Executive Summary: The purpose of this report is to provide the City Council with a report on emergency actions recently taken to replace a leaking waterline at the Police Center. The work was conducted using the City Manager’s emergency authority to streamline the procurement of contracted services. This report complies with provisions of the State Public Contract Code and the Fremont Municipal Code regarding public notification to the City Council of emergency work performed.
BACKGROUND: On June 16, 2022, significant water leaks were discovered at two locations at the Fremont Police Center (2000 Stevenson Boulevard.) The overall waterline was al so observed to be severely corroded. The location of the water leakage created a threat to the functioning of the Police Center and to its infrastructure including the main building, emergency generator and access driveways.
Due to the potential for a major failure of the waterline and disruption to essential public safety services, Public Works received approval from the City Manager to proceed with an emergency contract and waive full compliance with the standard competitive bidding process for non-emergency public works projects, which generally takes approximately three months to complete. Staff subsequently issued an informal Request for Quotations for the waterline replacement work and received five bid responses. The contract was awarded to Environmental Services, Inc. who submitted the lowest bid and was available to immediately work on the project. The work was completed on August 1, 2022. The total project cost was $175,000.
DISCUSSION/ANALYSIS: In accordance with the Public Contract Code Section 22050 and Fremont Municipal Code Section 3.20.290, the Fremont City Council has delegated authority to the City Manager to order emergency action to protect the City, based on a written determination supported by substantial evidence that there is an emergency, there is a need to take immediate action to resolve the emergency, and the action to be taken is directly related to resolving the emergency. Applicable law defines an “`emergency’ as a sudden, unexpected occurrence that poses a clear and imminent danger, requiring action to prevent or mitigate the loss or impairment of life, health, property, or essential public services.” On June 29, 2022, the City Manager made the emergency determination based on facts and information provided by staff, and authorized award of an emergency contract to immediately address the risk to public facilities and operations.
