Executive Summary: The purpose of this report is to facilitate the development of two transportation projects that were approved for funding by Alameda County Transportation Commission (ACTC).

BACKGROUND: In November 2014, Alameda County voters approved Measure BB to increase multi-modal transportation investment Countywide. The program is administered by ACTC. On June 7, 2023, ACTC approved the allocation of Measure BB funding for their 2024 Capital Investment Program (CIP), including the following two City of Fremont projects: East Bay Greenway Trail (Irvington to Fremont BART) Project in the amount of $1,033,000; and Fremont Boulevard/Walnut Avenue Bikeway Project in the amount of $1,100,000.

Execution of Project Funding Agreements with Alameda CTC is required to develop the environmental clearance, preliminary engineering, and final design of the projects.

DISCUSSION/ANALYSIS: ACTC has approved Measure BB project grants for the following two projects in Fremont:

1. East Bay Greenway (Irvington to Fremont BART): The project proposes to construct a segment of the East Bay Greenway Regional Trail, extending from Irvington District to Fremont Central Park, as well as a new Class I trail connection between the East Bay Greenway Trail to the Fremont BART station. The project will connect numerous affordable housing development sites near the future Irvington BART Station to the Fremont Downtown/City Center District and the Fremont BART Station. Funding provided by ACTC is for final design. Environmental clearance and preliminary engineering will be funded by local funding sources. The project is identified as a priority in the City’s Trails Strategy Plan and in the Alameda County Transportation Plan.

2. Fremont Boulevard/Walnut Avenue Bikeway Project: The project consists of constructing elevated bikeways along Walnut Avenue from Paseo Padre Parkway to Fremont Boulevard and along Fremont Boulevard from Country Drive to Stevenson Boulevard. Existing intersections within the project corridor will be reconstructed to Council Staff Report (ID # 4994) Meeting of September 19, 2023 Updated: 9/13/2023 1:22 PM by Susan Gauthier Page 2
provide new protected intersections with upgraded traffic signal equipment. The elevated bikeways along Walnut Avenue will be an extension of the elevated bikeways recently constructed from Mission Boulevard to Paseo Padre Parkway.

Funding provided by ACTC is for final design. Environmental clearance and preliminary engineering will be funded by local funding sources. The project is identified as a priority in the City’s Bicycle Master Plan and in the Alameda County Transportation Plan.

It is noted that as part of the funding source, each project will include a City appropriation of $25,000 in State Senate Bill 1 (SB1) funds as well as local matching funds of approximately $534,000. The source of the additional local matching funds will be identified for appropriation at the time of approval of future agreements/contracts for each project.

FISCAL IMPACT: Approval of the project funding agreements with ACTC will allow the City to receive the approximately $2,133,000 for the projects listed above, with an approximately $534,000 local match. The funding source for local match required for each of the projects will be identified at the time of approval of future professional service agreements/contracts.

ENVIRONMENTAL REVIEW: Execution of Measure BB Project Funding Agreements constitute a funding and administrative activity which is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15061(b)(3) and 15378(b), as it can be seen with certainty that there is no possibility that the activity will have a significant effect on the environment. The projects associated with these funding agreements will undergo environmental review in compliance with CEQA.

ATTACHMENTS: None.

RECOMMENDATIONS:

1. Authorize the City Manager or his designee to execute Project Funding Agreements for the East Bay Greenway Trail (Irvington to Fremont BART) Project and the Fremont Boulevard/Walnut Avenue Bikeway Project.

2. Appropriate $1,033,000 in ACTC funds to PWC9101-504, and reallocate $25,000 in SB-1 funds from PWC8234-134 (SB-1-RMRA State Gas Tax 2030) to PWC9101-134 for the East Bay Greenway Trail (Irvington to Fremont BART) Project.

3. Appropriate $1,100,000 in ACTC funds to PWC9100-504, and reallocate $25,000 in SB-1 funds from PWC8234-134 (SB-1-RMRA State Gas Tax 2030) to PWC9100-134 for the Fremont Boulevard/Walnut Avenue Bikeway Project.

4. Find the action constitutes a funding and administrative activity which is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15061(b)(3) and 15378(b), as as it can be seen with certainty that there is no possibility that the implementation of the agreements will have the potential for causing a significant effect on the environment. The projects associated with these funding agreements will undergo environmental review in compliance with CEQA.
