RECOMMENDATION: Approve the following actions related to the State Grant Funds:

1. Find the actions are exempt from environmental review, each as a separate and independent basis for CEQA compliance, under CEQA Guidelines, Section 15378 (administrative and funding activity not a “project” under CEQA) and Section 15061 (no possibility the activity may have significant effect on the environment). Environmental review will be conducted as part of the project environmental clearance process, as appropriate.

2. For the Sabercat Bridge and Trail project (Parks and Recreation Grant):

Accept AB 179 funds in the amount of $6 million, appropriate the funds to the Sabercat Trail Extension Project – PWC8977-525, and adopt a resolution approving the city application for specified grant funds from the State Budget Act of 2022/23 in the amount of $6 million and certifying the City will have sufficient funds to complete and operate the project and will comply with the general provisions contained in the funding contract required per the 2022-23 Procedural Guide for Local Assistance Specified Grants.

3. For the Sabercat Bridge and Trail project (Caltrans Grant): Accept AB 179 funds in the amount of $6 million, appropriate the funds to the Sabercat Trail Extension Project – PWC8977-525, and adopt a resolution authorizing the City Manager to execute agency-state master agreements for the Sabercat Bridge and Trail project and for other transportation projects that may be approved by the City for which state and/or federal funding is approved.

4. For the Centra Park Community Center project: Accept AB 179 funds in the amount of $8 million, appropriate the funds to the Central Park Community Center Project– PWC9087-525, and adopt a resolution authorizing the City Manager to execute a funding agreement with the State.

5. For the Housing Navigation Center: Accept AB 179 funds in the amount of $500,000, appropriate the funds to the Housing Navigation Center project, and authorize the City Manager to execute a funding agreement with the State. No resolution is required for this item.

a. Finds that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to, without limitation, CEQA Guidelines Section 15311, Accessory Structures and CEQA Guidelines Section 15183 in that it is an on-site sign which conforms to the Fremont General Plan and applicable Zoning rules, and that each of the foregoing provides a separate and independent basis for CEQA compliance. b. Determines that that proposed project is in compliance with the City’s zoning ordinance in that the orientation, height, size, and design of the pylon sign are in compliance with the development standards and policies for freeway-oriented pylon signs.
c. Based on the available information, evidence presented at the hearing and consideration of the above, finds that the proposed project is consistent with the City’s General Plan for the reasons described in this staff report and by reference in Informational 3 (December 8, 2022 February 7, 2023 Fremont City Council Page 11
Planning Commission Report).

3. Grants the Appeal (reversing the Planning Commission’s decision to deny the project and allow the project to proceed), approving the proposed Conditional Use Permit to allow a freeway-oriented sign as shown in Exhibit “A,” subject to the findings and conditions of approval contained in Exhibit “B”.

6. Other Business

Executive Summary: In order for the City Council and the City’s legislative bodies to continue holding meetings by teleconferencing pursuant to Government Code Section 54953(e) (AB 361), the City Council needs to reconsider the circumstances of the state of emergency created by the COVID-19 pandemic every 30 days and find that the state of emergency continues to directly impact the ability of the members to meet safely in person.

BACKGROUND: On September 16, 2021, Governor Newsom signed AB 361 amending the Brown Act to allow local agencies to meet remotely during declared emergencies under certain conditions. AB 361 builds upon Executive Order N-29-20, issued by the Governor on March 17, 2020, which relaxed the teleconferencing requirements of the Brown Act to facilitate virtual meetings during the COVID-19 declared emergency.

AB 361 authorizes local agencies to continue meeting remotely without following the Brown Act’s standard teleconferencing provisions, including the requirement that meetings be conducted in physical locations, if the meeting is held during a state of emergency proclaimed by the Governor and either of the following applies: (1) state or local officials have imposed or recommended measures to promote social distancing; or (2) the agency has already determined or is determining whether, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.

To continue meeting remotely pursuant to AB 361, an agency must make periodic findings that: (1) the body has reconsidered the circumstances of the declared emergency; and (2) the emergency impacts the ability of the body’s members to meet safely in person, or state or local officials continue to impose or recommend measures to promote social distancing. These findings should be made not later than 30 days after teleconferencing for the first time pursuant to AB 361, and every 30 days thereafter.

DISCUSSION/ANALYSIS: The City Council and the City’s other legislative bodies have met using teleconferencing throughout the COVID-19 pandemic to protect the health and safety of the public and staff. The factual circumstances exist for the City to continue to hold meetings pursuant to AB 361. Specifically, the Governor’s declared State of Emergency in response to the COVID-19 pandemic (the “Emergency”) is still in place. In addition, the City of Fremont COVID-19 Employee Resource Guide requires physical distancing for City employees, customers and visitors, to the extent possible. And finally, the Centers for Disease Control and Prevention continue to advise that COVID-19 spreads more easily

indoors than outdoors and that people are more likely to be exposed to COVID-19 when they are closer than 6 feet apart from others for longer periods of time. Therefore, due to the ongoing COVID 19 pandemic, the need to promote social distancing to reduce the likelihood of exposure to COVID-19, and the imminent risks to the health or safety of meeting attendees, the Emergency impacts the ability of the City Council and the legislative bodies of the City to meet safely in person.

