Executive Summary: Staff recommends the City Council accept the proposal from the Public Restroom Company (PRC) and authorize the City Manager or designee, to execute an agreement with the Public Restroom Company, Inc (PRC), through SourceWell Cooperative Contract #081721, to design, fabricate, deliver and install a restroom at Centerville Community Park for a base amount of $457,436, plus a 10% contingency of $45,744, for a total contract amount of $503,180; and find that the project is exempt from environmental review pursuant to CEQA Guidelines Section 15302 and the Council’s prior approval of a mitigated negative declaration which covered the entire Centerville Community Park Project.

BACKGROUND: Centerville Community Park, located at 3375 Country Drive, currently exists as a developed ten-acre parcel with an additional 9.86 acres, identified as 3350 Eggers Drive, which is planned to be developed in the future. In 2002, City Council had approved a total of $5,100,000 to develop the remaining ten acres of fallow land as an expansion of the existing park. From 2002-2007, staff worked on the Master Plan and Construction Drawings for public bid. In 2007, the park expansion was put on hold due to maintenance cutbacks. Later in 2007, it was determined that additional maintenance funds would be allocated to maintain the site; therefore, project design resumed. An additional $2,700,000 was allocated to the project in 2007-2008 through the CIP process, to address increases in construction cost.

The Centerville Community Park project was then divided into two phases, the first phase being Centerville Community Park Demolition project (8392A) and the second phase being the park development portion (8392B). The demolition project was awarded in 2008 which included the removal of all existing structures and debris on the undeveloped 9.86 acr es of land, including seven (7) structures and their foundations, and associated earthwork, fence removal, tree removal, asphalt and concrete removal, and other miscellaneous debris.

After completion of the demolition, the development phase of work (8392B) was again put on hold.

In January 2019, a restroom/meeting room at the left field corner of the Sigmund ballfield in Centerville Community Park was struck by a car and one restroom had to be permanently closed due to structural damage. As a result, a new restroom facility is needed to replace Staff Report (ID # 4710) Meeting of October 4, 2022
Updated: 9/29/2022 10:14 AM by Alberto Quintanilla B Page 2 the damaged restroom, to serve the developed park and its users, and to accommodate the future 9.86 development.

The new restroom facility will be located approximately 300 feet away from the damaged structure, behind the backstop of the existing Sigmund Ballfield, on the currently undeveloped parcel.

DISCUSSION/ANALYSIS: The installation of this restroom will serve users of the existing developed park, and the undeveloped, future parkland. This prefabricated bathroom will be located adjacent to the existing Sigmund Ballfield, behind the backstop. This building will have a traditional men’s and women’s restroom with 3 stalls each: one (1) all gender restroom, a storage room, and a maintenance chase. The roof line and exterior aesthetics will be like the restroom installed at Lila Bringhurst Community Park, also created and installed by Public Restroom Company.

This building footprint is based on an off-the-shelf model and has been customized to meet the City’s needs in terms of the number of stalls provided, storage and maintenance access.

The City will further customize elements to meet its needs, such as selecting exterior aesthetics, plumbing fixtures and other building elements, as required per City Building Maintenance Standards.

Cooperative Purchase

The pre-fabricated restrooms will be purchased from the Public Restroom Company through a cooperative contract (cooperative purchasing/piggybacking) with SourceWell (formerly National Joint Powers Alliance, NJPA). SourceWell is a public agency/cooperative created by the Minnesota legislature to provide purchasing contracts that are competitively bid nationally and at lower prices to other public entities.

Fremont Municipal Code (FMC) Section 3.20.310 authorizes the City to participate in cooperative agreements with other public agencies to purchase goods and services, including incidental labor and public works components, at prices established by the cooperative purchasing agency (SourceWell) through a competitive bidding process that meets the City’s procurement goals and objectives. Authority for cooperative purchases is also codified in Public Contract Code sections 10298 and 10299.

Based on staff’s review, SourceWell’s competitive bidding process meets the City’s procurement goals and objectives. The Public Restroom Company will design, manufacture, deliver and install the prefabricated restrooms at a cost saving to the City compared to typical on-site construction methods. Savings will largely be achieved in architectural and labor costs reductions resulting from redesigned floor plans and construction taking place offsite. This method of project delivery also expedites the project timeline since building fabrication is the longest lead item on this type of project.

Completion of site improvement plans and other work to bring utilities into the park to support the restroom and the future park development will be designed and publicly bid , and the contract for this work will be presented to the Council for approval.

Project Schedule
Staff Report (ID # 4710) Meeting of October 4, 2022
Updated: 9/29/2022 10:14 AM by Alberto Quintanilla B Page 3 The Public Restroom Company has provided a delivery schedule to finalize the fixtures and finishes, revise all drawings and submit to the City for permitting, construct the bathroom structure, deliver to the site and install, a time frame of 240 working days from the issuance of a Notice to Proceed. Based on the rough schedule, staff anticipates a target delivery date after June 1, 2023.

All underground utilities servicing the building and future 10-acre park, are currently being designed separately. The utilities for this restroom installation will be installed by public bid by a separate contractor and completed prior to the delivery and installation of the prefabricated restroom.

FISCAL IMPACT

Project Budget and Funding: Funds were originally allocated in 2002, totaling $8,122,475, when the original master plan for the undeveloped 10 acres of Centerville Community Park was designed. When the project was put on hold in 2008, remaining funding totaled approximately $7,348,943. Between 2008 and the most current CIP, small projects were done throughout Centerville Community Park, and staff time was billed against the PWC.

Additional funding of $4,200,000 was added per the 2021/22-2025/26 Capital Improvement Program, in anticipation of developing a portion of the site in conjunction with the Fremont Unified School District (FUSD) joint use park. The current funding balance in PWC8392 -540 is $10,953,089 and PWC8392-543 is $9,341 for a total current balance of $10,962,430.

ENVIRONMENTAL REVIEW: A mitigated negative declaration was prepared and approved by the City Council on May 14, 2002, for the entire Centerville Community Park project, as originally designed (EIA No. PLN2002-00233). The work associated with the proposed project is consistent with the original park project analyzed in the mitigated negative declaration and no further environmental review is required. As a separate and independent basis for CEQA compliance, the project is exempt from CEQA as a Class 1 facility (Replacement and Reconstruction of Existing Facilities) pursuant to Section 15302 of the Guidelines of the California Environmental Quality Act.
