Executive Summary The purpose of this report is to facilitate administrative adjustments to the City’s Capital Budget by: (1) returning unused appropriations to their respective funds; (2) transferring unused appropriations to existing projects; and (3) exchanging the source of project funding for some items. The recommended actions include “closing out” 19 completed projects.
BACKGROUND: The City’s current 5-Year CIP and Capital Budget was approved by the City Council in June 2021 and includes investments in the amount of approximately $189 million for the repair and improvement of the City’s parks, buildings and transportation system. The City currently manages over 200 capital projects in various stages of development that have received an appropriation of funds by the City Council. The majority of these projects are successfully managed by staff through project completion, consistent with initial budget appropriation amounts. Staff also pursues funds from internal and outside sources whenever possible to either wholly fund or offset City project expenses.
Typically, during the mid-year timeframe, staff identifies various administrative adjustments to the Capital Budget for City Council approval to allow for: closing out completed projects; adapting to changing circumstances; and enabling the most effective use of funds.
Additionally, staff is proposing a fund cleanup of Alameda County Transportation Commission (ACTC) Measure B funds. On March 31, 2022, the Measure B one-half sales tax expired. An allocation commitment of approximately $3.3 million dollars remains in Measure B Funds 518 and 519 for Bikes/Pedestrians and Local Streets/Roads and is proposed to be transferred to the Measure BB Funds 515 and 520 respectively.
DISCUSSION/ANALYSIS: The following describes various funding actions recommended in this staff report.
Project Closeouts
Upon completion of right-of-way acquisition, construction and other related activities, some capital projects have remaining budget appropriations. Historically, projects with over - expended balances are offset against projects with under-expended balances within the fund, and all are closed simultaneously. Staff periodically requests City Council approval to close projects and return unused funds to available fund balance for appropriation in the

Packet Pg. 9
Council Staff Report (ID # 4811) Meeting of March 14, 2023 Updated: 3/10/2023 9:08 AM by Alberto Quintanilla Page 2 next Capital Budget cycle, return to granting agencies, or appropriate to active capital projects as reflected on the Project Closeout List (Exhibit A). The Project Closeout List includes 19 completed projects.
Project Defund and Reallocation of Funds
Staff has identified some active or ongoing projects with remaining appropriations that are in excess of current project needs or where it is beneficial to fund the project with another source of funding as shown on the Defund List (Exhibit B). The funds then are either made available for appropriation in the next Capital Budget cycle, returned to granting agencies, or appropriated to active capital projects.
In addition, a reduction in private development activity in Fremont has resulted in lower projected development impact fee revenues in the amount of $13.6 million. For the current budget, numerous projects (identified on Exhibit B) are being partially defunded at this time. The future status of these projects will be reevaluated as part of the comprehensive CIP to be presented to Council in May 2023.
Project Appropriations
As funds become available through project closeout and defunding, or from new funding allocations, eligible projects are identified to receive funds. Recommended appropriations include active projects receiving budget augmentation for project completion or continuation of existing programs and reallocation of funding sources. A list of project appropriation actions is included in Exhibit C.
FISCAL IMPACT: The recommended actions will close out 19 projects and return $1.7 million to fund balance. In addition, 18 projects are recommended to be defunded, in a total amount of $14.9 million, of which $13.6 million will be returned to balance funds impacted by the decrease in revenue from development impact fees and $1.3 million will be returned to fund balance. Monies returned to fund balance will be redistributed to previously approved projects in need of funding augmentation as presented on Exhibit C and / or will be made available for future programming.
ENVIRONMENTAL REVIEW: The recommended actions are exempt from the California Environmental Quality Act (CEQA) because they are an administrative fiscal activity and not projects pursuant to CEQA Guidelines section 15378.

