Executive Summary: The purpose of this report is to request authority to amend the Recreation Service Agreement with Communication Academy, Inc. to increase the amount not to exceed to $185,000.

BACKGROUND: The Recreation Services Division of the Community Services Department offers a variety of activities and programs for the community. Communication Academy, Inc. has been partnering with the City of Fremont Recreation Division for many years offering educational instruction in academic math, public speaking, creating writing, journalism, debate, mock trial, storytelling, and more to youth in Fremont. Communication Academy, Inc. provides literature and communication enrichment programs with a high level of educational quality and engaging classes.

DISCUSSION/ANALYSIS: The annual not to exceed amount of the current agreement is $75,000. During the COVID-19 pandemic, programs experienced extreme decreases in registration. With conditions normalizing, there has been a significant increase in registrations and the number of camps offered to meet community demand. Additionally, Communication Academy, Inc. educational classes could be a new component offering within our After School Education and Safety Program (ASES) providing academic and literacy support, and safe, constructive alternatives for youth.

Based on current registration trends and the addition of programming options in our Expanded Learning Program, the After School Academy, staff recommends that the City Council authorize the City Manager or her designee to execute an amendment to the Recreation Service Agreement with Communication Academy, Inc., to increase the total not - to-exceed compensation from $75,000 to $185,000 for the contract term ending June 19, 2023.

FISCAL IMPACT: Communication Academy, Inc. is a program offered through the Recreation Services Cost Center and there is no impact to the General Fund. The Recreation Service Agreement includes a 60/40 contractual payment (60% of resident registration fees paid to the contractor; 40% to the cost center) to Communication Academy on registration fees as compensation.

ENVIRONMENTAL REVIEW: The proposed action is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5) and it has no possibility of a significant effect on the environment, as specified in CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

ATTACHMENTS: None.

RECOMMENDATION: Authorize the City Manager or her designee to execute Amendment No. 1 to the Recreation Service Agreement with Communication Academy, Inc. to increase the not-to-exceed compensation amount to $185,000 for the current contract term ending June 19, 2023.
