RESOLUTION NO. 2023-XX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

FREMONT AUTHORIZING THE CITY MANAGER TO EXECUTE A

LETTER OF INTENT WITH THE ALAMEDA COUNTY FIRE

DEPARTMENT TO NEGOTIATE THE TERMS OF A PROPOSAL FOR

AMBULANCE SERVICES AND/OR EMERGENCY MEDICAL

SERVICES IN ALAMEDA COUNTY

WHEREAS, in 2019 Alameda County, under their sole authority, awarded the contract for ambulance services within its Exclusive Operating Area, which includes Fremont, to Falck Northern California; and

WHEREAS, Falck Northern California has failed to meet contractual response time requirements in the Exclusive Operating Area, leading the Alameda County Fire Chiefs to consider other 911 ambulance service delivery models; and

WHEREAS, the Alameda County Fire Department (“ACFD”) is developing an ambulance service proposal (“Proposal”) in response to a Request for Proposals for emergency ambulance services and/or emergency medical services, which will be issued by Alameda County in Spring 2023 (“County RFP”); and

WHEREAS, ACFD wishes to partner with the Fremont Fire Department (“FFD”) and other fire departments within Alameda County to develop a new model for ambulance services that will address current issues with response times and financial feasibility, for which a Letter of Intent is required; and

WHEREAS, the Letter of Intent shall not create any contractual or other legal rights or obligations for the City; rather, the Letter of Intent is intended to confirm FFD interest to help ACFD develop an ambulance service Proposal in response to the County RFP, and to consult with and negotiate with ACFD regarding the extent of FFD’s participation in ACFD’s Proposal and any resulting contract with Alameda County, subject to City Council approval; and

WHEREAS, upon finalizing the partnership model, staff will return to Council and present further details regarding opportunities for FFD involvement, if any, under this new partnership model, and to obtain Council approval to enter into any ensuing participating and/or subcontracting agreement with ACFD should the City decide to participate in the new County ambulance service program.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES that the City Manager or designee is authorized to execute a Letter of Intent with the Alameda County Fire Department to enable the Fremont Fire Department to work with Alameda County Fire Department to develop a new model for ambulance services and to negotiate the terms and conditions of a partnership model in response to the upcoming Request for Proposals that will be issued by Alameda County in Spring/Summer 2023.