Executive Summary: Each year, the City of Fremont (“City”) levies annual assessments within Landscaping Assessment District 88 (“District”) for public landscape maintenance.
This District currently consists of 47 zones. These zones encompass subdivision tracts that were approved by the City without requiring the formation of homeowners associations (HOA).
The District maintains public landscaped areas benefiting these subdivisions. Each of the 47 zones in District 88 has an established maximum assessment. Four years ago, more than half of the zones managed by the City were at maximum assessment or within $2 of the maximum assessment. Presently, 68% of the District 88 zones managed by the City are at maximum assessment or within $2 of the maximum assessment. On pages 17 and 18 of the preliminary 2023-24 Annual Engineers Report the difference between current assessments and maximum assessments are shown for each zone. Maximum assessments are not keeping pace with District 88 service costs. The City is prohibited from assessing District 88 property owners above the established maximum assessments without first gaining property owners’ approval through a Proposition 218 ballot procedure. In spring/summer 2021, the City along with Harris and Associates completed a Proposition 218 property owner ballot process to restructure and reassess District 88 to support the cost of on-going services. The Proposition 218 proposal for District 88 was unsuccessful. Any additional work such as another Proposition 218 property owner ballot and restructuring of the District will require a new Request for Proposal.
State law requires two Council meetings to complete the annual assessment process. At this first meeting, staff recommends the City Council adopt resolutions ordering the preparation and filing of the enclosed annual Preliminary Engineer’s Report detailing calculations of the annual assessments and declaring intent to levy and collect annual assessments. The resolution sets a public hearing on the proposed levy for May 9, 2023. If the City Council approves the levy at the May meeting, the approved assessments will be forwarded to Alameda County for inclusion on property tax bills in July.
BACKGROUND: Levies of ongoing annual assessments and establishment of new landscaping assessment districts are governed by the Landscaping and Lighting Act of 1972 (the ”LLA”). The LLA allows the City to levy and collect assessments for the purpose of

Council Staff Report (ID # 4817) Meeting of March 14, 2023 Updated: 3/9/2023 10:19 AM by Alberto Quintanilla A Page 2 funding installation and maintenance of public landscaping and lighting improvements. The amount of the assessments levied on each parcel of land is calculated based upon the special benefit the parcel receives from the improvements.
The County collects the assessment with property taxes and transfers the funds to the City.
The City Council formed the Fremont Landscaping Assessment District 88 in December 1988. This is a citywide district allowing for the creation of individual landscape maintenance zones within the District as a condition of approval of residential subdivision maps. The assessments ensure ongoing maintenance of public landscaping improvements in or adjacent to the subdivisions which improves the appearance of the subdivisions and the City overall. The District currently consists of 47 Zones of which the City manages 41, encompassing subdivision tracts that were approved by the City and did not require the formation of homeowners’ associations (HOA).
On June 24, 1997, the property owners in District Zones 1 through 37 (except for Zones 18 and 22) authorized maximum assessment amounts to be established. In subsequent years, property owners authorized forming Zones 38 through 47 and authorized maximum assessments for them as well. The current 41 active District 88 Zones are 1 through 1 7, 19 through 21, and 23 through 47. The current 6 inactive District 88 Zones are 18 and 22 as property owner’s majority protests in 1997 and Zones 2, 6, 12, and 16 which are not assessed because City Council approved the homeowners request to maintain the landscaping. The assessment of these 4 zones can be imposed again if in the future homeowners fail to provide adequate maintenance.
The Zone Budgets and maximum assessments are shown in the Preliminary Annual Engineer’s Report on pages 5 through 9. All proposed assessment amounts for Fiscal Year 2023/24 are at or below the maximum established assessments approved by the property owners.
Presently, 68% of the zones managed by the City are at or within $2.00 of the established maximum assessment to maintain the landscaping. With the unsuccessful passing of the restructure and reassessment of District 88, additional zones will eventually reach their maximum assessment, meaning more and more zones will become under-funded and decisions about maintenance service level changes will need to be made to keep costs within the capped or available budgets for each zone. Additionally, capital improvement projects or replacements will be minimal, as assessment revenue will be used to cover regular maintenance service levels. As costs continue to rise due to inflation, the existing maximum assessments will be unable to match costs.
DISCUSSION/ANALYSIS: Annual Assessments for Existing Zones in District 88: To start proceedings for levying the annual assessment of District 88 for Fiscal Year 2023/24, the City Council must adopt two resolutions. The first resolution orders preparation of an Engineer’s Report detailing the calculation of the proposed annual assessments. The second resolution: (1) accepts and approves the Engineer’s Report, which the City Council has received prior to this meeting and which the City Council may modify before approving; (2) states the City Councils’ intent to levy and collect annual assessments; and (3) sets a public hearing date of May 9, 2023, for final approval of the proposed assessment amounts for Fiscal Year 2023/24.
Engineer’s Report: Each year since the inception of Landscaping Assessment District 88,

