Executive Summary: In 2005, the City of Fremont, along with the Cities of Alameda, Berkeley, Emeryville, Hayward, Livermore, Newark, Oakland, San Leandro, and Union City, amended the 2004 Alameda County Narcotics Task Force (ACNTF) memorandum of understanding (MOU) to establish the Alameda County Consortium Byrne Justice Assistance Grant (JAG) Local Consortium.

The MOU appoints the County of Alameda via the Alameda County Sheriff’s Office as the program administrator responsible for the administration of all fiscal procedures to facilitate JAG funding operations for the JAG Consortium members.

This report requests that the City Council provide explicit authorization and designation for Alameda County to review and submit all JAG grants on behalf of the City of Fremont.

BACKGROUND: In 2004 the United States Department of Justice (USDOJ) grant programs and the Local Law Enforcement Block Grants (LLEBG) and the Byrne Formula Grants merged into a hybrid grant program now known as Byrne Justice Assistance Grants (JAG) Local.

The USDOJ wanted to allocate these JAG grants on a regional consortium basis to our country’s various qualifying local law enforcement agencies. The Alameda County Chiefs of Police & Sheriff’s Association (ACCOPSA), an organization including all the Alameda County area's local law enforcement agencies, joined together with the Federal Bureau of Investigation (FBI) and the Alameda County District Attorney's Office to form the regional Alameda County Narcotics Task Force (ACNTF) through a memorandum of understanding (MOU). In 2005, the City of Fremont, along with the Cities of Alameda, Berkeley, Emeryville, Hayward, Livermore, Newark, Oakland, San Leandro and Union City, entered into an amendment of the 2004 MOU to establish the Alameda County Consortium Byrne Justice Assistance Grant (JAG) Local Consortium.

Each year the USDOJ, through the Bureau of Justice Assistance (BJA), informs the Alameda County Sheriff’s Office (ACSO), as the program administrator of the JAG Local consortium for Alameda County, of the new funding levels for Alameda County and the qualifying cities within Alameda County. The ACSO is responsible as the program administrator for meeting all of the grant pre-requisite requirements on behalf of the JAG Consortium.

Council Staff Report (ID # 4796) Meeting of February 7, 2023 Updated: 2/2/2023 11:34 PM by Susan Gauthier Page 2
DISCUSSION/ANALYSIS: The Edward Byrne Justice Assistance Grant Program Local Solicitation form requires a review by the governing body of the unit of local government (e.g., City Council or County Board of Supervisors). The 2004 Alameda County Narcotics Task Force Addendum to Memorandum of Understanding and the 2005 Amendment establishing the Alameda County Justice Assistance Grant Local Consortium (MOU) does not provide clear guidance on Alameda County’s ability to review the grant application on behalf of the City of Fremont. As a result, the most productive and prudent way to fulfill the administrative requirements for this year and future years under the MOU is for the City Council to authorize and designation for the County of Alameda Board of Supervisors to review and submit all JAG grants on behalf of the City of Fremont.

FISCAL IMPACT: None

ENVIRONMENTAL REVIEW: Authorizing Alameda County to apply for the JAG grants is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment.

Where it can be seen with certainty that there is no possibility that the activity in questi on may have a significant effect on the environment, the activity is not subject to CEQA. The authorization to apply for grants will clearly not have a significant effect on the environment and, thus, CEQA does not apply, and no further environmental review is necessary.
