Executive Summary: The purpose of this report is to facilitate compliance with the State’s accountability requirements for the use of Senate Bill 1 (SB1) funds. In Fiscal Year (FY) 2023/24, the City of Fremont expects to receive SB1 funds in the amount of $5.68 million and proposes to use these funds for pavement rehabilitation and the Paseo Padre Safety Improvements project.

BACKGROUND: On April 28, 2017, the Governor signed SB1, the Road Repair and Accountability Act of 2017. This bill enabled new revenue for state and local transportation projects through increases in gasoline and diesel fuel excise tax, along with an increase in vehicle registration fees. Portions of the revenues were directly allocated to cities for pavement maintenance, safety improvements, and “complete streets” (enhancing facilities for walking and bicycling.) Other funding will be available on a competitive basis. The expected direct annual revenue for Fremont is $5.68 million for FY 2023/24 and approximately $4-6 million annually over the next decade.

In order to receive direct allocations of the SB1 revenues for FY 2023/24, cities must adopt a Council action and submit a list of projects to the California Transportation Commission (CTC) by July 1st with information about the proposed use of funds related to location, scope, and expected useful life of the project.

DISCUSSION/ANALYSIS: Staff recommends that Fremont’s SB1 funds of $5.68 million for FY 2023/24 and the remaining SB1 funds left unspent from FY 2022/23 be utilized on the following projects:

Project Name SB1 Funding
Amount
Pavement Rehabilitation (PWC 8234-W) $4,000,000
Paseo Padre Parkway Safety Improvements $2,000,000

Any SB1 funds not used for the above listed project will be used for future SB1 projects.

FISCAL IMPACT: The adoption of an SB1 Project List is required by the State to receive $5.68 million in planned state revenue for transportation projects.

Council Staff Report (ID # 4867) Meeting of June 6, 2023 Updated: 5/31/2023 10:20 AM by Alberto Quintanilla Page 2 ENVIRONMENTAL REVIEW: The proposed action is not a project under the California Environmental Quality Act (CEQA) as it is an administrative activity that will not res ult in direct or indirect physical changes in the environment (CEQA Guidelines Section 15378).
