Executive Summary: In order for the City Council and the City’s legislative bodies to continue holding meetings by teleconferencing pursuant to Government Code Section 54953(e) (AB 361), the City Council needs to reconsider the circumstances of the state of emergency created by the COVID-19 pandemic every 30 days and find that the state of emergency continues to directly impact the ability of the members to meet safely in person.

BACKGROUND: On September 16, 2021, Governor Newsom signed AB 361 amending the Brown Act to allow local agencies to meet remotely during declared emergencies under certain conditions. AB 361 builds upon Executive Order N-29-20, issued by the Governor on March 17, 2020, which relaxed the teleconferencing requirements of the Brown Act to facilitate virtual meetings during the COVID-19 declared emergency.

AB 361 authorizes local agencies to continue meeting remotely without following the Brown Act’s standard teleconferencing provisions, including the requirement that meetings be conducted in physical locations, if the meeting is held during a state of emergency proclaimed by the Governor and either of the following applies: (1) state or local officials have imposed or recommended measures to promote social distancing; or (2) the agency has already determined or is determining whether, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.

To continue meeting remotely pursuant to AB 361, an agency must make periodic findings that: (1) the body has reconsidered the circumstances of the declared emergency; and (2) the emergency impacts the ability of the body’s members to meet safely in person, or state or local officials continue to impose or recommend measures to promote social distancing.

These findings should be made not later than 30 days after teleconferencing for the first time pursuant to AB 361, and every 30 days thereafter.

DISCUSSION/ANALYSIS: The City Council and the City’s other legislative bodies have met using teleconferencing throughout the COVID-19 pandemic to protect the health and safety of the public and staff. The factual circumstances exist for the City to continue to hold meetings pursuant to AB 361. Specifically, the Governor’s declared State of Emergency in response to the COVID-19 pandemic (the “Emergency”) is still in place. In addition, the City of Fremont COVID-19 Employee Resource Guide requires physical distancing for City employees, customers and visitors, to the extent possible. And finally, the Centers for Disease Control and Prevention continue to advise that COVID-19 spreads more easily

indoors than outdoors and that people are more likely to be exposed to COVID-19 when they are closer than 6 feet apart from others for longer periods of time. Therefore, due to the ongoing COVID 19 pandemic, the need to promote social distancing to reduce the likelihood of exposure to COVID-19, and the imminent risks to the health or safety of meeting attendees, the Emergency impacts the ability of the City Council and the legislative bodies of the City to meet safely in person.

FISCAL IMPACT: None.

ENVIRONMENTAL REVIEW: N/A

ATTACHMENTS: None.

RECOMMENDATION: Staff recommends that the City Council make the following findings in order to continue holding videoconference meetings for the City Council and the City’s legislative bodies:

1. The City Council has reconsidered the circumstances of the COVID-19 state of emergency;

2. The state of emergency continues to directly impact the ability of the members to meet safely in person; and

3. Staff is directed to schedule reconsideration of these findings at the regularly scheduled City Council meeting on March 8, 2022.

AMENDMENTS TO THE SPECIAL EVENTS ORDINANCE AND STAFF CHARGES - Introduce an Ordinance Amending the Special Events and Parades Ordinance and Adopt a Resolution Amending the Master Fee Schedule to Change City Staff Charges for Special Events

Executive Summary: Various City Departments, including Community Services, Police, and Public Works recently reviewed the Special Events and Parades Ordinance (FMC Chapter 12.25). City staff determined revisions are needed to align with current city practices and with anticipated future changes to the special event permitting process. It is also necessary to revise special event staff charge categories to align with services provided by the City and to update the Plaza Park category to align with the City’s upcoming Comprehensive Parks and Recreation Master Plan.

BACKGROUND: The Special Events and Parade Ordinance, FMC Chapter 12.25, (“Ordinance”) was last revised in 2013. Over the years, the City gradually changed its approach to special events, including responsiveness to public health and safety concerns related to events. In anticipation of how future events will be permitted, staff sees a need to revise the Ordinance.

Special event staff charges (Master Fee Schedule Article 1. General and Miscellaneous, Section 001.00000.3390, bullet C) was last updated in 2019. City staff suggests amending the special event staff charge categories to align with current and anticipated future services provided by the City.

In an effort to improve communication, historical event organizers who have applied for a special event permit since 2019 have been notified of these proposed changes. On January 19, 2022, an email outlining the proposed changes was sent to the group indicating this item was coming before the City Council for approval.

DISCUSSION/ANALYSIS:

Updates to the Ordinance: Proposed changes to the Ordinance are shown in the Draft Ordinance and are summarized below:

1. Using the current “Neighborhood – Civic Parks and Plazas” terminology as appropriate. The proposed amendment removes the plazas listed as examples and updates the park category name of “City Plazas” and use of the terminology “Neighborhood – Civic Parks and Plazas” to match the City’s pending Comprehensive

Parks and Recreation Master Plan. The proposed amendment also adds language to indicate the Recreation Division will continue to manage Civic Parks and Plazas, where approved by Council, as in the case of the Downtown Plaza.

