ADDENDUM TO MEMORANDUM OF UNDERSTANDING

ALAMEDA COUNTY JUSTICE

ASSISTANCE GRANT CONSORTIUM
ARTICLE: ONE
NAME
The name of this addendum to the Memorandum of Understanding shall be the ALAMEDA COUNTY JUSTICE ASSISTANCE GRANT (JAG) CONSORTIUM.

ARTICLE: TWO

PURPOSE
A. The purposes of the JAG Consortium are:

1. The fair and equitable dispersal of the annual allocation of the federal Edward J. Byrne Justice Assistance Grant (JAG) funds to Alameda County and eligible Alameda County cities.

2. Ensure compliance with JAG funding program areas limited to: law enforcement; prosecution and the courts; prevention and education; corrections and community corrections; drug treatment; and planning, evaluation and technology improvement within the eligible Alameda County Cities and Alameda County.

The promotion of coordinated law enforcement efforts utilizing Justice Assistance Grant Program funding throughout Alameda County with maximum cooperation between all member law enforcement agencies.

ARTICLE: THREE

AMENDMENTS TO THE MOU
The representatives from the agencies identified at the end of this Attachment B may amend any Article of this addendum to the MOU by following the Terms of Agreement/Addendum in the existing MOU.

ARTICLE: FOUR

DISTRIBUTION OF THE JUSTICE ASSISTANCE GRANT PROGRAM ASSETS A. The aforementioned representative members shall determine the distribution of 1 Attachment B
the JAG funding in a manner which is as fair and equitable as possible to all eligible members.

B. It is agreed that annual JAG funding shall be shared based on the participating agencies' respective 2004 allocation under the Byrne Formula and Local Law Enforcement Block Grants (LLEBG). The following formula, determined by mutual consent, will be utilized.

The annual state and local allocations under the (JAG) Program commencing in 2005 shall comprise the total available JAG award for the eligible Alameda County cities and Alameda County.

2. The 2004 Byrne Formula and LLEBG form the base formula allocation level for all member agencies except for the City of Emeryville. Emeryville did not qualify for the 2004 Local Law Enforcement Block Grant monies so their base level shall be the 2004 base qualification threshold level of $10,000.

3. In the event that the annual JAG funding amount is greater than the 2004 Byrne Formula and LLEBG totals, the surplus funds shall be allocated to all eligible member agencies using the combined 2004 Byrne Formula and LLEBG percentage allocation formula as the basis for the eligible members.

4. In the event that the annual JAG funding amount is less than the 2004 Byrne Formula and LLEBG totals, the lower funding amounts shall be allocated to all eligible member agencies using the combined 2004 Byrne Formula and LLEBG percentage allocation formula as the basis for the eligible members.

For only the 2005 JAG grant allocation year, the eligible members shall receive their full 2004 base allocation amounts and any shortfall shall be attributed to the funding total of the Alameda County Narcotics Task Force.

6. The ACNTF will utilize funding from both the state and local JAG allocations as shown in Attachment A.

ARTICLE: FIVE

FISCAL PROCEDURE
A. Responsibility: The County of Alameda shall be responsible for the administration of all fiscal procedures necessary to facilitate JAG funding operations.

B. JAG awards are to be distributed at the beginning of a fiscal year. The County of 2 Attachment B
Alameda shall receive the local JAG allocations and distribute the funds as soon as possible to all the eligible member agencies based on the particular formula percentages.

C. The County of Alameda is the JAG program administrator and responsible for the administration of the program assets.

D. All member agencies will submit a quarterly financial report and a semi-annual program status report to the County of Alameda through the Alameda County Narcotics Task Force Executive Policy Committee to enable the County to submit timely overall reports to the responsible federal and state agencies.

E. Administrative Overhead: The Alameda County Sheriff's Office and the Alameda County Auditor-Controller shall be reimbursed for the administrative cost of managing the JAG grant program by direct allocation of allowable administrative costs calculated at one percent (1%) of the actual total direct JAG program allocation even though the federal rules allow ten percent (10%). However, for the 2005 JAG program allocation, Alameda County will forego receiving administrative costs.