Council Staff Report (ID # 4817) Meeting of March 14, 2023 Updated: 3/9/2023 10:19 AM by Alberto Quintanilla A Page 3 staff has prepared and submitted an Engineer’s Report to the City Council. For each zo ne, the Engineer’s Report lists the expected costs (including a reasonable contingency) for the new fiscal year and a carryover cost. The carryover cost is sufficient to pay for the first six months of maintenance since assessments are not collected by the County until property tax bills become due. The City’s and County’s administrative costs are also included. The total is shown on the gross assessment line of the District budgets. A credit may be applied to each zone, which consists of the projected zone balance as of the end of the current fiscal year, less a reserve fund. The gross assessment less the credit for each zone is divided among its property owners to establish the annual net assessment (Total Balance to Assessment) for each property. Forty-one zones will be assessed in Fiscal Year 2023/24.
The annual assessments per lot vary considerably among the zones because of the difference in size and character of the landscaped areas, and because of the number of lots in the zone. In previous years, the City Council took special action on Zone 2 (nine lots in Tract 5847), Zone 6 (eight lots in Tract 5950), Zone 12 (nine lots in Tract 5558), and Zone 16 (seven lots in Tract 6121) to allow the homeowners in these zones to take responsibility for the landscape maintenance themselves. This action foregoes assessing these zones as long as the homeowners are properly maintaining the landscaping.
Currently, the homeowners in these four zones are maintaining the landscaping in a satisfactory manner.
Historical Annual Assessments, shown on pages 11 through 16 of the Report, list the assessment amounts for each of the previous years for the 41 Zones being assessed. This table also shows the maximum allowable assessment for each Zone.
The notice of public hearing with a Resolution of Intent must be posted and published in a local newspaper, one time, at least 10 days prior to the public hearing according to the Landscape and Lighting Act. At the public hearing, the Council must consider oral and written protests to the assessment. However, the proposed zone assessments for the existing District do not exceed the maximums established for Zones 1 through 47, so a majority protest will be merely advisory to the City Council and will not automatically defeat the proposed assessments.
New Zones: There are no new Zones proposed for the 2023/24 fiscal year.
LLMD funding reserves were allocated in Fiscal Year 2018/19 to hire a consultant, Harris and Associates, to prepare an updated report and other tasks, including the following:
• Review and update the overall program to ensure it continues to meet the requirements of the Landscape and Lighting Act of 1972 and Proposition 218; • Review and determine the public and private benefit of each lot in LLMD 88; • Conduct community outreach to share the results;
• Provide updates to each LLMD zone;
• Support changes to the current assessment process (proposed restructure and reassessment); and
• Assist with the mailed ballot process and community outreach for the proposed restructuring.

This work will continue through June 30, 2024. Any additional work will require a new Request for Proposal.
FISCAL IMPACT: The 2023/24 annual LLMD assessments are charged to property owners for the City of Fremont to maintain and administer landscaping services within each zone.
Contract costs will continue to be paid by District funding reserves.
ENVIRONMENTAL REVIEW: The recommended action is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5) and as it can be seen with certainty that there is no possibility that the activity may have significant effect on the environment per CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

