RESOLUTION NO. 2023-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FREMONT ACCEPTING AND ACKNOWLEDGING THE GIFT FROM
THE BELIAS TRUST
WHEREAS, Fremont’s Tri-City Animal Shelter is managed by the Fremont Police Department, Animal Services Unit and shelters animals found in Fremont, Union City and Newark; and
WHEREAS, a trust established by Anastasios (“Tasos”) Belias and Erika Belias (the “Belias Trust”), provides that upon the death of the first spouse, a portion of the trust assets would be distributed to the Tri-City Animal Shelter.
WHEREAS, Mr. Belias passed away on April 2, 2021, the trust is now ready to be distributed, and the amount of the gift to the Tri-City Animal Shelter is approximately $337,279; and
WHEREAS, Chapter 3.20 of the Fremont Municipal Code requires that the City Council take an action to approve acceptance of gifts and donations exceeding $100,000, and for the acquisition of personal property in an amount greater than $100,000.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FREMONT AS FOLLOWS:
SECTION 1. The City Council acknowledges and accepts the gift from the Belias Trust to the Tri-City Animal Shelter in the approximate amount of $337,279, in accordance with the terms of the Trust. The donation revenue and any subsequent trust distributions shall be used for the benefit of the Tri-City Animal Shelter as provided by the Belias Trust.
SECTION 2. The City Council authorizes the City Manager or designee to execute the Termination and Release Agreement.
SECTION 3. The City Council recognizes donation revenue of $337,279, and any subsequent trust distributions, in the Miscellaneous Special Revenue Fund (Fund 210) for the benefit of the Tri-City Animal Shelter (Organization Code 21021910 – Animal Shelter Donations).
SECTION 4. This resolution shall be effective immediately upon passage.
