responsibility shown in Table 4-3 is the result of LOS enhancements related to capacity.

MEMORANDUM
TO: Michael Chaney
Ventures 1021, LLC
FROM: Erik Ruehr
VRPA Technologies, Inc.

DATE: February 24, 2026
RE: TTM 6537 Transportation Impact Study
Traffic Safety Review
This traffic safety review is provided as part of a Transportation Impact Study (TIS) conducted for the TTM 6537 project in the City of Fowler. The project proposes to provide 199 single-family residential units on a proposed site located near the intersection of Fowler Avenue and Parlier Avenue. The Transportation Impact Study dated February 24, 2026 includes details regarding trip generation, trip distribution, project trips, roadway capacity analysis, and recommended roadway improvements.

The purpose of this memorandum is to provide a traffic safety analysis for portions of the State highway system where the project would be expected to provide a substantial increase in trips. The remainder of the memorandum includes background information, a description of the methodology used, safety analysis, traffic operations analysis, and recommendations.

BACKGROUND
Based on the project’s TIS, project traffic is expected to contribute traffic to the following locations along the State highway system:
 SR 99/Merced Street Interchange
 SR 99/Manning Avenue Interchange
This memorandum provides a traffic safety analysis as described in the Caltrans February 2024 Local Development Review (LDR) Safety Review Practitioners Guide.

METHODOLOGY
The methodology for conducting the safety analysis can be summarized as follows:
 Roadway accident data for the SR 99 interchanges with Merced Street and Manning Avenue for the past three years was reviewed to determine whether there are any safety issues exist that could be corrected through traffic operational improvements. 368
Section , Item C
Michael Chaney
February 24, 2026

Page 2 of 5 ends

 Project traffic based on the TIS was reviewed to determine whether the addition of project traffic would add to the need for safety-related improvements.  Roadway capacity and queuing analysis from the TIS was used to analyze the context for future traffic growth and potential roadway improvements that relate to safety conditions.

SAFETY ANALYSIS
A Traffic Accident Surveillance and Accident Summary (TASAS) report and a Collision Data Summary were provided by Caltrans for on ramps and off ramps at the interchanges of SR 99 with Merced Street and Manning Avenue. The information was provided for the most recently available three-year period from January 1, 2022 to December 31, 2024 and the results are shown in Attachment A After reviewing the available information, the following conclusions were noted:
 There were no fatal accidents at any of the ramps and therefore, the average collision rates were below statewide averages for fatal accidents.
 When considering fatal plus injury collisions, the following locations had collision rates higher than statewide averages:
- SR 99 Southbound Off Ramp to Manning Avenue
- SR 99 Northbound On Ramp from Manning Avenue
- SR 99 Southbound Off Ramp to Merced Street/Fowler Avenue  When considering the total of fatal plus injury and property damage only accidents, the following locations had collision rates higher than statewide averages:
- SR 99 Southbound On Ramp from Manning Avenue
- SR 99 Southbound Off Ramp to Merced Street/Fowler Avenue Of the locations identified above, the following locations were screened out of additional analysis because the project would not make any physical modifications and the project results in zero additional trips:
- SR 99 Southbound Off Ramp to Manning Avenue
- SR 99 Northbound On Ramp from Manning Avenue
The following locations were not screened out and additional analysis is required:
- SR 99 Southbound Off Ramp to Merced Street/Fowler Avenue - SR 99 Southbound On Ramp from Manning Avenue

Page 3 of 5 ends

For the ramps where further analysis is required, a review of the accident history was conducted.

Following is a summary:
 SR 99 Southbound Off Ramp to Merced Street/Fowler Avenue: The accidents at this location were 4 rear end accidents with speeding listed as the cause in each of the accidents. This is a relatively low level of accidents and not indicative of a correctable pattern. Signing and pavement markings on the off ramp were reviewed and considered to be adequate.

The project is expected to add 27 trips to this ramp in the AM peak hour and 78 trips to this ramp in the PM peak hour. The queuing analysis indicates that this off ramp will not experience any queues that would affect the SR 99 mainline. It is expected that the project traffic added to this intersection will not cause any changes in operation other than the addition of traffic. The accident risk per vehicle would be expected to remain at a fairly low rate as it is for existing conditions.

Although no increased accident risk has been noted, the City and Caltrans are pursuing the installation of a roundabout at this intersection and this would be expected to improve traffic safety.
 SR 99 Southbound On Ramp from Manning Avenue: The accidents at this location included 2 head on, 1 side swipe, and 1 overturn. Signing and pavement markings on the on ramp were reviewed and considered to be adequate.

The project is expected to add 15 trips to this ramp in the AM peak hour and 10 trips to this ramp in the PM peak hour. It is expected that the project traffic added to this intersection will not cause any changes in operation other than the addition of traffic. The accident risk per vehicle would be expected to remain at a fairly low rate as it is for existing conditions.

TRAFFIC OPERATIONS ANALYSIS
A detailed traffic operations analysis is provided in the project’s TIS. A summary is provided below:
 All intersections in the study area currently operate at level of service D or better.  With the addition of traffic growth from other sources and project traffic, four of the study area intersections are expected to experience level of service E or F conditions in the future: Merced Street/SR 99 Northbound Ramps, Merced Street/Fowler Avenue/Sumner Avenue/SR 99Southbound Ramps, Fowler Avenue/Fresno Street, and Manning Avenue/SR 99 Northbound Ramps.
 At the intersections of Manning Avenue/SR 99 Northbound Ramps and Fowler Avenue/Fresno Street, the TIS recommended that traffic signals be installed when warranted. 370

 At the intersections of Merced Street/SR 99 Northbound Ramps and Merced Street/Fowler Avenue/Sumner Avenue/SR 99 Southbound Ramps, the TIS mentioned two alternatives: traffic signals and roundabouts. Traffic signals were expected to resolve the level of service deficiencies but they were also expected to result in queuing issues which would tend to have a negative effect on safety. The installation of roundabouts would be expected to resolve the level of service deficiencies and also result in safety improvements. The City of Fowler and Caltrans have conducted analyses separate for the TIS for this project and are actively pursuing the installation of roundabouts at these intersections.

RECOMMENDATIONS
The analysis described above leads to the following recommendations.  No mitigation is needed to address short-term safety concerns since the number of accidents experienced at study area intersections is relatively low and not indicative of correctable patterns. In addition, there were no safety concerns relating to queuing of traffic onto the freeway mainline at any of the study area intersections through the horizon year.  Roundabouts are the preferred improvement the intersections of Merced Street/SR 99 Northbound Ramps and Merced Street/Fowler Avenue/Sumner Avenue/SR 99 Southbound Ramps. It is recommended that the project applicant work with the City and Caltrans to support implementation of these improvements.

Re: TTM 6537 Traffic Analysis – Updated Fair Share Percentages Dear Soo Ho:

VRPA Technologies, Inc. (VRPA) recently completed a Transportation Impact Study (TIS) for the TTM 6537 project in the City of Fowler. The approved TIS is dated February 24, 2026.

The project’s TIS assumed the construction of 199 single-family dwelling units and this has since been changed to 179 single-family dwelling units. This reduces the project’s fair share percentages for various intersections affected by the project as shown in the attached table. Other than changing the fair share percentages, there is no need for any changes in the TIS. Although the traffic effects of the project are somewhat overstated in the traffic analysis, there would be no substantial changes in terms of mitigation measures or other results.

If you have any questions, please feel free to contact me by email at [email protected] or by phone at (858) 361-7151.