20 PART IV – METHOD OF APPORTIONMENT
Method of Apportionment
Street and Highways Code Section 22573 requires tha t maintenance assessments be levied according to be nefit rather than according to assessed value. This section states:
“The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements.”
The 1972 Act permits the designation of areas of be nefit within any individual assessment district if "by reason of variations in the nature, location, and extent of t he improvements, the various areas will received di fferent degrees of benefit from the improvements." (Sec. 22574). Thus , the 1972 Act requires the levy of a true "assessm ent" rather than a "special tax."
In November 1996, the voters of California adopted Proposition 218, which has been codified as Article s XIIIC and XIIID of the California Constitution. Proposition 218 imposed a number of substantive and procedural requirements on taxes, assessments, and property-related fees imposed by local governments in California. Since the District Assessments were imposed prior to November 5, 1996, they are “grandfathered” under Article XIIID, Section 5(a) of the Constitution, which permits the continuation of assessments existing pr ior to the effective date of Proposition 218. The A ssessments may continue to be levied annually by the City without additional property-owner approval at the rates tha t existed when Proposition 218 went into effect. Any increase above such rates must be in compliance with Proposition 218 and requires property-owner approval.
The method of apportionment described in this Repor t, and confirmed by the City Council, utilizes comm only accepted engineering practices which have been established p ursuant to the 1972 Act and the California Constitu tion for the allocation of special benefit assessments. The calculation of assessments is based upon the parcel type and the services and improvements provided to equitably apportion the costs based on the special benefit received by each lot or parcel.
The special benefit received by each lot or parcel is over and above any general benefit conferred upon said lots or parcels or to the public at large.
Special Benefit
The improvements and associated costs have been all ocated to the assessable properties within the Dist rict based upon the special benefit received by those properties. The improvements for which the properties are asses sed have been identified as necessary, were installed and are bei ng maintained as part of the development plans spec ifically for each tract. As such, the improvements and continuing ma intenance and servicing of those improvements are s trictly the obligation of the properties within the District.

21 General Benefit
Although the improvements may be visible to passers by or to the public at large, the improvements were installed as a requirement of the development of the tract and are for the benefit of properties within the District. It has been determined therefore, any access or use by properties or individuals outside the District is completely incidental and the costs of operating, maintaining and servicing said improvements therefore provides no measurable benef it to outside properties or individuals.
Definition of Special Benefit
The method of apportionment described in this Repor t is based on the premise that each assessable parc el or unit receives distinct and special benefits from the imp rovements and services provided, including the visu al desirability provided by well-maintained landscaping. In accordance with Article XIII D, Section 4 of the California Constitution:
“Special benefit means a particular and distinct be nefit over and above general benefits conferred on real property located in the District or the public at large.” The special benefits associated with local landscaping improvements are specifically:
• Enhanced desirability of properties due to proximity and accessibility of the improvements. • Improved aesthetic appeal provided by a positive representation of the development, neighborhood and the community.
• Improved ingress and egress to property resulting in enhanced traffic flow, reduced traffic accidents and consequent reduction of possible property damage.
• Improved traffic visibility and circulation.
• Improved accessibility for emergency vehicles.
• Reduced vandalism and other criminal activity.
• Enhanced environmental quality provided by adequate green space and other landscaping which helps moderate temperatures, reduce noise pollution and control dust and debris.
The proceeds from the assessments are used to fund enhanced maintenance of improvements, services and activities that provide a special benefit to parcels within the Dis trict that, in absence of the assessment, would not otherwise be provided. The District will continue to receive the same level of general service provided to the public at large under City- funded and administered programs, as determined annually, related to the maintenance and servicing of public facilities and improvements (landscaped medians, streetscapes and right-of-way maintenance).
Consistent with the requirements of Section 4 of Article XIII D of the California Constitution that “only special benefits are assessable”, the City will provide the District with additional maintenance services at $0.088 per square foot of landscaped area along arterial or collector streets. The cost is based on the City’s current landscape maintenan ce contract for areas outside the District. These cost allocations, revi ewed and adjusted annually by the City, are conside red to be “general benefits” and are equal to or greater than the gene ral benefit related to the services being provided. All other maintenance, operations and administrative costs associated with the District, which exceed the City’s contribution to the public at large, are accordingly considered to be “ special benefits” funded by the District assessment s which provide a special benefit to the parcels within the District.” The assessment levied upon each parcel as presented does not exceed the reasonable costs of the proportional special benefit conferred to the parcel.
The table on the following page shows the general b enefit calculation for each Zone where general bene fit applies and the total amount that should be contributed to the District to pay for the general benefit portion of the Zone costs.

