Executive Summary: The purpose of this report is to request authorization for the City Manager to execute two Task Orders for FY 2023/24 to the Joint Powers Agreement with the City of Union City. These Task Orders define the paratransit services that will be provided to participants of the City’s Ride-On Tri-City! Program.

Task Order No. 11 is for taxi and ride-hailing services to be provided by the Human Services Department to Union City residents in the amount of $54,000. Task Order No. 12 is for Wheelchair Accessible Van services to be provided by the City of Union City to Fremont and Newark residents in the amount of $799,875.

BACKGROUND: Since 2017, the City’s Ride-On Tri-City! Program has provided paratransit services for Union City residents under a Joint Powers Agreement (JPA) between the City of Fremont and the City of Union City. Under this arrangement, Union City seniors and individuals with disabilities receive subsidized taxi or ride-haling services through the City’s Ride-On Tri-City! Program and the City of Union City reimburses Fremont for these services.

For FY 2023/24, an additional task order to the JPA will be executed for paratransit services that the City of Union City will provide for the City’s Ride-On Tri-City! Program.

The existing JPA between the City of Fremont and the City of Union City outlines the provision of paratransit services and has been flexibly structured so that new task orders may be executed as needed, such as on an annual basis, to allow for changes in service needs, costs and funding availability. The existing JPA with Union City is made pursuant to State law and does not create a separate legal entity. Rather, the JPA allows Fremont to provide services to Union City residents and Union City to reciprocate services to residents served by the City while retaining the legal protections available when providing municipal services within the City’s jurisdiction.

DISCUSSION/ANALYSIS: The City of Fremont has worked with the Cities of Newark and Union City to develop and implement regional transportation services that allow elderly and disabled Tri-City residents to access needed health care, social and recreational opportunities and to take care of shopping and other day-to-day needs more easily. These services are provided through Ride-On Tri-City!, a program of the City’s Human Services Department.

Council Staff Report (ID # 5014) Meeting of October 10, 2023 Updated: 10/5/2023 12:40 PM by Susan Gauthier Page 2
The City’s existing JPA with the City of Union City and the City of Newark to provide paratransit services to their respective residents enables all three cities to benefit from economies of scale by streamlining community outreach and education efforts, consol idating staff functions, leveraging funding and providing cost-effective services to Tri-City residents.

These transportation services have been funded by the Measure B/BB sales tax revenues that are administered by the Alameda County Transportation Commission (Alameda CTC).

The direct local distribution funding the cities receive from Alameda CTC helps the cities plan for and implement affordable, reliable and accessible transportation services for older adults and people with disabilities living in Fremont, Newark and Union City.

The City of Union City will continue to use its Measure BB direct local distribution revenues to reimburse the City of Fremont for paratransit taxi and ride-hailing services for Union City residents provided under Task Order No. 11. In FY 2023/24 these services for Union City residents will continue to be provided through the City’s contracts with Siddiq, Inc. (for taxi services) and with Lyft, Inc. and GoGo Technologies, Inc. (for ride-hailing services).

In July 2022, the City partnered with the City of Union City to include its Wheelchair Accessible Van services in Union City’s Request for Proposals (RFP) to secure a service provider for Union City Transit and Paratransit operations. This action was taken by the City to address the declining interest from transportation service providers to operate the City’s Wheelchair Accessible Van service due to the high operational costs of running a relatively small accessible transportation service. As a result of this partnership, the City is able to maintain this essential wheelchair accessible transportation service for Ride-On Tri-City! program participants residing in Fremont and Newark.

For FY 2023/24, Union City’s provision of Wheelchair Accessible Van services to the City’s Ride-On Tri-City! participants will be added as Task Order No. 12 to the JPA. Under Task Order No. 12, the City will reimburse Union City for the paratransit costs associated with this service.

FISCAL IMPACT: Under Task Order No. 11 for FY 2023/24, Union City will reimburse the City of Fremont in an amount up to $54,000 for all service delivery costs provided to Union City residents. Under Task Order No. 12 for FY 2023/24, The City of Fremont will reimburse the City of Union City in an amount up to $799,875 for all service delivery costs provided to Fremont and Newark residents. The City of Newark will reimburse the City of Fremont for all service delivery costs for Newark residents. The City’s FY 2023/24 Operating Budget includes sufficient appropriations in Fund 252 and Fund 176 for the paratransit services described above.

ENVIRONMENTAL REVIEW: The action is exempt from CEQA pursuant to, without limitation, CEQA Guidelines Section 15378(b)(2), (4) and/or (5), and/or 15061(b)(3) as an administrative or fiscal activity that has no potential to cause a significant effect on the environment, directly or indirectly, each of the foregoing providing a separate and independent basis for CEQA exemption.

ATTACHMENTS: None.
