Executive Summary: The City issues annual purchase orders to U.S. Foods Inc. (U.S. Foods) to provide food service-related supplies at the City’s Aqua Adventure Waterpark (Waterpark). The purpose of this report is to recommend the City Council delegate authority to the City Manager or her designees to execute annual purchase orders with U.S. Foods, not to exceed $250,000 per fiscal year, through June 30, 2027.

BACKGROUND: Since the Waterpark opened in May of 2009, U.S. Foods has provided food and supplies to support the Waterpark food activities. These food items are prepared at the Waterpark and then sold to customers at various food outlets throughout Central Park, including sports snack bars and event catering. The Waterpark serves approximately 70,000 guests annually and additional customers make purchases through the sports snack bars and event catering services.

DISCUSSION/ANALYSIS: The City Age Well Centers (through a separate annual purchase order) and the Waterpark participate as part of a cooperative purchasing organization through OMNIA Partners for public sector procurement, allowing the City to receive unit cost savings through controlled pricing and group purchasing. The selection and contract award to U.S. Foods follows the City’s cooperative competitive process. The cooperative competitive process consists of a service competitively bid by another agency and meets the City’s requirement in the Purchasing Ordinance, Fremont Municipal Code section 3.20.180.

The $250,000 annual purchase orders with U.S. Foods will provide the purchasing authority to meet the consumable food demand at the Waterpark and Central Park as well as the incremental increase in product costs. Food service demand continues to rise with the popularity of the Palms Pavilion and the addition of the Summer Camp Lunch Program.

Staff recommends the City Council delegate authority to the City Manager or her designee to execute annual purchase orders in an amount not to exceed $250,000 per fiscal year through June 30, 2027. This timeline aligns with the anticipated expiration date of the cooperative contract.

These purchase orders will not preclude the City from purchasing food products from other vendors with better pricing for specific items.

FISCAL IMPACT: The General Fund will not be impacted. The Recreation Cost Center (Fund 189) covers the cost of any food and supply purchases as these costs are offset by the revenue generated. The appropriation for these costs is included in the adopted annual operating budget for the Community Services Department.

ENVIRONMENTAL REVIEW: The action is exempt from CEQA pursuant to, without limitation, CEQA Guidelines Section 15378(b)(2), (4) and/or (5), and/or 15061(b)(3) as an administrative or fiscal activity that has no potential to cause a significant effect on the environment, directly or indirectly, each of the foregoing providing a separate and independent basis for CEQA exemption.

ATTACHMENTS: None.

RECOMMENDATION: Authorize the City Manager or her designee to execute annual purchase orders with U.S. Foods Inc. for the Waterpark for food and supplies in an amount not to exceed $250,000 per fiscal year through June 30, 2027.
