Executive Summary: As provided for by the City Attorney’s employment contract, the Mayor has requested that the City Attorney receive a five percent cost of living wage increase equal to the percentage general wage increase being provided to the City’s miscellaneous represented employees.

BACKGROUND: City Attorney Rafael E. Alvarado, Jr. has been employed by the City of Fremont since February 2022. The City entered into an employment agreement with Mr. Alvarado on January 12, 2022, and that agreement provides that the City Council may grant Mr. Alvarado periodic cost of living wage increases. The Mayor now desires to provide Mr. Alvarado with a five percent cost of living wage increase commensurate with the negotiated wage increase provided to all other City of Fremont miscellaneous employees in association with the City’s recently concluded labor negotiations.

Mr. Alvarado currently receives an annual salary of $295,000 and a bi-weekly salary of $11,346. If this recommended general wage increase is approved, Mr. Alvarado’s new annual salary will be $309,750 or $11,913 bi-weekly.

FISCAL IMPACT: The annual cost of the recommended five percent cost of living wage increase will be $14,750 (approximately $15,400 total compensation) and will be absorbed primarily by the General Fund with smaller amounts being absorbed by the Integrated Waste Management Fund and the Risk Management Fund.
