Executive Summary: The purpose of this report is to facilitate the continuation of timely response to hazardous materials emergencies.
BACKGROUND: In 2018, the City entered into a five-year on-call contract in an amount not to exceed $95,000 annually with Environmental Logistics Inc. to provide emer gency response to hazardous material emergencies and scheduled waste removal. Due to service demand increases, the annual contract budget was increased to $130,000 in 2021, and to $156,000 in November 2022.
DISCUSSION/ANALYSIS: Incidences of unscheduled and emergency responses increased during Fiscal Year (FY) 2022/23 and are expected to exceed the current contract amount of $156,000 per year. Emergency responses have increased due to assistance required by the Police Department with homeless encampment cleanup, multiple drug lab cleanups, and an unanticipated emergency generator response at City Hall. Hazardous materials responses are trending upward, and staff recommends an increase of $60,000 for a total not-to- exceed amount of $216,000. Accordingly, an amendment to the agreement with Environmental Logistics Inc. is recommended to fund the increase in service levels through FY 2022/23, the last remaining year on the contract.
FISCAL IMPACT: Sufficient funding for the additional hazardous materials emergency response is available in the Maintenance Division’s General Fund Operating Budget.
ENVIRONMENTAL REVIEW: The recommended action is exempt from the requirements of the California Environmental Quality Act (CEQA) per, without limitation, each on a separate and independent basis, (1) CEQA Guidelines Section 15301(b) Existing Facilities, as the scope of work involves cleaning of existing public sewerage and stormwater facilities; (2) CEQA Guidelines Section 15308 Actions by Regulatory Agencies for Protection of the Environment, as the proposed agreement would assure the maintenance, restoration, or protection of the environment and the regulatory process involves procedures for protection of the environment; (3) CEQA Guidelines Section 15330 Minor Actions to Prevent, Minimize, Stabilize, Mitigate or Eliminate the Release or Threat of Release of Hazardous Waste or Hazardous Substances, as the proposed agreement would authorize minor cleanup actions to prevent, minimize, stabilize, mitigate, or eliminate the release or threat of release of a hazardous waste or substance; and (4) CEQA Guidelines Section 15378(b)(2),(4) and/or Council Staff Report (ID # 4784) Meeting of January 10, 2023 Updated: 1/4/2023 5:02 PM by Alberto Quintanilla Page 2 (5), and or 15061(b)(3), as an administrative or fiscal activity of the City, which has no possibility directly or indirectly to cause a significant adverse effect on the physical environment.
ATTACHMENTS: None.
RECOMMENDATION: Make findings of CEQA exemption, and authorize the City Manager or designee to execute an amendment to the Hazardous Materials Response Agreement with Environmental Logistics Inc. to increase compensation by $60,000, to an amount not to exceed $216,000 for the last year of the contract.
