Executive Summary: The purpose of this report is to facilitate the retention of an on-call consultant services to assist with the development of railroad quiet zone projects.
BACKGROUND: On-call consultant services agreements are used for services requiring expertise that City staff does not have and/or to supplement City staff during periods of peak work demand.
There are eleven identified at-grade crossings that are part of the Fremont Quiet Zone Program -- a set of projects designed to enhance the safety of railroad crossings and allowing for passing trains to not blast their horn. Two crossings have been design ated as quiet zones - the Stevenson Boulevard quiet zone was established on December 2, 2010, and the Nursery Avenue quiet zone was established on September 4, 2021. Six crossings are part of the Centerville Railroad Corridor Project, which is currently funded through concept design. Staff is actively seeking funding for design of the remaining three at - grade crossings as well as construction funding for the Centerville Railroad Corridor Project from Alameda County Transportation Commission and as part of train service improvement projects. As funding becomes available, the on-call consultant would assist staff with implementing the remaining crossings in the Fremont Quiet Zone Program.
The on-call quiet zone consultant would perform services to assist with updating existing condition inventories at the at-grade railroad crossings, preparing conceptual and final designs to implement safety improvements needed to establish the quiet zones, and conducting meetings and preparing applications with the California Public Utilities Commission (CPUC) for establishment of the quiet zone.
DISCUSSION/ANALYSIS: In December 2022, the City solicited proposals for On-Call Quiet Zone Consulting Services. Two proposals were received from the following firms, listed alphabetically: Lockwood, Andrews & Newnam, Inc., and RailPros, Inc.
An evaluation panel, comprised of City staff, evaluated all of the proposals based on the completeness of the proposal, understanding of project scope, overall experience to perform the required services, previous and current work with public entities, evaluation of assigned personnel and their experience, billing rates, and evaluation of their overall approach.
Council Staff Report (ID # 4794) Meeting of February 7, 2023 Updated: 1/19/2023 9:54 AM by Alberto Quintanilla Page 2 Based on the results of the evaluation process, staff recommends authorizing the approval of a master agreement for on-call quiet zone consulting services with RailPros, Inc. for the not-to-exceed amount of $1,250,000 over a period of five years.
FISCAL IMPACT: All task orders issued, and work performed by the consultants under the on-call Master Service Agreement will be restricted to the funds appropriated and available for the specific approved project for which the work is required.
ENVIRONMENTAL REVIEW: Environmental review is not required because award of this agreement is not a project within the meaning of California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15061 (b)(3) and 15378(b) as it can be seen with certainty that there is no possibility that award of the contract will have a significant effect on the environment and the award is an administrative activity that will not result in an effect on the physical environment. The projects that the consultant will provide services for will be subject to appropriate environmental review.
ATTACHMENTS: None.
RECOMMENDATION: Approve and authorize the City Manager or his designee to execute a Master Service Agreement with RailPros, Inc. for on-call quiet zone consulting services for a total not-to-exceed compensation of $1,250,000 for five years.
