Executive Summary: The purpose of this report is to facilitate the City’s timely response to emergencies involving hazardous materials, as well as to address the disposal of hazardous and contaminated materials associated with ongoing City maintenance and cleaning operations.

BACKGROUND: Many of the City’s services require a timely response and safe handling of hazardous and contaminated materials. Situations include emergency hazardous material spills managed by the Fire and Police Departments; cleanup of homeless encampments and illegal dumping; and the scheduled disposal of hazardous and contaminated materials related to vehicle maintenance, storm drain cleaning, and street sweeping operations. The City has contracted with environmental specialists to address the removal of hazardous materials in a manner that is safe, timely and compliant with environmental regulations.

The City’s contract for hazardous material support services is due for renewal. The estimated cost of these services can be up to $300,000 per fiscal year.

DISCUSSION/ANALYSIS: The City issued a Request for Proposals (RFP) on April 20, 2023 for Emergency Hazardous Materials (HazMat) Response Services. The City received proposals on May 31, 2023 from the following three contractors: Environmental Logistics, Inc., Patriot Environmental Services, and US Ecology.

After review, it was determined that Environmental Logistics Inc. is best qualified and has the means necessary to perform the services as outlined in the RFP. Staff recommends executing a service agreement with Environmental Logistics for a five-year period from July 1, 2023 through June 30, 2028.

The proposed compensation would be up to $300,000 per fiscal year, for a total not to exceed amount of $1,500,000 for a five-year period.

FISCAL IMPACT: The recommended action has a total not-to-exceed amount of $1,500,000 over a five-year period, through June 30, 2028. The source of funding is from the General Fund Operating Budget for Public Works HazMat, in combination with the Solid Waste Fund for Environmental Services.

Council Staff Report (ID # 4963) Meeting of July 18, 2023 Updated: 7/11/2023 8:37 AM by Alberto Quintanilla Page 2 ENVIRONMENTAL REVIEW: The proposed Emergency Hazardous Materials Response Agreement is exempt from the requirements of the California Environmental Quality Act (CEQA) per, without limitation, each on a separate and independent basis, (1) CEQA Guidelines Section 15301(b) “Existing Facilities”, as the scope of work involves cleaning of existing public sewerage and stormwater facilities; (2) CEQA Guidelines Section 15308 “Actions by Regulatory Agencies for Protection of the Environment”, as the proposed agreement would assure the maintenance, restoration, or protection of the environment and the regulatory process involves procedures for protection of the environment; and (3) CEQA Guidelines Section 15330 “Minor Actions to Prevent, Minimize, Stabilize, Mitigate or Eliminate the Release or Threat of Release of Hazardous Waste or Hazardous Substances”, as the proposed agreement would authorize minor cleanup actions to prevent, minimize, stabilize, mitigate, or eliminate the release or threat of release of a hazardous waste or substance.

ATTACHMENTS: None.

RECOMMENDATION: Authorize the City Manager or designee to execute a Service Agreement with Environmental Logistics Inc. to provide Emergency Hazardous Materials Response Services effective July 1, 2023, through June 30, 2028, with a total contract amount for a five-year period not-to-exceed $1,500,000.
