Executive Summary: The report recommends that the City Council transfer funds from the Park Cost and Scope Contingency, PWC8101-541 of $80,700 to PWC 9012-541; approve the plans and specifications for Rix Park Basketball Court Project, accept the bid, and award the construction contract to Silicon Valley Paving, Inc. for the Base Bid amount of $329,358, with 10% Construction Contingency amount of $32,936, for a total Contract amount of $362,294; and to consider exemptions from the requirements of the California Environmental Quality Act (CEQA).

BACKGROUND: The existing half size basketball court located in the southern section of Rix Park has been in use since 1964. The court is separated from the main gravel pathway by turf with no dedicated pathway to the court itself. The surface of the basketball court is in disrepair and has exceeded its usable lifespan. The City has received numerous complaints regarding the condition and usability of the existing court.

The project scope will include: demolition and removal of the existing basketball court; backfill and conversion of the old court footprint to lawn; installation of two n ew back-to- back half courts with basketball standards nearer to Seneca Park Loop street, with an accessible concrete path from the street; installation of concrete paving and mow bands; installation of site furnishings; minor grading; modification to existing irrigation at additional new sod installation; and off-haul of excess excavated soils.

DISCUSSION/ANALYSIS: The proposed removal of the old basketball court from its existing location and the installation of the new basketball court adjacent to Seneca Park Loop provides a new playing court for residents with dedicated hardscape access to the court from the existing main circulation park pathway. The new location will enhance neighborhood eyes on the court, reducing vandalism and unwanted behaviors. The included Council Staff Report (ID # 4786) Meeting of February 7, 2023 Updated: 2/2/2023 11:19 PM by Susan Gauthier Page 2
site furnishing (i.e. trash and recycle receptacles) at the court will help to reduce maintenance cost for the court and immediate area.

Rix Park Basketball Court Project was funded and approved as a part of the 2019/20 – 2023/24 and 2021/22 - 2025/26 Capital Improvement Programs. The project was bid and advertised on December 6th, 2022 and December 13th, 2022. The bids were opened on January 6th, 2023.

FISCAL IMPACT:

Project Budget and Funding: Rix Park Basketball Court Project was funded with a total of $450,000 of Park Dedication Fees and was approved as part of the 2019/20-2023/24 and 2021/22 -2025/26 Capital Improvement Programs. The amount in the fund will cover the design, consultant fees and the construction bid for the project. Due to escalation of construction costs and recent spikes in inflation, the project budget will not be able to cover the construction contingency and construction administration and management. The deficit is proposed to be covered through a transfer of funds from Park Cost and Scope Contingency, PWC8101-541.

Transfer of Funds: As of January 1, 2023, the Park Cost and Scope Contingency, PWC8101-541 has a balance of $267,360. These funds are eligible for use in the Rix Park Basketball Court Project. This report includes a recommendation to transfer $80,700 from Park Cost and Scope Contingency, PWC8101-541 to fund PWC 9012-541-R to cover the Council Staff Report (ID # 4786) Meeting of February 7, 2023 Updated: 2/2/2023 11:19 PM by Susan Gauthier Page 3
