Executive Summary: The purpose of this report is to authorize the execution of the Facilities Maintenance Agreement for the Fremont Skate Park at 40500 Paseo Padres Parkway (Central Park) to maintain the Skate Park in a safe and usable condition.

BACKGROUND: The current Fremont Skate Park opened in 2013. It is approximately an acre in size and located in Central Park adjacent to the Aqua Adventure Waterpark. The skate park includes street course, bowls, and many other features. This skate park is visited by over a hundred skaters daily and is open from dawn to dusk or until 8:00 p.m.

Over the last two fiscal years, City Park Maintenance staff has identified several areas of infrastructure failure at the skate park requiring maintenance service. Specific issues , such as broken tiles, cracked concrete, loose surfaces and wear on sealant joints, demand attention to preserve the skate park’s sustainability.

DISCUSSION/ANALYSIS: A Request for Proposals (RFP #23-012) was publicly released on October 19, 2022. The RFP remained open through November 17, 2022. The Skate Park Maintenance and Safety Work listed in the RFP included but was not limited to the following:

• Maintenance of Concrete Spalling
• Remove and Replace Broken Tiles at Skate Park Bowl
• Seal all saw cut joints
• Seal concrete cracks

The City received no proposals for RFP #23-012. Fremont Municipal Code 3.30.030 permits the City to negotiate and enter into a contract if no proposals are received by the City after the advertising period. Following this authority, City staff reached out to California SkateParks about completing the work after the advertising period of the RFP closed without receipt of any proposals. California SkateParks agreed to complete the project and City staff is recommending the City Council authorize the City Manager to executie a facilities maintenance agreement with California SkateParks for the Skate Park Maintenance and Safety Work.

If approved, the City expects the Skate Park Maintenance and Safety Work to commence in early 2023 and for the skate park to reopen in spring/summer 2023.

Council Staff Report (ID # 4762) Meeting of December 20, 2022 Updated: 12/11/2022 10:52 AM by Susan Gauthier A Page 2 FISCAL IMPACT: All City costs associated with this agreement are included in the budget adopted through the bi-annual CIP process (PWC8501 Capital Replacement for Parks) and there will be no General Fund impact.

ENVIRONMENTAL REVIEW: The maintenance activities for the existing park play surfaces are exempt from review under the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15301, Existing Facilities. Prior to commencement of ground disturbing activities, the requirements of Fremont Municipal Code Section

18.218.050(b)(1)(Standard Development Requirements for Burrowing Owls) will be met.

ATTACHMENTS: None.