2. Allowing late submissions under unforeseen circumstances. The proposed amendments include adding language for managing late applications to allow more flexibility for the City to evaluate the acceptance of late applications.

3. Allowing evaluation of applicant history within the past 12 months. The proposed amendments include expanding the reasons for denial of a special event permit to include the City’s ability to evaluate the applicant’s history of recent events that may have occurred outside of the City of Fremont.

4. Allowing established/recurring events, or those with significant impact, priority on historical event dates and location. The proposed amendments allow the City flexibility in approving events with a successful history or events with beneficial economic, public health, safety, or other impacts to the City to take precedence in securing an appropriate location.

5. Allowing deposits to be waived for events receiving funding from the City. The proposed amendments revise the ordinance to include a waiver of deposits for recipients of City funding for such events, thus reducing the processing of unnecessary payments and reimbursements from the event organizer and the City.

Updates to the Master Fee Schedule for Special Event Staff Charges: The current Special Event Staff charges were adopted in 2019 and include five staff categories and their hourly rates. The proposed amendments to staff charges effective FY 2022/2023 include revising the label of “Maintenance Employees” to “Maintenance Employees (Public Works/Community Services)” to allow better clarity to event organizers that maintenance employee service charges may be imposed by Public Works and/or Community Services as needed and as appropriate for their event. The amendments also include adding a sixth category “Public Service Assistant (PSA)” at the hourly rate of $25.00. The addition of this category would allow city departments to call in PSAs as needed and as appropriate to assist with special events. Their duties may involve monitoring the facility, allowing access to restrooms, preparation and cleanup of the event, etc. These services would be additional services not included in City rental facility fees or other special event permitting fees. The proposed $25.00 hourly rate is the City’s current average loaded PSA II rate provided by Community Services; PSA IIs are primarily utilized for these duties. It’s important to note that City staff is not proposing to recover the cost of PSAs that would be working on general assignments or who would otherwise be working during the event hours. The PSA service charges would be applicable when their service is called upon for the purpose of assisting the special events.

FISCAL IMPACT: Adoption of proposed changes to the Master Fee Schedule will result in a new category of special event staff charges, thus resulting in changes of fees assessed for special events as appropriate.

ENVIRONMENTAL REVIEW: Updates to Special Events and Parades Ordinance and amendments to City staff service charges for Special Events, are an administrative government activity that is not subject to the California Environmental Quality Act (CEQA)

pursuant to CEQA Guidelines Section 15061(b)(3) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. CENTERVILLE COMPLETE STREETS PROJECT - Approval of Direction for the Street Design Along Fremont Boulevard to Retain Four Vehicle Lanes (Two in Each Direction) in the Centerville Business District Area, Generally Between Thornton Avenue and Central Avenue, as Part of the Centerville Complete Streets Project (PWC 8946)

Executive Summary: The purpose of this report is to facilitate design direction for improvements along Fremont Boulevard in the Centerville area that address interests for all travel modes and the local business community. Through an extensive community outreach process, interests have been expressed for a wide range of design options. In 2021, a demonstration project was conducted to test the effects of reducing Fremont Boulevard from four to three vehicle lanes. Based on studies of the demonstration project and community input, staff recommends retaining Fremont Boulevard with four vehicle lanes.

BACKGROUND: In September 2018, the State of California approved legislation (SB 989, Wieckowski) relinquishing to the City, State Route 84 running through the City of Fremont including portions of Thornton Avenue, Fremont Boulevard, Peralta Boulevard, and Mowry Avenue. The relinquishment has provided Fremont with local control over how to improve the street with regards to safety, travel modes, pavement conditions, and support for the historic Centerville business district.

The City has received a grant of Federal funds through the Alameda County Transportation Commission (CTC) in the amount of $7.7 million to improve portions of Thornton Avenue and Fremont Boulevard referred to as the Centerville Complete Streets project. Based on the grant conditions, the project is required to be ready to advertise for construction contract bidding by January 1, 2023.

Since prior to the State Route 84 relinquishment, the Centerville Community and Business Association has advocated for modifications to Fremont Boulevard to improve conditions for the local business district related to pedestrian safety, sidewalk dining, community gathering, parking, and aesthetics. Additionally, the City has adopted safety and multimodal policies that encourage increased travel by walking, bicycling and transit.

In an effort to address the complex set of policy and community interests in the Centerville business district area, a community outreach process was initiated to help guide the design of Centerville Complete Streets project. In July 2019, the City Council approved a contract with PlaceWorks to assist with the community engagement process. Four community meetings were held along with several stakeholder meetings to: 1) identify and prioritize the key issues and inform the community on complete streets design options; 2) review

design alternatives based on community input; and 3) present a preferred desig n and receive community feedback. A project webpage includes information from the community meetings and design options (see weblink below).