22 The above Zones have landscape maintenance services performed along arterial or collector streets with in the District.
The General Benefit Cost per Zone is based on the estimated percentage of landscaping along arterial or collector streets, multiplied by the $0.088 per square foot of landscaping. The cost per square foot determined and provided by City staff, and represents the costs to provide similar landscaping services in other areas of the City. The General Benefit Costs per Zone have been accounted for by the services provided by the City and are therefore not shown on the budget pages.

23 ASSESSMENT RANGE FORMULA
It is generally recognized that most budgetary items will be impacted by inflation in future years. In an effort to minimize the impact this has on maintenance districts, a for mula for inflationary adjustments is typically incl uded as a part of the maximum assessment to be approved by the property o wners during the formation of the District. Prior to the passage of Proposition 218 however, inflationary adjustments were not included as a standard part of the formation and approval process. The District was formed in 1988, prior to the passage of Proposition 218, and does not inclu de an inflationary adjustment for the annual assessments.
To impose a new assessment or increased assessment in excess of the Maximum Assessment Rate, the City must comply with the provisions of the California Constitution, Article XIII D, Section 4c that requires a public hearing and certain protest procedures including mailed notice of the public he aring and property owner protest balloting. Proper ty owners must approve the proposed new or increased assessment via a property owner protest balloting process before any such new or increased assessment can be imposed. A protest occurs when, at the public hearing, the returned as sessment ballots opposed to the new or increased assessment outweigh the returned ballots in favor of the new or increased assessment, weighting those returned assessment ballots by the financial obligation of each parcel.
The definition of new or increased assessments includes any assessment which, 1) did not previously exist or, 2) exceeds a previously approved assessment amount or assessment range formula. Any assessment range formula must have been previously adopted by the agency and approved by the property owners.

APPENDIX A – ASSESSMENT ROLL
Appendix A
Parcel Identification for each lot or parcel within the District shall be based on available parcel ma ps and other property data from the Alameda County Assessor’s office as they existed at the time this Report was prepared and adopted by the City Council.
A listing of parcels assessed within the District for Fiscal Year 2023-2024, along with the corresponding assessment amount is shown on the following pages. If any parcel sub mitted for collection is identified by the County A uditor/Controller to be an invalid parcel number for the current fiscal year, a corrected parcel number and/or new parcel n umbers will be identified and resubmitted to the County Auditor/Co ntroller. The assessment amount to be levied and c ollected for the resubmitted parcel(s) shall be based on the method of apportionment and assessment rate approved in th is Report.
Therefore, if a single parcel has changed to multiple parcels, the assessment amounts applied to each of the new parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment.
Non-assessable lots or parcels include areas of pub lic streets and other roadways (typically not assig ned an APN by the County); dedicated public easements, open space ar eas and rights-of-way, including public greenbelts and parkways; utility rights-of-way; common areas; landlocked parcels; small parcels vacated by the County, bifurcated lots and any other property that cannot be developed or has specific d evelopment restrictions. These types of parcels ar e considered to receive little or no benefit from the improvements and are therefore, exempted from assessment.

Executive Summary: The State of California has provided supplemental funding to local law enforcement agencies through the continuation of funding for the Citizens Option for Public Safety (COPS) grant program through the Supplemental Law Enforcement Services Account (SLESA). These funds are distributed by the State to the County, which passes through the funding to local agencies proportionally based on population, to be allocated at a minimum of $100,000.
In order to make use of the COPS funds, the City Council must authorize the acceptance and use of the funds.
The FY 2022/23 COPS grant allocation to the City of Fremont is $593,068, which will be spent on items supporting frontline law enforcement services.
BACKGROUND: Since 1997, the California State Budget Act has included allocations to counties and cities for the COPS program. This funding is intended to fill the need for additional resources at the local level to ensure public safety. Under the provisions of Government Code Section 30061-30063, a percentage of the funds are allocated to counties and cities, based upon population, for law enforcement services.
The COPS funds must be used for front line municipal police services and must supplement and not supplant existing funding. The City Council shall appropriate existing and anticipated moneys exclusively to fund frontline municipal police services in accordance with written requests submitted by the Chief of Police.
Each city must create a Supplemental Law Enforcement Services Account (SLESA) for the COPS grant money. The funds cannot be used for administrative overhead costs in excess of
0.5 percent of the total allocation. The allocation may not be used to fund the costs of any capital project or construction project that does not directly support front line law enforcement.
DISCUSSION/ANALYSIS: In FY 2022/23 the Fremont Police Department expects to receive $593,068 from the COPS grant into the SLESA and the funds will need to be spent by June 30, 2024. The funds are requested to be spent as follows:

