CITY OF Memorandum
Fremont
DATE: July 15, 2022
TO: Lester Aquino, Civil Engineer I
FROM: Joel Pullen, Planning Manager
SUBJECT: PLN2019-00020, Hsieh Property Street Vacation and Public Service Easement Dedication The Community Development Department has reviewed the application cited above for a proposed street vacation and public utility easement dedication as part of the development of a new single-family home at 43477 Bryant Street. The area to be vacated is primarily unused and not necessary for future street widening purposes as the remaining right-of-way is sufficient to accommodate the roadway, which in its current condition meets City standards. Staff has determined that the approximately 791 square feet of unused right- of-way adjacent to 43477 Bryant Street is excess and no longer needed for present or prospective roadway use.
The portion of Bryant Street to be vacated is adjacent to 43477 Bryant Street (APN 513-0608-126).
General Plan Consistency
As specified in Fremont Municipal Code Section 2.20.310(b), for the purpose of conformity findings required to be made pursuant to Government Code Section 65402(a), the functions of the planning agency of the City may be performed by the Planning Manager. The property in question is designated Low Density Residential in the General Plan and the vacated would become a portion of that adjacent property upon vacation. The proposed street vacation would conform to the following policy and implementation measures of the General Plan:
LAND USE POLICY 2-2.11: Problem Parcels - Avoid the creation of "problem" parcels that are not practical to develop or provide with services. Work to eliminate or merge such parcels where they already exist.
LAND USE IMPLEMENTATION MEASURE 2-2.11.B: Merger of Problem Parcels - To the extent lawful and feasible, require or encourage the acquisition and merger of problem parcels that adjoin non-problem parcels when discretionary approvals (including subdivisions) are requested for non- problem parcels.
LAND USE IMPLEMENTATION MEASURE 2-2.11.C: Land Assembly - Encourage the assembly of small or awkwardly shaped contiguous parcels in order to create more viable development sites and promote the more productive and efficient use of land.
MOBILITY IMPLEMENTATION MEASURE 3-3.1.B: Narrower Streets - Where aesthetic, safety, and emergency access considerations can be addressed, design streets only as wide as required to provide all necessary functions in a new development to create a less auto-oriented, more pedestrian- friendly street environment.
The proposed street vacation would allow an undevelopable portion of surplus right-of-way to be merged with a parcel that has already been developed with a single-family home, consistent with the above- referenced General Plan Land Use policy. Therefore, I find that the proposed street vacation is consistent with the General Plan.
