RESOLUTION NO. 2023-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT
APPROVING A THIRD AMENDMENT TO THE EMPLOYMENT
AGREEMENT WITH THE CITY ATTORNEY
WHEREAS, the City Council of the City of Fremont entered into an Employment Agreement with City Attorney Rafael E. Alvarado Jr. on January 12, 2022; and
WHEREAS, on July 12, 2022, the Employment Agreement was amended to provide the City Attorney a cost of living wage increase in the amount of five percent (5%), commensurate with the wage increase provided to management employees in FY 2022/2023, as set forth in the Memorandum of Understanding between the City and the Fremont Association of Management Employees; and
WHEREAS, on April 18, 2023, the Employment Agreement was further amended to provide a merit-based wage increase to Rafael E. Alvarado Jr., as authorized in Sections 3 and 8.B. of the Employment Agreement, in the amount of five percent (5%); and
WHEREAS, the City Council now desires to further amend the Employment Agreement to provide the City Attorney a salary adjustment as authorized in Section 3 of the Employment Agreement, in the amount of five percent (5%), commensurate with the wage increase provided to management employees in FY 2023/2024, as set forth in the Memorandum of Understanding between the City and the Fremont Association of Management Employees.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Fremont authorizes the Mayor to execute the Third Amendment to the Employment Agreement with the City Attorney to provide a salary adjustment in the amount of five percent (5%), in a form to be approved by the City Attorney’s Office.