RECOMMENDATION: Staff recommends that the City Council make the following findings in order to continue holding videoconference meetings for the City Council and the City’s legislative bodies:

Executive Summary: In order to confirm that the California Public Employees’ Retirement System (CalPERS) will appropriately consider established City of Fremont employee compensation earnable when calculating retirement benefits, the City of Fremont’s Employee Salary Schedule (or Pay Plan) is required to be formally adopted by the City Council in a public meeting. City Council approval of the overall pay plan is required for compliance with CalPERS compensation reporting requirements. This report does not seek Council action with respect to amounts of employee compensation, as such compensation has already been established via bargaining or under separate authority.

BACKGROUND: Fremont Municipal Code Section 2.25.210 (Salary Entitlement) codifies the City Manager’s authority to set, approve and amend employee pay ranges as part of a City-wide Salary Schedule. This authority is further outlined and defined in the City of Fremont’s Personnel Rules: Article VI (Compensation). In order to comply with CalPERS reporting requirements, staff requests, from time to time, that the City Council approve the current and most up-to-date salary schedule to reflect compensation changes that have been made under the City Manager’s authority since the City Council’s last approval. The salary schedule attached to this report reflects compensation rate changes made to comply with local minimum wage requirements; negotiated compensation increases (authorized during the bargaining process that concluded in July 2022), and various classification and compensation changes made to effect organizational compensation alignment, to incorporate market data and to maintain Fremont’s position as a desirable employer. The City Council last adopted the Citywide pay plan on September 7, 2021.

The City currently publishes its salary schedules on its publicly accessible website and the schedules are adjusted and reposted after each amendment.

DISCUSSION/ANALYSIS: The Public Employees’ Retirement Law (PERL) Government Code Section 20636 defines compensation earnable for State, School, and Public Agency members and in doing so requires that pay be outlined in publicly available pay schedules.

California Code of Regulations (CCR) Section 570.5 outlines eight criteria required to ensure that a pay plan is considered publicly available as follows:
(1) Has been duly approved and adopted by the employer’s governing body in accordance with requirements of applicable public meeting laws
(2) Identifies the position title for every employee position

(5) Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s internet website
(6) Indicates an effective date and date of any revisions (7) Is retained by the employer and available for public inspection for not less than five years
(8) Does not reference another document in lieu of disclosing the pay rate

The City’s Human Resources Department is responsible for ongoing compliance with CCR 570.5’s criteria (2) through (8). The City Council’s formal adoption of the pay plan will finalize compliance and further verify that City of Fremont employee salaries are to be considered “earned compensation” for the purposes of retirement/CalPERS reporting.

Human Resources staff will seek Council adoption of the City’s salary schedules from time to time when substantial changes to the salary schedules are being implemented. Each adoption of the salary schedules will incorporate salary changes resulting from any changes implemented by the City Manager as consistent with her authorities and responsibilities outlined in Municipal Code Section 2.25.210. The attached salary schedule reflects the following changes:

1) Implementation of the local required minimum wage increase; 2) Implementation of salary increases associated with successor Memorandum s of Understanding (MOU’s) approved in July 2022;
3) Classification and compensation changes resulting from organizational and/or market studies.

FISCAL IMPACT: This action is not seeking any specific change to employee compensation as such changes have already been implemented and their budgetary authority was coordinated via bargaining or City Manager authority.

ENVIRONMENTAL REVIEW: City administrative and personnel-related actions, and general policy and procedure making are not a “project” under CEQA, per CEQA Guidelines Section 15378(b)(2).

WHEREAS, the City Manager is authorized to set, approve and amend employee salary ranges as part of a citywide Salary Schedule pursuant to Fremont Municipal Code Section

WHEREAS, California Government Code Section 20636 and California Title 2 of the Code of Regulations, Section 570.5 require that salary schedules be publicly available and be approved and adopted by the City Council at a public meeting to ensure proper reporting to CalPERS for retirement benefit purposes; and

WHEREAS, per the requirements of California Government Code Section 20636 and Title 2 of the Code of Regulations,Section 570.5, the City’s salary schedule is posted currently available on the City’s publicly accessible website and is available to the public; and

WHEREAS, City administrative and personnel-related actions, and general policy and procedure making are not a “project” under CEQA, and the City Council finds that this action is not a “project” per CEQA Guidelines Section 15378(b)(2).

