Executive Summary: The purpose of this report is to authorize the execution of the Master Services Agreement for “Tree Planting and Providing Young Tree Care Services ” to JTS Tree Expert, Inc.

BACKGROUND: On December 7, 2021, the City Council approved the submittal of an application to the California Department of Forestry and Fire Protection for the Cal Fire and Urban Community Forestry Program grant and authorized the City Manager or her designee to execute all necessary applications, contracts, agreements, amendments, payment requests, and any other implementing documents and to implement and carryout out the purposes specified in the grant application and project to completion.

On May 25, 2022, Cal Fire awarded the City a grant of $850,000 under the Prop 68 Urban Forest Expansion and Improvement Grant program.

DISCUSSION/ANALYSIS: A Request for Proposals (RFP# 23-001) to implement tree planting and provide young tree care services through the establishment period was publicly released on July 8, 2022. The RFP remained open through August 18, 2022. The scope of work consists of tree planting, young tree care following the planting of trees such as re- staking, young tree pruning, basin, mulching maintenance, watering to support the survival of these trees through the 6-year establishment period, engagement with property owners to gain permission to assist the City in planting efforts on their property, educating property owners on providing long-term maintenance of trees and identifying planting locations.

The City received five competitive proposals for this service: Arborist Now, Calistros, JTS Tree Expert, Los Loza and Professional Tree Care. These proposals were evaluated by three raters applying the following factors: qualifications, feasibility, responsiveness, service agreement and rates. The JTS Tree Expert, Inc., proposal scored the highest.

Staff recommends executing the contract with JTS Tree Expert Inc., through June 30, 2028, with a total not to exceed amount of $320,000.

FISCAL IMPACT: The funding for “Tree Planting and Providing Young Tree Care Services ” is covered by the Cal Fire Grant.

Council Staff Report (ID # 4913) Meeting of June 6, 2023 Updated: 5/26/2023 8:53 AM by Alberto Quintanilla A Page 2 ENVIRONMENTAL REVIEW: Approval of tree planting and providing young tree care services master services agreement is exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) because any environmental impacts associated with any specific tree maintenance activity are speculative at this time, and it is anticipated that compliance with Fremont Municipa l Code Chapter 18.218 (Standard Development Requirements) will be sufficient to avoid such impacts. Typical tree maintenance activity will be exempt pursuant to CEQA Guidelines 15301(h) (maintenance of existing landscaping), but further review may be necessary on a case-by-case basis.

ATTACHMENTS: None

RECOMMENDATION: Authorize the City Manager or her designee to execute the agreement with JTS Tree Expert, Inc., with a total not to exceed amount of $320,000.