However, should COPS grant money become unavailable, these service costs may be accommodated in the Police Department General Fund budget to the extent new funding becomes available.
ENVIRONMENTAL REVIEW: The recommended action is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/ or 15378(b)(5) and as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment per CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

Updated: 3/10/2023 9:10 AM by Alberto Quintanilla Page 1
ADOPT A RESOLUTION DESIGNATING AGENTS AUTHORIZED TO OBTAIN DISASTER AND EMERGENCY ASSISTANCE FUNDING – Adopt a Resolution Designating and Authorizing Agents to Act on Behalf of the City of Fremont for All Matters Pertaining to State and Federal Disaster Assistance Funding Contact Persons:
Name: Alec Tune David Persselin
Title: Emergency Services Manager Finance Director
Div/Dept: Fire Department Finance Department
Phone: 510-494-4200 510-494-4631
E-Mail: [email protected] [email protected]
Executive Summary: The City of Fremont may, from time to time, apply for State and Federal disaster assistance funding from the California Governor’s Office of Emergency Services (Cal OES), as authorized by the California Disaster Assistance Act (CDAA), or wh en granted by Federal sources as authorized under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as Amended. As a condition of receiving such assistance, Cal OES regulations, pursuant to the CDAA, require the governing body of a city to adopt a resolution designating and authorizing agents to act on behalf of the city for the purpose of obtaining such funding, and to renew such authorization at least once every three years.
BACKGROUND: The City Council previously adopted Resolution 2020-09, which designated and authorized the Assistant City Managers, Deputy City Manager, and Finance Director to apply for emergency financial assistance and prepared required documents on behalf of the City in response to declared emergencies. This resolution is expiring, and a new resolution is needed to enable the City to obtain state and federal emergency financial assistance when disasters occur.
Under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as Amended, a public entity may apply for Federal disaster assistance, including under the Federal Emergency Management Agency (FEMA) Public Assistance program, when such assistance has been requested by the Governor and a Major Disaster has been declared by the President of the United States. Under the California Disaster Assistance Act (CDAA), a local government may apply for CDAA disaster assistance when the Governor proclaims a State of Emergency and authorizes such assistance, or when the Director of Cal OES authorizes certain assistance. Additionally, the CDAA provides that the State may contribute a share toward FEMA Public Assistance program funding, reducing the applicable local cost share.
The City of Fremont may occasionally be eligible to apply for other grant funding from Cal OES, including FEMA’s Hazard Mitigation Grant Program, Pre-Disaster Mitigation Program, and Building Resilient Infrastructure and Communities program (each of which are authorized under the Stafford Act). Additional programs include the FEMA Flood Mitigation Assistance Program (per Section 1366 of the National Flood Insurance Act, as Amended), National Earthquake Hazards Reduction Program (per 42 U. S. Code Sections 7704(b)(2)(A)(ix) and 7704(b)(2)(B) and the Consolidated Appropriations Act, 2018, Div. F, Department of Homeland Security Appropriations Act, 2018, Pub. L. No. 115-141.), and the

Packet Pg. 93
Council Staff Report (ID # 4827) Meeting of March 14, 2023 Updated: 3/10/2023 9:10 AM by Alberto Quintanilla Page 2 California Early Earthquake Warning program (under CA Govt. Code – Gov, Title 2, Div. 1, Chapter 7, Article 5, Sections 8587.8, 8587.11, 8587.12). Cal OES applies the designation of Authorized Agents to matters concerning these funding sources as well.
DISCUSSION/ANALYSIS: Adoption of a resolution designating agents to enter into agreements and to act on behalf of the City of Fremont is required by Cal OES as a condition of eligibility for Federal and State disaster assistance funding. Generally, when Federal disaster assistance is authorized to the City of Fremont, FEMA considers Cal OES to be the grantee and the City to be the subgrantee.
The proposed resolution designates the same positions previously authorized by City Council.
FISCAL IMPACT: Adoption of the resolution will permit the City of Fremont to continue to obtain financial assistance for all open and future major disasters proclaimed by the Governor of the State of California and declared by the President of the United States.
ENVIRONMENTAL REVIEW: This action is not subject to review under the California Environmental Quality Act (CEQA) under CEQA Guidelines sections 15378 because the action is an administrative governmental activity that will not result in direct or indirect physical changes in the environment.

COUNCIL STAFF REPORT (ID # 4829) DOC ID: 4829
Updated: 3/9/2023 10:30 AM by Alberto Quintanilla Page 1 NEWARK JOINT POWERS AGREEMENT - Authorization to Execute Task Orders to the Joint Powers Agreement with the City of Newark for FY 2022/23 Paratransit Services

Div/Dept: Human Services Department Human Services Department Phone: 510-574-2033 510-574-2051

Executive Summary: The purpose of this report is to request authorization for the City Manager to execute a Task Order for FY 2022/23 to the Joint Powers Agreement with the City of Newark. Task Order No. 27 is for paratransit services to be provided by the Human Services Department to City of Newark residents in the amount of $293,052.
BACKGROUND: For many years, the Human Services Department has provided services for Newark residents under a Joint Powers Agreement (JPA) between the City of Fremont and the City of Newark, specifically, case management services for older adults and paratransit services for older adults and individuals with disabilities.
The existing JPA between the City of Fremont and the City of Newark outlines these services and has been flexibly structured so that new task orders may be executed as needed, such as on an annual basis, to allow for changes in service needs, costs and funding availability.
The existing JPA with Newark is made pursuant to State law and does not create a separate legal entity. Rather, the JPA allows City staff to provide services to Newark residents while retaining the legal protections available when providing municipal services within the City’s jurisdiction.
DISCUSSION/ANALYSIS: The Alameda County Transportation Commission administers the Measure BB sales tax revenues for cities to provide special transportation for older adults and people with disabilities. The City of Newark will use its Measure BB direct local distribution revenues to pay the City of Fremont for paratransit service delivery provided under Task Order No. 27. The City of Fremont has worked with the Cities of Newark and Union City to develop and implement regional transportation services that allow older adults and people with disabilities residing in the Tri-City area to more easily access needed health care, social and recreational opportunities and take care of shopping and other day-to-day needs. The City’s existing JPA with the City of Union City and the City of Newark to provide paratransit services to their respective residents enables all three cities to benefit from economies of scale by streamlining community outreach and education efforts, consolidating staff functions, leveraging funding and providing cost-effective services to Tri-City residents.
Paratransit services to Newark residents for FY 2022/23 will continue to be provided through the City’s contracts with MV Public Transportation, Inc. (for wheelchair accessible van services), Siddiq, Inc. (for taxi services) and with Lyft, Inc. and GoGo Technologies, Inc. (for ride-hailing services).

Council Staff Report (ID # 4829) Meeting of March 14, 2023 Updated: 3/9/2023 10:30 AM by Alberto Quintanilla Page 2
FISCAL IMPACT: Under Task Order No. 27 for FY 2022/23, Newark will reimburse the City in an amount up to $293,052 for all Newark paratransit service delivery costs, including City overhead. The adopted budget for FY 2022/23 includes sufficient appropriations in Fund 176 for the paratransit services described above.
ENVIRONMENTAL REVIEW: These actions are exempt from, and not subject to review under, the California Environmental Quality Act (CEQA) pursuant to, without limitation, CEQA Guidelines section 15061(b)(3) as it can be seen with certainty that these activities will not have a significant effect on the environment and/or Guideline section 15378(b)(2), (4) and/or (5), since the actions are administrative or fiscal activities of the City that will not result in direct or indirect physical changes in the environment. Each of the foregoing provides a separate and independent basis for CEQA exemption.
ATTACHMENTS: None.
RECOMMENDATIONS: Authorize the City Manager or her designee to execute Task Order No. 27 to the existing Joint Powers Agreement with the City of Newark for the provision of FY 2022/23 paratransit services, in the amount not to exceed $293,052.