Executive Summary: The purpose of this report is to initiate construction of a multimodal safety improvement project at the intersection of Fremont Boulevard and Walnut Av enue.

Funding is partially provided from a Federal grant. The project is part of an ongoing series of investments that are transforming Fremont Boulevard from a historically auto-oriented thoroughfare into a “complete street” that supports safe and convenient mobility by all travel modes. The project also includes a westerly extension of the 1.5-mile long Walnut Avenue protected bikeway to the Fremont Hub commercial center.

BACKGROUND: In 2021, the City of Fremont received a competitive Federal grant though the Metropolitan Transportation Commission’s (MTC) Safe and Seamless Mobility Quick - Strike Program. The Quick-Strike Program is a one-time, competitive grant program within the One Bay Area Grant (OBAG) program framework, and it emphasizes bicycle/pedestrian safety and mobility, connections to transit, and projects that advance equitable mobility. On May 4, 2021, the City Council adopted a resolution of support for the project.

This project will provide enhanced safety and comfort for people walking, bicycling, and connecting with transit in the Downtown/Central Fremont Priority Development Area (PDA) and commercial district. The project also supports multimodal travel along the Fremont Boulevard Transit Priority Corridor and in the Walnut Avenue multimodal corridor which connects to the Fremont BART station. This project will reconstruct the existing intersection with protected intersection features and modify the existing traffic signals to accommodate the new intersection design. Key project elements consist of the removal of existing right turn slip lanes, new elevated curb returns to encourage slower vehicle turns, raised bike lanes, new ADA curb ramps, enhanced intersection safety lighting, new video detection for bicycles, touchless pedestrian push buttons, high visibility crosswalks, and enhanced bikeway connections to existing bike facilities upstream and downstream of the project intersections.

Various City, County, and regional plans identify the Fremont Boulevard and Walnut Avenue corridors as priorities for developing high quality facilities for walking, bicycling, and transit.

These plans include the Fremont Bicycle Master Plan; the Alameda County Transportation Plan, the East 14th/Mission Boulevard/Fremont Boulevard Multimodal Corridor Plan, and the

Construction is anticipated to begin in Spring 2023 with completion scheduled by December 2023.

DISCUSSION/ANALYSIS: Bids for this project were opened on December 6, 2022. The bidders with their respective bid amounts are shown below. The Engineer’s Estimate is $2,300,000.

The low bidder for this project, Golden Bay Construction, Inc., submitted a responsive bid and all documents are in order. The contractor is a responsible bidder experienced in this type of work and has satisfactorily completed contracts of this nature with the City and other nearby local agencies. Pursuant to the requirements of Section 21080.25 of the Public Resources Code, staff certifies that the entire project will be completed with a skilled and trained workforce and that contractor Golden Bay Construction, Inc., shall be required to provide sufficient and competent administration, staff, and a skilled and trained workforce necessary to perform and timely complete the work in accordance with the contract documents.

Based on lessons learned from earlier bids for similar projects, staff updated the Engineer’s Estimate to account for the higher costs based on 1) increased costs of current market for construction materials, fuel and trucking, 2) escalating construction costs for traffic signal work, and 3) limited space for contractor to work, store and stage construction materials and equipment in the project area. While the low bid was lower in cost than the updated Engineer’s Estimate, the cost increases were not budgeted in the original estimate submitted for grant funding.

FISCAL IMPACT: Additional funding is needed to construct the project in order to adjust for the recent inflationary increase in construction costs. The increased source of funding is proposed to come from reallocating unused contingency funds from two completed projects and by transferring funds from the future Fremont Boulevard/Country Drive Intersection Improvements Project. The Fremont/Country project is expected to receive a new funding allocation from ACTC in Spring 2023 which will free up some of the funding currently programmed to that project.

As noted in the “Source of Funds” section above, staff recommends reallocation of funds as proposed, to allow construction to move forward for this project, thereby meeting the grant deadline for project delivery. With the recommended additional reallocation of funds to the project, there will be sufficient funds available for the estimated project cost.

ENVIRONMENTAL REVIEW: Based on the whole records and each as a separate and independent basis for CEQA compliance, the project is statutorily exempt from CEQA review under Section 21080.25 of the Public Resources Code, as amended, because the project is a sustainable transportation project that implements pedestrian and bicycle facilities (i.e., construction of protected intersection corners, elevated curb returns, raised pedestrian/bicycle corners and green buffered bike lanes) and improves pedestrian and bicycle safety and improves access for current and potential transit riders. The project is located within public right of way and does not add new infrastructure that increases automobile capacity or require demolition of affordable housing. Furthermore, the City certifies the project will be completed by a skilled and trained workforce pursuant to enforceable contract provisions requiring contractors and subcontractors at every tier to use skilled labor. As a separate and independent basis, the project is exempt under CEQA Guideline Section 15301, Class 1(c), 15301 for "Existing Facilities" in that it involves operation, repair, maintenance or minor alteration of existing structures, facilities involving negligible or no expansion of existing or former use. None of the exceptions to the categorical exemptions outlined in CEQA Guidelines section 15300.2 applies to the Project.

