Executive Summary: The City is proposing an amendment to the Downtown Community Plan (DCP) and a Zoning Text Amendment to Fremont Municipal Code (FMC) Section 18.47 Downtown District to allow four curb-cuts on the northwest side of Capitol Avenue between State Street and Fremont Boulevard (collectively, the “proposed amendments”). Curb-cuts (or new driveways) are currently prohibited along this section of Capitol Avenue. The proposed amendments are being sought as part of a settlement agreement authorized by City Council with a downtown property owner, Sunhill Enterprises, LLC (“Sunhill”). Staff and the Planning Commission recommend that City Council approve the proposed amendments.

The ordinance was introduced by the City Council at its May 3, 2022 meeting. The ordinance is now before the Council for adoption.
