ORDINANCE NO. XX-2022
AN ORDINANCE OF THE CITY OF FREMONT REZONING A 22.4-
ACRE SITE AT 40517 -40525 ALBRAE S TREET AND 6000
STEVENSON BOULEVARD FROM P-2006-10 (“THE GLOBE”
PLANNED DISTRICT ) TO P-2021-160 (PRELIMINARY AND
PRECISE PLANNED DISTRICT ), TO ALLOW A THREE-
BUILDING, APPROXIMATELY 397,000-SQUARE-FOOT INDUSTRIAL
DEVELOPMENT
WHEREAS, a project applicant has proposed a General Plan Amendment (GPA) to change the land use designation of the property located at 40517-40525 Albrae Street and 6000 Stevenson Boulevard from Regional Commercial to Tech Industrial in conjunction with an application to rezone the property to Preliminary and Precise Planned District P-2021-160; and
WHEREAS, an Addendum to the previously certified Environmental Impact Reports (EIRs) (State Clearinghouse #2005042146) prepared for a prior redesignation of the site and The Globe Planned District (P-2006-10) was prepared in compliance with the California Environmental Quality Act (CEQA); and
WHEREAS, the Planning Commission held a noticed public hearing on the project including the GPA on February 24, 2022, after which the Commission recommended that the City Council approve the GPA and the project, as proposed, by a vote of 5-1; and
WHEREAS, the City Council held a noticed public hearing on March 15, 2022 on the project, and considered the reports and documents presented by City staff, the Planning Commission’s deliberations, and the written and oral comments presented at the public hearing; and
WHEREAS, all legal requirements for adopting the proposed ordinance have been met.
THE CITY COUNCIL OF THE CITY OF FREMONT DOES ORDAIN AS FOLLOWS:
SECTION 1. ZONING MAPS AMENDED
The Zoning Maps of the City of Fremont, codified as Fremont Municipal Code Title 18, Chapter
18.35 (Zoning Maps), Section 18.35.010, are hereby amended by rezoning property addressed 41517-40525 and 6000 Stevenson Boulevard, as more particularly shown on the PLN2021- 00160 rezoning Exhibit “C” to the March 15, 2022 City Council staff report, attached hereto and incorporated herein as Attachment 1, from P-2006-10 (“The Globe” Planned District) to P- 2021-160 (Preliminary and Precise Planned District).

SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT COMPLIANCE As set forth in “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT
ADOPTING AN ADDENDUM TO THE ENVIRONMENTAL IMPACT REPORT AND
SUPPLEMENTAL PREPARED AND CERTIFIED FOR THE GLOBE IN CONJUNCTION WITH THE ALBRAE INDUSTRIAL GPA & REZONING PROJECT LOCATED AT 40517- 40525 ALBRAE STREET AND 6000 STEVENSON BOULEVARD,” adopted by this Council, the City Council hereby determines that the Addendum and Mitigation Monitoring and Reporting Program prepared for this project have been completed in compliance with the requirements of the CEQA, and finds on the basis of the whole record before it that the project would not result in new significant environmental effects or a substantial increase in the severity of previously identified significant effects; that there are no changes in circumstances that would result in the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; and that there is no new information resulting in new significant environmental effects, a substantial increase in the severity of previously identified significant effects, or a change in the feasibility or acceptance of mitigation measures, and that this action reflects the independent judgment of the City of Fremont. The Director of Community Development shall file a Notice of Determination with the County Clerk in accordance with the CEQA guidelines.
SECTION 3. EFFECTIVE DATE
This ordinance shall take effect and will be enforced thirty (30) days after its adoption.
SECTION 4. PUBLICATION AND POSTING
The City Clerk has prepared and published at least five days before the date of adoption a summary of this ordinance once in a newspaper of general circulation printed and published in Alameda County and circulated in the City of Fremont. A certified copy of the full text of the ordinance was posted in the office of the City Clerk since at least five days before this date of adoption. Within 15 days after adoption of this ordinance, the City Clerk shall cause the summary to be published again with the names of those City Council members voting for and against the ordinance and shall post in the office of the City Clerk a certified copy of the full text of this adopted ordinance with the names of those City Council members voting for and against the ordinance.
The foregoing ordinance was introduced before the City Council of the City of Fremont at the regular meeting of the City Council, held on the 15th day of March, 2022, and finally adopted at a regular meeting of the City Council held on , 2022, by the following vote:
