Executive Summary: The purpose of this report is to request authorization for the City Manager to execute a Task Order for FY 2022/23 to the Joint Powers Agreement with the City of Newark. Task Order No. 27 is for paratransit services to be provided by the Human Services Department to City of Newark residents in the amount of $293,052.

BACKGROUND: For many years, the Human Services Department has provided services for Newark residents under a Joint Powers Agreement (JPA) between the City of Fremont and the City of Newark, specifically, case management services for older adults and paratransit services for older adults and individuals with disabilities.

The existing JPA between the City of Fremont and the City of Newark outlines these services and has been flexibly structured so that new task orders may be executed as needed, such as on an annual basis, to allow for changes in service needs, costs and funding availability.

The existing JPA with Newark is made pursuant to State law and does not create a separate legal entity. Rather, the JPA allows City staff to provide services to Newark residents while retaining the legal protections available when providing municipal services within the City’s jurisdiction.

DISCUSSION/ANALYSIS: The Alameda County Transportation Commission administers the Measure BB sales tax revenues for cities to provide special transportation for older adults and people with disabilities. The City of Newark will use its Measure BB direct local distribution revenues to pay the City of Fremont for paratransit service delivery provided under Task Order No. 27. The City of Fremont has worked with the Cities of Newark and Union City to develop and implement regional transportation services that allow older adults and people with disabilities residing in the Tri-City area to more easily access needed health care, social and recreational opportunities and take care of shopping and other day-to-day needs. The City’s existing JPA with the City of Union City and the City of Newark to provide paratransit services to their respective residents enables all three cities to benefit from economies of scale by streamlining community outreach and education efforts, consolidating staff functions, leveraging funding and providing cost-effective services to Tri-City residents.

Paratransit services to Newark residents for FY 2022/23 will continue to be provided through the City’s contracts with MV Public Transportation, Inc. (for wheelchair accessible van services), Siddiq, Inc. (for taxi services) and with Lyft, Inc. and GoGo Technologies, Inc. (for ride-hailing services).

FISCAL IMPACT: Under Task Order No. 27 for FY 2022/23, Newark will reimburse the City in an amount up to $293,052 for all Newark paratransit service delivery costs, including City overhead. The adopted budget for FY 2022/23 includes sufficient appropriations in Fund 176 for the paratransit services described above.

ENVIRONMENTAL REVIEW: These actions are exempt from, and not subject to review under, the California Environmental Quality Act (CEQA) pursuant to, without limitation, CEQA Guidelines section 15061(b)(3) as it can be seen with certainty that these activities will not have a significant effect on the environment and/or Guideline section 15378(b)(2), (4) and/or (5), since the actions are administrative or fiscal activities of the City that will not result in direct or indirect physical changes in the environment. Each of the foregoing provides a separate and independent basis for CEQA exemption.

ATTACHMENTS: None.

RECOMMENDATIONS: Authorize the City Manager or her designee to execute Task Order No. 27 to the existing Joint Powers Agreement with the City of Newark for the provision of FY 2022/23 paratransit services, in the amount not to exceed $293,052.