In addition, review under the National Environmental Policy Act (NEPA) was also performed and a Categorical Exclusion (CE) with technical studies was prepared for the project. On November 15, 2021, the State determined that the project does not individually or cumulatively have a significant impact on the environment as defined by the National Environmental Policy Act (NEPA) and is excluded from the requirements to prepare an Environmental Assessment or Environmental Impact Statement.

Key project elements include the removal of existing right turn slip lanes, new elevated curb returns to encourage slower vehicle turns, raised bike lanes between Grimmer Boulevard and Eugene Street, new ADA curb ramps, enhanced intersection safety lighting, new video detection for bicycles, touchless pedestrian push buttons, high visibility crosswalks, and enhanced bikeway connections to existing bike facilities upstream and downstream of the project intersections.

Various City, County, andregional plans identify the Fremont Boulevard and Grimmer Boulevard corridors as priorities for developing high quality facilities for wal king, bicycling, and transit. These plans include the Fremont Bicycle Master Plan; the Alameda County Transportation Plan; the East 14th/Mission Boulevard/Fremont Boulevard Multimodal Corridor Plan; and the Alameda County Priority Bikeway Network; and the Regional Active Transportation Plan adopted by the Metropolitan Transportation Commission.

Construction is anticipated to begin in Spring 2023 with completion scheduled by December 2023.

DISCUSSION/ANALYSIS: Bids for this project were opened on December 6, 2022. The bidders with their respective bid amounts are shown below. The Engineer’s Estimate is $3,200,000.

The low bidder for this project, Redgwick Construction Co., submitted a responsive bid and all documents are in order. The contractor is a responsible bidder experienced in this type of work and has satisfactorily completed contracts of this nature with the City and other nearby local agencies. Pursuant to the requirements of Section 21080.25 of the Public Resources Code, staff certifies that the entire project will be completed with a skilled and trained workforce and that contractor Redgwick Construction Co. shall be required to provide sufficient and competent administration, staff, and a skilled and trained workforce necessary to perform and timely complete the work in accordance with the contract documents.

FISCAL IMPACT: Additional funding is needed to construct the project in order to adjust for the recent inflationary increase in construction costs. The increased sources of funding are primarily from County Measure B and BB sales tax funds dedicated to improving bicycle and pedestrian facilities. These funds are administered by the Alameda County Transportation Commission (ACTC). It is noted that some ACTC funding is being transferred out of the Fremont Boulevard/Country Drive Intersection Improvement Project (PWC9050), however these funds are expected to be backfilled by a new ACTC funding allocation in Spring 2023. In addition, $500,000 is proposed from unallocated State gas tax revenues that are associated with recently increased gas prices.

Staff recommends reallocation of funds as proposed above, to allow construction to move forward for this project, thereby meeting the grant deadline for project delivery. With the recommended additional reallocation of funds to the project, there will be sufficient funds available for the estimated project cost.

ENVIRONMENTAL REVIEW: Based on the whole records and each as a separate and independent basis for CEQA compliance, the project is statutorily exempt from CEQA review under Section 21080.25 of the Public Resources Code, as amended, because the project is a sustainable transportation project that implements pedestrian and bicycle facilities (i.e., construction of protected intersection corners, elevated curb returns, raised pedestrian/bicycle corners and green buffered bike lanes), improves pedestrian and bicycle safety, and improves access for current and potential transit riders. The project is located within public right of way and does not add new infrastructure that increases automobile capacity or require demolition of affordable housing. Furthermore, the City certifies the project will be completed by a skilled and trained workforce pursuant to enforceable contract provisions requiring contractors and subcontractors at every tier to use skilled labor. As a separate and independent basis, the project is exempt under CEQA Guideline Section 15301, Class 1(c), 15301 for "Existing Facilities" in that it involves operation, repair, maintenance or minor alteration of existing structures and facilities involving negligible or no expansion of existing or former use. None of the exceptions to the categorical exemptions outlined in CEQA Guidelines section 15300.2 applies to the project.

On November 29, 2021, the State determined that the project does not individually or cumulatively have a significant impact on the environment as defined by the National Environmental Policy Act (NEPA) and is excluded from the requirements to prepare an Environmental Assessment or Environmental Impact Statement. On May 2, 2022, the City validated the NEPA document as current and complete.