Updated: 3/10/2023 9:13 AM by Alberto Quintanilla Page 1 CAPITAL IMPROVEMENT PROGRAM – Receive Presentation and Provide Input to Staff on the Preparation of the City’s Five-Year Capital Improvement Program (CIP) for Fiscal Years 2023/24 through 2027/28.

Executive Summary: The purpose of this report is to inform the City Council about the preparation of the City’s five-year CIP and to receive input from Council. A draft CIP is proposed to be brought back to the City Council on May 16, 2023 for review and comment.
Adoption of the CIP is planned for June 2023.
BACKGROUND: The City’s Capital Improvement Program addresses the City’s infrastructure needs and investments, primarily in the areas of Transportation, Parks, Capital Maintenance (streets and buildings), and General Government. The CIP includes a five-year program of planned investments, with the first two years representing a two-year Capital Budget. The CIP is updated every two years. The City’s current CIP includes investments totaling $189 million over five years.
DISCUSSION/ANALYSIS: At the City Council meeting, staff will present an introduction to the Capital Improvement Program (CIP), including fund sources, projected revenue, and a review of current projects and programs.
Preliminary revenue estimates for the new CIP cycle are projected to be higher than the current CIP due to a combination of factors including increases in State Gas Tax and Alameda County Transportation Commission revenue. These increases will help offset rising construction costs and diminishing grant revenues from regional, state, and federal sources.
Revenues related to development impact fees are down and projects that support parks and transportation will be impacted by a revenue loss of over $13 million.
The General Fund makes annual transfers to the CIP program to support ongoing maintenance and capital replacement programs for streets and sidewalks, parks, and public buildings. These annual transfers total $7 million in FY 2022/23. In addition, the General Fund operating budget may include funding for specific CIP projects.
On occasion, the City Council may approve transfers of unanticipated general revenue or expenditure savings from the General Fund to provide a source of funding for future CIP projects or to augment previously approved projects. It is noted that current and future needs for City infrastructure have been estimated to be approximately $1 billion.
Staff recommends that the City Council provide input on the proposed project funding under the CIP, which staff prepared with the intent to align expenditures to City infrastructure

Subsequently, staff will prepare a draft five-year CIP for fiscal years 2023/24 through 2027/28 and a two-year Capital Budget for fiscal years 2023/24 and 2024/25. Staff anticipates returning to Council for review of the Draft CIP on May 16, 2023.
Public Hearings to consider adoption of the CIP are planned for June 6, 2023 (First Hearing) and June 13, 2023 (Second Hearing and Adoption).
FISCAL IMPACT: None
ENVIRONMENTAL REVIEW: The recommended actions are exempt from the California Environmental Quality Act (CEQA) because they are an administrative fiscal activity and not projects pursuant to CEQA Guidelines section 15378.

Topic: To establish consistent use of parliamentary procedures in City Council meetings.
Discussion:
Good Governance calls for focused and orderly meetings. In order to have robust conservations and efficient meetings, it is important for the Chair to be able to effectively run the meeting and for all Councilmembers to follow the same meeting rules and protocols.
Good governance requires a commitment from the City Council to have a shared vision that drives the work of City leadership. The City Council will need to have a governance mindset to govern effectively with a unity of purpose. The City Attorney recently provided a Brown Act training for the City Council, which included an overview of specific parliamentary procedure methods. During the recent City Council retreat, the Councilmembers confirmed their commitment to having more effective and efficient meetings by following Rosenberg’s Rules of Order.
RECOMMENDATION: Direct staff to update the Fremont City Council handbook to incorporate Rosenberg’s Rules of Order as standard rules of order.