The residential and business community response to assigning roadway priorities and design alternatives was mixed, generally with residents preferring to maintain vehicle throughput along Fremont Boulevard, and the business representatives preferring to reduce the number of vehicle lanes in favor of traffic calming, more parking and enhanced outdoor gathering space. The range of options varied from keeping Fremont Boulevard with four through lanes for vehicle traffic to reducing it to two lanes (one lane in each direction). In response to the conflicting community feedback, staff implemented a six-month long demonstration project on Fremont Boulevard that reduced the number of vehicle lanes to three, with the northbound direction reducing from two lanes to one. The change allowed for adding on- street parking, enhanced bike lanes and pop-up patios to create outdoor spaces during the pandemic. The demonstration project was largely funded through an Alameda CTC Rapid Covid Response grant. The test period for the demonstration project period started in June 2021 and extended through the end of December 2021.

DISCUSSION/ANALYSIS: For the demonstration project, staff collected data throughout the test period to determine the effects on corridor travel times and vehicle delay, bicycle and pedestrian use, and corridor crashes/collisions. Because the test period occurred during the Covid pandemic, it is not possible to draw significant conclusions related to changes in travel conditions associated with the demonstration project. Overall, traffic volumes in the Fremont Boulevard corridor were about 30% lower during the test period than they were before the start of the pandemic.

At the midpoint of the demonstration project, an online community survey was conducted to gather community input on the traffic impacts and patterns on Fremont Boulevard and neighboring streets, pedestrian and bicycle activity, and on the use of the pop-up patio dining areas.

The survey received approximately 400 responses with 50% of the respondents being Centerville residents and 38% being Fremont residents living outside the Centerville area.

• 70% of the respondents utilized the roadway at least 3 times per week, while an additional 20% utilized the roadway at least once/twice per week • 97% of the respondents typically drive through the corridor, while 27% also used alternative transportation modes such as walking, biking, and transit • 74% responded that the project increased pedestrian safety • 74% responded that the project increased traffic congestion • 26 businesses reported greater difficulty for business access • The “pop-up patios” received very little use.

An overwhelming majority (over 90%) of the written feedback opposed reducing vehicle lanes due to the impacts on traffic congestion and communicated a preference for Fremont Boulevard to remain a major thoroughfare, but there was also significant support for

complete streets elements that improve pedestrian crossings and add protected bike infrastructure. Based on feedback from the Centerville community, staff is recommending returning Fremont Boulevard to a 4-lane road configuration while adding sidewalk improvements, enhanced pedestrian crossings, and either a buffered bike lane or an elevated bike lane on Fremont Boulevard.

All of the design alternatives that feature four vehicle through-lanes offer less space within the public right of way that can be devoted to new outdoor gathering space, which was a community priority based on the design workshop conducted at the first community meeting. As a way to enhance gathering space in the Centerville business district, staff recommends that future efforts focus on utilizing existing open space to create more vibrant gathering areas at the Centerville Train Depot and Bill Ball Plaza.

Next Steps and Other Centerville Area Projects
Subject to City Council approval of the staff recommendation, final design work will proceed on the Centerville Complete Streets project based on retaining Fremont Boulevard as a four - lane street. Significant improvement elements will include pavement rehabilitation, modified intersections at Fremont/Thornton and Fremont/Peralta, new pedestrian signal at Fremont/Bonde Way (near Centerville Train Station), new pedestrian flashing beacon (at Artist Walk entrance), separated bikeway or buffered bike lanes (dependent on space availability), transit stop enhancements, and sidewalk repairs throughout the corridor. For the area south of Peralta Boulevard, future improvements will be made in conjunction with the planned private development project (formerly Silicon Sage). Note that the Centerville Complete Streets project will also include improvements along Thornton Avenue consistent with “safe routes to school” plans by the City and Fremont Unified School District , and will include a new traffic signal at the Thornton/Oak intersection.

There are other significant transportation improvements planned in the Centerville area which include:
• Fremont Boulevard Traffic Signal Modernization – Currently in construction for nine miles along Fremont Boulevard from north Fremont to south Fremont. Project completion is planned for Fall 2022
• Peralta Boulevard and Fremont Boulevard Underground Utility Conversion – The City and PG&E are working to underground the overhead utility lines along Peralta Boulevard between Fremont Boulevard to Sequoia Road and Fremont Boulevard between Alder Avenue to Thornton Avenue. Construction is planned for 2024 • Centerville Corridor Railroad Quiet Zone – Planning work has commenced to provide railroad crossing safety improvements and establish a railroad quiet zone in the Centerville area, including the crossings at Fremont Boulevard, Maple Street, Dusterberry Way, and Blacow Road. The project is eligible for funding from regional grants.

FISCAL IMPACT: The cost to implement the improvements on Fremont Boulevard are within the scope of the grant funding received from Alameda CTC.

ENVIRONMENTAL REVIEW: Environmental review will be conducted upon further development and implementation of the approved design direction discussed in this Staff Report.
